日本国における英連邦戦死者墓地の一部返還に関する日本国政府とニュー・ジーランド政府との間の交換公文

書簡をもつて啓上いたします。本使は、千九百五十五年九月二十一日に署名された日本国における英連邦戦死者墓地に関する協定及び同協定に附属する同日付けの交換公文(以下「協定」という。)に言及するとともに、協定にいう目的のため連邦戦死者墓地委員会(以下「委員会」という。)が日本国政府にょつて使用を認められている土地の一部を通過する高速道路を横浜地区において建設するという日本道路公団の計画に関連して、委員会と協議の上、委員会の事業に現在参加している政府であるグレート・ブリテン及び北部アイルランド連合王国、カナダ、オーストラリア、ニュー・ジーランド、南アフリカ共和国及びインドの政府(以下「参加国政府」という。)に代わつて、次のことを申し述べる光栄を有します。
Excellency, I have the honour to refer to the Agreement relative to the British Commonwealth war Cemetery in Japan signed on September 21,1955 and the Exchange of Notes attached to the said Agreement of the same date (hereinafter referred to as the "Agreement"), and ,in connection with the ongoing plan of the Japan Highway Public Corporation to construct a motorway on the Yokohama area which would pass through part of the land the use of which has been granted by the Government of Japan to the commonwealth War Graves Commission (hereinafter referred to as the "Commission ")for the purpose set forth in the Agreement, to state the following on behalf of the Government of the United Kingdom of Grate Britain and Northern Ireland, Canada, Australia, New Zealand, the Republic of South Africa and India being the Government at present participating in the work of the Commission(hereinafter referred to as the "Government of the Participating Countries")in consultation with the Commission.
1 委員会は、日本国政府が、日本道路公団により計画されている英連邦戦死者墓地内における高速道路の建設のため、協定に基づき委員会が使用を認められている土地の一定の部分を必要としている事実にかんがみ、千九百七十七年九月三十日から同部分を協定にいう目的のために使用することを終止し、これを日本国政府に返還する。
1. The Commission will cease to use for the purposes set forth in the Agreement certain portions of the land the use of which has been granted to the Commission under the Agreement and will return them to the Government of Japan as from September 30,1977,in view of the fact that the Government of Japan will require those portions for the construction of the motorway in the area of the British Commonwealth War Cemetery, as contemplated by the Japan Highway public Corporation.
2 返還される土地の部分は、この書簡に附属する地図に斜線で示される。
2. The portions of the land to be returned hereunder are indicated by oblique lines in the Maps attached herewith.
本使は、前記の土地の部分の返還に伴い、協定は、その返還の日から土地の同部分に適用されないこととなるというのが参加国政府の了解であることを申し述べる光栄を有します。
I have the honour to state that it is the understanding of the Governments of the participating Countries that in consequence of the return of the portions of the land as specified above, the Agreement will cease to apply to the said portions of the land as from the date of their return.
本使は、更に、閣下に対し、このことが日本国政府の了解でもあることを日本国政府に代わつて確認されるよう要請する光栄を有します。
I have the honour further to request Your Excellency's confirmation on behalf of the Government of Japan that this is also the understanding of the Government of Japan.
