宇宙開発事業団の静止気象衛星、実験用中容量静止通信衛星及び実験用中型放送衛星の打上げ計画のための協力に関する日本国政府とアメリカ合衆国政府との間の交換公文

書簡をもつて啓上いたします。本長官は、日本国政府が定めた「宇宙開発に関する基本計画」の一部として日本国の宇宙開発事業団(以下「事業団」いとう。)が実施する三箇の人工衛星(静止気象衛星、実験用中容量静止通信衛星及び実験用中型放送衛星をいう。)の打上げ計画のため、日本国政府がさきに行つた要請に応じて、アメリカ合衆国航空宇宙局(以下「宇宙局」という。)によつて提供される打上げ業務及びその関連業務の条件に関してアメリカ合衆国政府の代表者と日本国政府の代表者との間で最近行われた会談に言及する光栄を有します。
Excellency, I have the honor to refer to the recent discussions between the representatives of the Government of the United States of America and the Government of Japan concerning the terms and conditions under which launching and associated services will be furnished, in response to the request previously made by the Government of Japan, by the National Aeronautics and Space Administration of the United States of America (hereinafter referred to as "NASA") for the launching projects of three satellites (known as the Geostationary Meteorological Satellite, the Medium-Capacity Geostationary Communications Satellite for Experimental Purpose and the Medium-Scale Broadcasting Satellite for Experimental Purpose) undertaken by the National Space Development Agency of Japan (hereinafter referred to as "NASDA") as a part of the "Basic Program concerning Space development" decided by the Government of Japan.
本長官は、宇宙空間の平和的な探査及び利用の分野において両政府の間に引き続いて存在する相互に有益な関係を考慮し、アメリカ合衆国政府に代わつて次のとおり提案する光栄を有します。
In consideration of the continuing mutually beneficial relationship between our two Governments in the field of peaceful exploration and use of outer space, I have the honor to propose on behalf of my Government as follow:
1 宇宙局は、宇宙局と日本国の法令により事業団を監督の下に置いている日本国科学技術庁との間で合意される実施取極の条件に従い、実費弁償の原則により事業団の前記人工衛星打上げ計画のため打上げ業務及びその関連業務を提供する。
1.NASA will furnish launching and associated services for the foregoing satellite launching projects of NASDA a reimbursable basis in accordance with the terms and conditions of implementing arrangements to be agreed by NASA and the Science and Technology Agency of Japan under whose supervision NASDA is placed by the laws and regulations of Japan.
2 1にいう実施取極は、それぞれの国の法令に従つたものでなければならず、また、千九百七十二年十月九日の合衆国大統領の声明に定められている合衆国の打上げ援助政策についての関連規定に合致するものでなければならない。
2.The implementing arrangements referred to in paragraph 1. above shall be in accordance with the laws and regulations of the respective countries and consistent with relevant provisions of the United States launch assistance policy as provided in the statement of the President of the United States on October 9, 1972.
3 打上げのための準備と打上げの実施の結果として合衆国政府が負担したすべての費用の支払いは、事業団が行うことが了解される。日本国政府は、事業団が支払義務を履行することを確保するためすべての努力をする。1にいう実施取極に定められる宇宙局への弁償のための方式は、費用の完全な弁償を確保するよう日本国政府によつて意図されるものであることが了解される。
3.It is understood that payment for all costs incurred by the Government of the United States as a consequence of preparation for and conduct of the launchings will be made by NASDA. The Government of Japan will make every effort to assure that NASDA will fulfill its obligations for payment. It is understood that the mechanism for reimbursing NASA which will be established in the implementing arrangements referred to in paragraph 1. is intended by the Government of Japan to assure full reimbursement of costs.
4 日本国政府及びアメリカ合衆国政府は、前記の諸規定から又はそれらに関連して生ずることがあるいかなる問題についても、相互に受諾可能な解決を見いだすため協議する。
4.The government of Japan and the Government of United States of America will consult with each other on any matter that may arise from or in connection with the foregoing paragraphs with a view to finding a mutually acceptable solution.
本長官は、前記のことが日本国政府にとつて受諾し得るものであるときは、この書簡及び閣下の返簡が閣下の返簡の日付の日に効力を生ずる両政府間の合意を構成することを提案する光栄を有します。
If the foregoing is acceptable to your Government, I have the honor to propose that this note and Your Excellency's note in reply shall constitute an agreement between our two Governments which shall enter into force on the date of your reply.
本長官は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

I have the honor to confirm on behalf of the government of Japan that the foregoing is acceptable to the Government of Japan and to agree that Your note and this reply shall constitute an agreement between our two Governments which shall enter into force on the date of this reply.
