日本国とアメリカ合衆国との間の相互防衛援助協定に基づくＦ－四ＥＪ航空磯の追加生産及び取得に関する交換公文

書簡をもつて啓上いたします。本使は、千九百五十四年三月八日に東京で署名されたアメリカ合衆国と日本国との間の相互防衛援助協定に言及する光栄を有します。同協定は、各政府が、他方の政府に対し、援助を供与する政府が承認することがある装備、資材、役務その他の援肋を、両政府の間で行うべき細目取極に従つて、使用に供するものとすることを特に規定しています。この規定に従つて、アメリカ合衆国政府と日本国政府との間で、千九百六十九年四月四日に、前記の相互防衛援助協定の条項に基づいて百四機を限度とするF－四EJ航空機並びに関連する装備及び資材を日本国において生産し及び取得する計画について合意が成立しました。更に千九百七十二年十一月二十一日には、両政府の間で、二十四機を限度とするF―四EJ航空機の追加計画に関し合意が成立しました。
Excellency,I have the honor to refer to the Mutual Defense Assistance Agreement between the United States of America and Japan signed at Tokyo on March 8, 1954, which provides 1 inter alia, that each Government will make available to the other such equipment, materials, services, or other assistance as the Government furnishing such assistance may authorize, in accordance with such detailed arrangements as may be made between them. In pursuance of this provision 1 an agreement was reached between the Government of the United States of America and the Government of Japan on April 4, 1969 concerning a program for the production and acquisition in Japan of up to one hundred and four (104) F-4EJ aircraft and related equipment and materials under the terms and provisions of the said Mutual Defense Assistance Agreement. on November 21, 1972 further agreement was reached between the two Governments concerning an additional program for up to twenty four (24) F-4EJ aircraft.
アメリカ合衆国政府及び日本国政府の代表者は、前記の両計画に継続して実施すべき計画について討議を行いました。この討議の結果による合衆国政府の了解は、次のとおりであります。
The representatives of the Government of the United States of America and the Government of Japan have held discussions on a program to be pursued following the above-mentioned two programs. The following is the understanding by the Government of the United States of America of the results of the above-mentioned discus s ions:
1 3の規定に基づき締結される細目取極に従い、日本国政府は、前記の百二十八機に加えて追加のF―四EJ航空機並びに関連する装備及び資材を生産し又は取得し、合衆国政府は、追加のF―四EJ航空機並びに関連する装備及び資材の生産又は販売を承認する。
1. In accordance with the detailed arrangements to be concluded under paragraph 3, the Government of Japan will produce or acquire F-4EJ aircraft and related equipment and materials in addition to the above -mentioned one hundred and twenty-eight (128 ) aircraft and the Government of the United States of America will authorize the production or sale of additional F-4EJ aircraft and related equipment and materials.
2 F―四EJ航空機並びに関連する装備及び資材の生産は、日本国政府の経済上及び技術上の要件が満たされるべきであるとの原則に従い、合衆国及び日本国の企業が参加して実施される。合衆国政府は、日本国政府に直接販売を行うことにより、前記の計画を補足する。
2. The production of F-4EJ aircraft and related equipment and materials will be undertaken through the participation of the industries of the United States and Japan in accordance with the principle that the economic and technological requirements of the Government of Japan are to be satisfied. The above-mentioned programs will be supplemented by direct sale by the Government of the United States of America to the Government of Japan.
3 この了解は、前記の協定及びこれに基づく取極(千九百五十六年三月二十二日に署名された防衛目的のためにする特許権及び技術上の知識の交流を容易にするためのアメリカ合衆国政府と日本国政府との間の協定を含む。)に従つて実施され、その実施のための細目取極は、両政府の権限のある当局の代表者により締結される。
3. The present understanding will be implemented in accordance with the above-mentioned Mutual Defense Assistance Agreement and arrangements concluded thereunder, including the Agreement between the Government of the United States of America and the Government of Japan to Facilitate Interchange of Patent Rights and Technical Information for Purposes of Defense signed on March 22, 1956. The detailed arrange- menus to implement the present understanding will be concluded between representatives of the competent authorities of the two Governments.
4 この了解及びこれに基づき締結されるすべての取極に基づき日本国政府の行う財政上の債務の負担又は支出は、日本国の憲法上の規定に従つた予算の承認を得たところにより行う。
4. Financial obligations or expenditures incurred by the Government of Japan under the to be concluded hereunder will be subject to budget authorization pursuant to the constitutional provisions of Japan.
本使は、この了解が日本国政府により受諾される場合には、この書簡及び受諾する旨の閣下の返簡が両政府間の合意を構成するものとみなし、この合意がその効力発生のために必要なアメリカ合衆国政府の国内手続を完了した旨の同国政府からの書面により通告を日本国政府が受領した日に効力を生ずることを提案する光栄を有します。
I have the honor to propose that, if the above understanding is acceptable to the Government of Japan l the present Note and Your Excellency Is reply of acceptance shall be regarded as constituting an agreement between the two Government s which shall enter into force on the date of the receipt by the Government of Japan of the written notification from the Government of the United States of America of the completion of necessary domestic procedures for the entry into force of such agreement.

I have the honor to confirm on behalf of my Government that the foregoing understanding is acceptable to the Government of Japan and to agree that Your Excellency's Note and this reply shall be regarded as constituting an agreement between the two Governments which shall enter into force on the date of the receipt by the Government of Japan of the written notification from the Government of the United States of America of the completion of necessary domestic procedures for the entry into force of such agreement.
