PROTOCOL SUSPENDING THE APPLICATION OF SAFEGUARDS UNDER THE AGREEMENT BETWEEN THE INTERNATIONAL ATOMIC ENERGY AGENCY,THE GOVERNMENT OF CANADA AND THE GOVERNMENT OF JAPAN FOR THE APPLICATION OF AGENCY SAFEGUARDS IN RESPECT OF THE BILATERAL AGREEMENT BETWEEN THOSE GOVERN-MENTS FOR CO-OPERATION IN THE PEACEFUL USES OF ATOMIC ENERGY

　国際原子力機関、カナダ政府及び日本国政府は、千九百五十九年七月二日にオタワで署名された原子力の平和的利用における協力のためのカナダ政府と日本国政府との間の協定(以下「協力協定」という。)並びに千九百六十六年六月二十日にウィーンで署名された協力協定に対する国際原子力機関による保障措置の適用に関する国際原子力機関、カナダ政府及び日本国政府の間の協定(以下「三者間協定」という。)を想起し、カナダ及び日本国が核兵器の不拡散に関する条約に加入していることに留意し、次のとおり協定した。

　The International Atomic Energy Agency, the Government of Canada and the Government of Japan;
RECALLING the Agreement between the Government of Canada and the Government of Japan for co-operation in the Peaceful Uses of Atomic Energy signed at Ottawa on 2 July 1959 (hereinafter referred to as to the Co-operation Agreement" ) as well as the Agreement between the International Atomic Energy Agency, the Government of Canada and the Government of Japan for the Application of Agency Safeguards in respect of the Co-operation Agreement signed at Vienna on 2O June 1966 (hereinafter referred to as "the Trilateral Agreement" );
NOTING the adherence of Canada and Japan to the Treaty on the Non-Proliferation of Nuclear Weapons;
HAVE agreed as follows:

第一条
　核兵器の不拡散に関する条約第三条1及び4の規定の実施に関して協力協定のいずれか一方の当事国政府と国際原子力機関との間で締結される協定(以下「保障措置協定」という。)が効力を有する間、協力協定の当該一方の当事国政府に関する限り、三者間協定の保障措置の適用は、停止する。

ARTICLE I 
　For such time as the Agreement concluded between either Party to the Co-operation Agreement and the International Atomic Energy Agency in implementation of Article III, l and 4 of the Treaty on the Non-Proliferation  of Nuclear Weapons (hereinafter referred to as "the Safeguards Agreement") is in force, the application of the safeguards of the Trilateral Agreement shall be suspended, insofar as that Party to the Co-operation Agreement is concerned.

第二条
　この議定書は、署名の日に効力を生じ、かつ、いずれか一方の保障措置協定が効力を有する間効力を有する。

ARTICLE II 
　This Protocol shall enter into force on the date of signature and shall remain in force for as long as either of the Safeguards Agreement s remains in force.

　千九百七十七年十二月二日にウィーンて、ひとしく正文である英語及びフランス語により本書三通を作成した。

　DONE in Vienna this 2nd day of December 1977 in triplicate in the English and French languages, the texts in both languages being equally authentic.
