科学技術の分野における協力に関する日本国政府とドイツ民主共和国政府との間の交換公文

(Note of the German Democratic Republic) Tokyo, November 16, 1977
書簡をもつて啓上いたします。本官は、科学技術の分野における両国間の協力を促進するというドイツ民主共和国政府及び日本国政府の共通の希望に基づく次の取極を本国政府に代わつて提案する光栄を有します。
Excellency,I have the honour to propose, on behalf of the Government of the German Democratic Republic, the following arrangements which are based on the common desire of the Government of the German Democratic Republic and the Government of Japan to promote co-operation between the two countries in the field of science and technology:
1 両政府は、科学技術の分野における協力を相互主義の原則に基づき促進する。
1. The two Government s will promote co- operation in the field of science and technology on the basis of reciprocity.
この協力は、次の形態により行うことができる。
Such co-operation may take the following forms:
(a) いずれか一方の政府が派遣する科学者及び技術者の交換
(a) Exchange of scientists and technicians sent by either Government;
(b) 公の研究機関の科学者及び技術者による会議、シンポジウム、パネル会合及び科学技術展示会の開催
(b) Holding of conferences, symposia, panel meetings and displays of scientific and technological results by scientists and technicians belonging to official research institutions;
(c) 公の研究機関の間の科学技術の分野における研究結果の交換
(c) Exchange of results of research in the field of science and technology between official research institutions
(d) 公の研究機関の間の科学技術の分野における出版物その他の情報の交換
(d) Exchange of publications and other information in the field of science and technology between official re search institutions;
(e) 将来両政府間で合意することがあるその他の形態
(e) Such other forms as may be agreed upon between the two Governments in the future.
2 両政府は、両国間の科学技術協力に関し、外交経路を通じて随時協議する。
2. The two Governments will from time to time consult with each other through diplomatic channels with respect to scientific and technological co-operation between the two countries.
3 両政府は、両国の各種団体及び機関並びに個人間の科学技術協力をできる限り促進する。
3. The two Governments will promote as much as possible scientific and technological co-operation between various organisations and institutions as well as individuals of the two countries.
4 この取極は、それぞれの国の現行法令の範囲内で実施される。
4. The present arrangements shall be implemented within the scope of the laws and regulations in force in each country.
5 この取極は、二年間効力を有し、その後は、最初の二年の期間の終わりに又はその後いつでもいずれか一方の政府が他方の政府に対しこの取極を終了させる意思を三箇月前に文書により予告することによつて終了させない限り効力を存続する。
5. The present arrangements shall remain in force for a period of two years and will continue in force thereafter unless terminated by either Government at the end of the initial two year period or at any time thereafter by giving to the other Government three months written notice of its intention to terminate the Present arrangements.
本官は、更に、前記の取極が日本国政府にとつて受諾し得るものであるときは、この書簡及び閣下のその旨の返簡が両政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。
If the foregoing arrangement s are acceptable to the Government of Japan, I have further the honour to propose that this Note and Your Excellency's reply to that effect shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of Your Excellency's reply.
本官は、以上を申し進めるに際し、ここに閣下に向かつて敬意を表します。 千九百七十七年十一月十六日に東京で

I have further the honour to inform Your Excellency that the foregoing arrangements are acceptable to the Government of Japan and to agree that Your Excellency's Note and this reply shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of this reply. I avail myself of this opportunity to extend to Your Excellency the assurance of my highest consideration.
