AGREEMENT BETWEEN JAPAN AND THE UNION OF SOVIET SOCIALIST REPUBLICS CONCERNING AN INTERNATIONAL OBSERVER SCHEME FOR FACTORY SHIPS ENGAGED IN PELAGIC WHALING IN THE SOUTHERN HEMISPHERE

　千九百四十六年十二月二日にワシントンで署名された国際捕鯨取締条約(以下「条約」という。)の締約政府である日本国及びソヴィエト社会主義共和国連邦の政府は、南半球における捕鯨の出漁国が鯨族の保存、母船による捕鯨の適当な生産性の維持及び捕鯨の合理的な運営の確保に共通の関心を有するので、

　The Governments of Japan and the Union of Soviet Socialist Republics, being Parties to the International Convention for the Regulation of Whaling, signed at Washington on December 2, 1946 (hereafter referred to as "the Convention"),

　国際捕鯨委員会の第二十三回会合が捕鯨の国際監視制度を確立することの必要性について行つた決定に基づき、南半球における捕鯨に従事する母船又は母船の機能を有する捕鯨船に乗船する国際監視員に関し、次のとおり協定した。

　Proceeding form the mutual concern of the pelagic whaling countries in the Southern Hemisphere for the conservation of whale stocks, for the maintenance of the proper productivity of pelagic whaling and the ensuring of its being carried out rationally;
  Have agreed on the following scheme for International Observers on board factory ships or catchers functioning as factory ships engaged in pelagic whaling in the Southern Hemisphere in accordance with the decisions taken by the twenty-third meeting of the International Whaling Commission on the necessity of establishing a scheme of international observation of whaling operations:

第一条　制度の目的

Article 1 Purpose of the Scheme

　この制度の目的は、南半球における母船による捕鯨につき、鯨が母船に引き渡されるとき又はその母船若しくは母船の機能を有する捕鯨船で処理されるときに当該捕鯨の監視を行うことである。

　The purpose of this scheme is to maintain surveillance of pelagic whaling in the Southern Hemisphere whenever whales are being delivered to factory ships or are being processed at such ships or catchers functioning as factory ships.

第二条　監視員の任命

Article 2 Appointment of Observers

　監視員は、国際捕鯨委員会(以下「委員会」という。)に対して責任を負うものとし、また、次の規定に従つて任命される。

　 Observers shall be responsible to the International Whaling Commission (hereafter referred to as "the Commission") and shall be appointed in accordance with the following provisions:

(1)　各署名政府は、自己の管轄下にある船団の数と少なくとも同数の監視員を指名する権利を有する。

(1)Each signatory Government shall have the right to nominate at least as many observers as it has expeditions under its jurisdiction.

(2)　このようにして指名された監視員のうちから、南半球における捕鯨に従事する船団に対して監視員が任命されるものとし、一の船団に対しては一人を超える監視員は、任命されない。

(2)Form the observers so nominated, observers shall be appointed to the expeditions engaged in pelagic whaling in the Southern Hemisphere and not more than one observer shall be appointed to any expedition.

(3)　委員会の書記長は、(2)の規定に従つて行われたすべての任命を双方の署名政府に通報する。

(3)The Secretary of the Commission shall inform both signatory Governments of all appointments made under sub-paragraph (2) of this Article.

第三条　監視員の権利及び任務

Article 3 Right and Function of Observers

(1)　監視員は、上級職員の地位を有するものとし、これに応じた食事及び宿泊施設を与えられる権利を有する。監視員を受け入れる各署名政府は、監視員及び通訳の任務の遂行に当たつてそれらの者安全及び福祉を確保し、それらの者に対し医療上の援助を行い、また、それらの者の自由及び尊厳を保障するため、適当な措置をとる。監視員及び通訳は、勤務する船団の慣習及び秩序を遵守する。

(1)The observers shall have the status of senior officers and shall be entitled to subsistence and accommodation accordingly. Each signatory Government receiving observers shall take appropriate measures to ensure security and welfare of the observers and interpreters in the performance of their duties, to provide them with medical care and assistance, and to safeguard their freedom and dignity. The observers and interpreters shall observe the customs and order existing on the expeditions on which they are serving.

(2)　監視員は、任命された船団の活動についていかなる管理権をも付与されないものとし、また、いかなる方法によつてもその活動に干渉する権限を有しない。監視員は、委員会以外のいかなる機関からも指示を求め又は受けてはならない。監視員は、任務の遂行に必要な便益(電信を利用する便益を含む。)を与えられる。

(2)The observers shall not be invested with any administrative power in regard to the activities of the expeditions to which they are appointed, and shall have no authority to interfere in any way with those activities. They shall neither seek nor receive instructions from any authority other than the Commission. They shall be given the necessary facilities for carrying out their duties, including cabling facilities.

(3)　監視員は、鯨の捕獲及びその合理的な利用に関し条約の遵守を検証することができるように、任命された船団の操業を自由に監視することができる。監視員は、特に、捕獲された鯨の種類、体長、性別及び頭数を確認するための便益を与えられる。

(3)An observer shall be enabled to observe freely the operations of the expedition to which he is appointed, so that he may verity the observance of the provisions of the Convention in regard to the taking of whales and their rational utilization. In particular, the observer shall be given facilities to ascertain the species, size, sex, and number of whales taken.

(4)　条約の付表に従つて作成することを要求されるすべての報告並びに保管し又は提供することを要求されるすべての記録及び資料は、監視員が検査のため自由にかつ直ちに入手又は閲覧することができるようにするものとし、監視員は、これらの報告、記録及び資料について必要なすべての説明を受ける。

(4)All reports required to be made and all records and data required to be kept or supplied in accordance with the Schedule of the Convention, shall be made freely and immediately available to observers for examination, and they shall be given all necessary explanations as regards such reports, records and data.

(5)　船団の一部を構成する船舶の船長、船団長若しくは上級職員又は国内監督官は、監視員の任務の遂行に必要な情報を提供する。

(5)The master, manager or senior officers of any of the vessels forming part of the expedition, or the national inspectors, shall supply any information that is necessary for the discharge of the observer's functions.

(6)　監視員は、条約の規定に対する違反が行われたと信ずるに足りる相当な理由がある場合には、船長又は船団長及び首席国内監督官に対し、その違反を直ちに書面によつて通知する。監視員は、その違反が重大なものであると認める場合には、直ちに、船長又は船団長及び首席国内監督官の説明又は意見を付して、その違反を委員会の書記長に通知する。

(6)When there is reasonable ground to believe that any infraction of the provisions of the Convention has taken place, it shall be brought in writing to the immediate notice both of the master or manager of the expedition and of the senior national inspector by an observer, who shall, if he deems it sufficiently serious, at once transmit it to the Secretariat of the Commission together with the explanation of comments of the master or manager of the expedition and the senior national inspector.

(7)　監視員は、監視に関する報告(条約の規定に対する違反の疑いがある行為に関するものを含む。)を作成し、かつ、船長又は船団長及び首席国内監督官に対し、情報として及びそれらの者の説明及び意見の作成のため当該報告を提出する。これらの説明及び意見を添付した監視員の報告は、できる限り速やかに委員会の書記長に送付する。

(7)An observer shall draw up a report covering his observations, including possible infractions of the provisions of the Convention which have taken place, and shall submit it to the master or manager of the expedition and to the senior national inspector for information and such explanations and comments as they wish to make. Any such explanations and comments shall be attached to the observer's report, which shall be transmitted to the Secretariat of the Commission as soon as possible.

第四条　用語

Article 4 Language

(1)　監視員は、自己を受け入れる政府の国の言語及び英語を解さない場合には、同一の国籍を有する通訳を同伴しなければならない。

(1)Any observer who knows neither the language of the country whose Government receives him nor the English language, must be accompanied by an interpreter who shall be of the same nationality.

(2)　監視員が自己を受け入れる政府の国の言語を解さないが英語を解する場合又は英語を解する通訳を同伴する場合には、船団は、少なくとも一人の英語を解する者を母船又は母船の機能を有する捕鯨船に乗船させることを必要とする。

(2)Where an observer does not speak the language of the country whose Government receives him but speaks English or is accompanied by an English-speaking interpreter, then the expedition is required to provide at least one English-speaking person on the factory ship or the catcher functioning as factory ship.

第五条　経費

Article 5 Finance

(1)　船団に対して任命される監視員を指名する各署名政府は、監視員の俸給その他の手当、旅費、通信費、食費、宿泊費その他の必要経費を支払う。

(1)Each signatory Government which nominates one or more observers who are appointed to expeditions shall pay the salary and other emoluments, travel, cable costs, subsistence and accommodation and other necessary expenses of those observers.

(2)　母船又は母船の機能を有する捕鯨船における食事及び宿泊施設は、監視員に実費で提供される。

(2)Subsistence and accommodation on the factory ship or the catcher functioning as factory ship shall be provided to the observers at cost.

(3)　監視員が通訳を同伴する必要がある場合には、通訳の俸給その他の必要経費は、監視員を指名した署名政府が支払う。

(3)When it is necessary that an observer be accompanied by an interpreter, the salary and other necessary expenses of that interpreter shall be paid by the signatory Government nominating the observer.

第六条　効力発生

Article 6 Entry into Force

　この協定は、前文に掲げる政府によつて署名された日に効力を生ずる。

　The present Agreement shall enter into force on the day upon which it is signed by the signatory Governments referred to in the preamble.

第七条　有効期間

Article 7 Duration

　この協定は、千九百七十六年八月三十一日まで効力を有する。

　The present Agreement shall remain in force until August 31, 1976.

第八条
　両署名政府は、国際捕鯨委員会の第二十八回会合前に、この協定の運用を検討し、かつ、将来の取極について決定するため、ロンドンで会合する。

Article 8
　The two signatory Governments shall meet in London before the twenty-eighth meeting of the Commission to review the operation of the present Agreement and to decide on future arrangements.

　以上の証拠として、下名は、各自の政府から正当に委任を受けてこの協定に署名した。

　In witness whereof the undersigned, being duly authorized thereto by their respective Governments, have signed the present Agreement.

　千九百七十五年十月九日に東京で、英語により本書二通を作成した。
