Washington, June 17, 1977

　書簡をもつて啓上いたします。本代表は、千九百七十六年六月十一日にアメリカ合衆国政府と日本国政府との間で交換された書簡(以下「交換された書簡」という。)に言及するとともに、交換された書簡6(b)に基づき、アメリカ合衆国政府に代わつて次の取極を提案する光栄を有します。

　Excellency,I have the honour to refer to the Notes exchanged between the Government of the United States of America and the Government of Japan on June l1 1 1976 (hereinafter referred to as of, the Notes exchanged") and, pursuant to paragraph 6 (b) of the Notes exchanged 1 to propose on behalf of the Government of the United States of America the following arrangements:

1　この書簡の附属に記載する種類の鋼(合衆国関税率表品目九二三・二五)は、交換された書簡にいう「合金工具鋼」から除外され、かつ、その結果交換された書簡及びこれに関連する交書の適用を受けない。

1. The type of steel described in the Attachment to the present Note (TUSKS item 923.25) will be excluded from "alloy tool steel" referred to in the Notes exchanged and, consequently, will not be subject to the Notes exchanged and the documents related thereto.

2　1にかかわらず、交換された書簡の付表B及び付表Cにいう各規制期間における基礎枠及び増大し得る百分率の最大限度は、影響を受けないものとし、またこの書簡の附属に記載する種類の鋼の日本国からの従前の輸出は、第一規制期間又はその後の規制期間における「合金工具鋼」(合衆国関税率表品目九二三・二六)の基礎枠に計上しない。

2. Notwithstanding paragraph 1 above 1 the base limits and the maximum percentage increases for any restraint period referred to respectively in Annex B and Annex C to the Notes exchanged will not be affected, and the previous Japanese exports of the type of steel described in the Attachment to the present Note will not be counted against the base limit of "alloy tool steel" (TUSKS item 923.26) for the first restraint period or for any sub sequent restraint period.

　本代表は、更に、この書簡及び日本国政府に代わつて前記の取極を確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。

　I have further the honour to propose that the present Note and Your Excellency's Note in reply confirming the above arrangements on behalf of the Government of Japan shall be regarded as constituting an agreement between the two Governments which will enter into force on the date of Your Excellency's reply.

　ある種の合金工具鋼(合衆国関税率表品目九二三・二五)の定義

　Definition of Certain Alloy Tool Steels (TUSKS 923.25)

　品目六〇八・五二、六〇八・七六、六〇八・七八、六〇八・八五、六〇八・八八、六〇九・〇六、六〇九・〇七及び六〇九・の八に定める種類の合金工具鋼で、鉄に加えて次の各元素を次に掲げる重量比で含有するもの

　Alloy tool steel of the types provided for in items 608.52 1 608.76, 608.78, 608.85, 608.88, 609.06, 609.07, and 609 .08, which contain, in addition to iron, each of the following elements by weight in the amounts specified:

　炭素〇・九五パーセントから一・一三パーセントまで

　carbon: not less than 0.95 nor more than 1.13 percent;

　マンガン〇・二二パーセントから〇・四八パーセントまで

　manganese: not less than 0.22 nor more than 0.48 percent;

　硫黄含有しないか又は〇・四八パーセントまで

　sulfur: none 1 or not more than  0.03 percent;

　りん含有しないか又は〇・〇三パーセントまで

　phosphorus: none, or not more than 0.03 percent;

　けい素〇・一八パーセントから〇・三七パーセントまで

　silicon: not less than 0.18 nor more than 0.37 percent;

　タロム一・二五パーセントから一・六五パーセントまで

　chromium: not less than 1.25 nor more than 1.65 percent;

　ニッケル含有しないか又は〇・二八パーセントまで

　nickel: none, or not more than 0.28 percent;

　銅含有しないか又は〇・三八パーセントまで

　copper: none 1 or not more than 0. 38 percent;

　モリプデン含有しないか又は〇・〇九パーセントまで

　molybdenum: none 1 or not more than 0.09 percent.

　書簡をもつて啓上いたします。本使は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。

　Excellency,I have the honour to acknowledge the receipt of Your Excellency l s Note of today's date which reads as follows:

　本使は、更に、日本国政府に代わつて前記の取極を確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずることに同意する光栄を有します。

　I have further the honour to confirm the foregoing arrangement s on behalf of my Government and to agree that Your Excellency is Note and this Note shall be regarded as  constituting an agreement between the two Government s which will enter into force on the date of this reply.
