　Tokyo, March 31, 1976


　書簡をもつて啓上いたします。本大臣は、日本国とオーストリアとの間の繊維製品の貿易の拡大及び秩序ある発展を健全な基盤の上で促進し、かつ、同貿易の障害を削減するために協カ的及び建設的な行動をとることを目的として、日本国政府の代表者とオーストリア政府の代表者との間で最近ジュネーヴで行われた討議に言及する光栄を有します。

　Sir,I have the honour to refer to the recent discussions held in General between the Representatives of the Government of Japan and of the Government of Austria for the purpose of taking co-operative and constructive actions to promote on a sound basis the expansion and orderly development of trade in textiles between the two countries and to reduce barriers in the said trade.


　本大臣は、更に、千九百七十三年十二月二十日にジュネーヴで作成された繊維製品の国際貿易に関する取極の規定に基づく前記の討議の結果到達した次の了解を日本国政府に代わつて確認する光栄を有します。

　I have further the honour to confirm, on behalf of the Government of Japan, the following understanding reached as a result of the above-mentioned discussions in accordance with the provisions of the Arrangement regarding International Trade in Textiles done in Geneva on  December 20, 1973:


1　オーストリア政府は、前記の取極第二条第一項に従つて繊維監視機関に通報されたすべての現行の数量制限を千九百七十六年三月三十一日までに廃棄する。

1. the Government of Austria will terminate all existing quantitative restrictions which have been notified to the Textiles Surveillance Body under paragraph 1 of Article 2 of the said Arrangement by March 31, 1976.


2　日本国政府は、過渡的措置として、付表に掲げる繊維製品のオーストリアへの輸出を同表中に定めるところに従つて制限する。

2. As a transitional measure the Government of Japan will limit its exports to Austria of the textiles listed in the Annex as provided for therein.


3　この了解の前記の諸規定は、権限のある当局により、それそれ自国の関係法令に従つて実施される。

3. The foregoing provisions of this understanding will be implemented by the competent authorities in accordance with the laws and regulations applicable in the respective countries.


4　この了解は、千九百七十七年十二月三十一日まで効力を存続する。

4. This understanding will continue in force through December 31, 1977.


　本大臣は、更に、貴官が前記の了解をオーストリア政府に代わつて確認されることを要請する光栄を有します。

　I have further the honour to request you to confirm the foregoing understanding on behalf of the Government of Austria.


　本大臣は、以上を申し進めるに際し、ここに重ねて貴官に向かつて敬意を表します。

1　付表に掲げる繊維製品(以下「繊維製品」という。)に対する数量制限枠は、いずれの暦年においても、他の数量制限枠からの移替えにより、最大限七パーセントまで増大することができる。


							

						

						

							

								
1) The quantitative limit for the textiles listed in the Annex (hereinafter referred to as "the textiles") may be increased in any calendar year by the transfer from any other quantitative limit or limits of a maximum of 7 per cent of the quantitative limit to which the transfer is made.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
2　繊維製品の数量制限枠は、繰入れ又は繰越しにより、繰入れが六パーセントを超えない十二パーセントまで超えることができる。


							

						

						

							

								
2) The quantitative limit for the textiles may be exceeded by carry forward and/or carryover within a limit of 12 per cent of which carry forward shall not represent more than 6 per cent.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
3　千九百七十六年第一四半期における実際の輸入又は輸出の量は、両国間の協議の後、当該繊維製品の千九百七十六年の数量制限枠から削除される。


							

						

						

							

								
3) The amount of actual imports or exports of the textiles during the firs t quarter of 1976 shall be deducted from t he quantitative limit for such textiles for 1976 after consultation between the two countries.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
4　直ちに再輸出され又は国内で加工した後に再輸出される繊維製品の輸入はいかなる数量制限枠の対象にもならない。ただし、当該繊維製品がオーストリアにおいてこの目的のために施行されている管理制度の下で輸入される場合に限る。


							

						

						

							

								
4) Imports of the textiles which are for immediate re-export or for inward processing and subsequent re-export shall not be subject to any quantitative limit, provided that they are entered under the system of control in force for this purpose in Austria.

5) The Government of Japan will issue a "certificate of export" in English which certifies that the shipment forms part of the quantitative limit. 6　オーストリア政府は、第五項に定める「輸出証明書」が日本国を原産地とする繊維製品に添付されていない場合には、その輸入を許可しないことを決定することができる。そのような決定が行われた場合には、オーストリア政府は、双方にとつて満足な解決を得ることを目的として、日本国政府と直ちに協議を行う。


							

						

						

							

								
6) The Government of Austria may decide not to admit imports of the textiles of Japanese origin unless such imports are covered by a "certificate of export" as specified in paragraph 5.
