ARRANGEMENT BETWEEN JAPAN AND THE UNION OF SOVIET SOCIALIST REPUBLICS FOR THE REGULATION OF PELAGIC WHALING IN THE SOUTHERN HEMISPHERE
千九百四十六年十二月二日にワシントンで署名された国際捕鯨取締条約(以下「条約」という。)の締約政府である日本国及びソヴィエト社会主義共和国連邦の政府は、
The Governments of Japan and of the Union Soviet Socialist Republics, being Parties to the International Convention for the Regulation of Whaling, signed at Washington on December 2, 1946 (hereinafter referred to as "the Convention"),
次のとおり協定した。
Have agreed upon the following arrangements:
第一条 この取極の適用上、「解禁期」とは、条約の付表２(a)から(a)までの規定に基づき南半球にかけるいわし鯨、ミンク鯨及びまつこう鯨の捕獲が許される期間をいう。
ARTICLE 1 For the purpose of the present Arrangement, the term "season" shall mean the season during which the taking of sei whales, minke whales and sperm whales in the Southern Hemispher permitted under subparagraphs (a), (b), (c) and (d) of paragraph 2 of the Schedule to the Convention.
第二条 千九百七十六年･千九百七十七年解禁期において、条約に基づき南半球における母船による捕獲を認められたいわし鯨、ミンク鯨及び･(i)つこう鯨の総割当頭数のうちの日本国及びソヴィエト社会主義共和国連邦の割当頭数は、次((1)とおり両国の間に配分する。
ARTICLE 2 In the 1976/77 season, of the total quota of sei whales, minke whales and sperm whales, authorized under the Convention to be taken in the Southern Hemisphere by Pelagic expeditions, the quota alloted to Japan and the Union of Soviet Socialist Repulics shall be allocated between the two countries in the following manner:

第三条 (1) 次のいずれかの区域又は区分に￠けるいずれか一方の政府の管轄下にある母船による捕獲頭数は、次の限度を超えてはならないの

(2) (1)の規定にかかわらず、いずれか一方の政府の管轄下にある母船による区域別又は区分別の捕獲頭数の合計は、前条にかいてそれぞれの国に配分された割当頭数を超えてはならない。
(2) Notwithstanding the above provisions, sum of the Area or the Division catches by pelagic expeditions under the jurisdiction either Government shall not exceed the quotas for their respective countries as allocated in Article 2.
第四条 この取極の締約政府でない政府の管轄下にある母鉛が南半球にかける捕鯨ざ従事し、かつ、当該政府が条約の締約政府であり又は締約政府となつた場合に粒、この取極は、終了する。
ARTICLE 4 If a factory ship under the jurisdiction of a Government which is not a Party to the present Arrangement should engage in pelagic whaling in the Southern Hemisphere and that Government is or becomes a Party to the Convention, the present Arrangement shall be terminated.
第五条 この取極は、前交に掲げる政府によつて署名された日に効力を生ずる。
ARTICLE 5 The present Arrangement shall enter into force on the day upon which it is signed by the Governments referred to in the preamble.
第六条 この取極は、千九百七十六年･千九百七十七年解禁期の終了まで実施する。
ARTICLE 6 The present Arrangement shall be operative until the end of the 1976/77 season.
以上の証拠として、下名は、各白の政府から正当に委任を受でこの取極に署名した。
In witness whereof the undersigned, be in duly authorized thereto by the irrespective Governments, have signed the present Arrangment.
千九百七十六年九月二十八日に東京で、英語により本害二通を作成した。
