　Tokyo, December 12, 1975

　書簡をもつて啓上したします。本大臣は、チリの債務者が負担する商業上の債務についての債務救済措置に関し、千九百七十五年五月五日、同六日及び同八日にパリで開催されたチリ共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した了解に基づいて日本国政府の代表者とチリ共和国政府の代表者との間で到達した次の了解を確認する光栄を有します。

　Excellency,I have the honour to confirm the following understanding reached between the representatives of the Government of Japan and of the Government of the Republic of Chile concerning debt relief measures in respect of commercial debts owed by Chilean debtors on the basis of the understanding reached during the consultations between the representatives of the Government of the Republic of Chile and of the Government of the Creditor countries concerned held at Paris on 5, 6 and 8 May, 1975.

1(a)　この取極は、一方においてチリ共和国政府、同政府企業及びチリの民間企業(以下「債務者」という。)と他方において日本国の居住者である関係債権者(以下「債権者」という。)との間で千九百七十三年十二月三十一日以前に契約され、日本国政府が保険を引き受けた商業上の債務であつて千九百七十五年一月一日から千九百七十五年十二月三十一日までの間(両期日を含む。)に弁済期限が到来したか又は到来するもののうち、弁済期間が一年を超えるものの元本及び利子の総額に適用される。

1.(a) The present arrangements shall apply to the total amount of the principal of and interest on the commercial debts with a repayment period exceeding one year, contracted between the Government and governmental corporations of the Republic of Chile and Chilean private enterprises (hereinafter referred to as "the debtors") on the one hand and creditors concerned resident in Japan (hereinafter referred to as "the creditors") on the other before 31 December, 1973, insured by the Government of Japan, and already due or falling due between 1 January and 31 December, 1975, both dates inclusive.

(b)　この取極が適用される商業上の債務の元本及び利子の総額は、五百六十一万八千四百七十五合衆国ドル五十六セント(五、六一八、四七五合衆国ドル五六セント)と見積もられている。

(b) The total amount of the principal of and interest on the commercial debts to which the present arrangements shall apply is estimated at five million six hundred and eighteen thousand four hundred and seventy-five United States dollars and fifty-six cents (U.S.$5,618,475.56).

2(a)　チリ共和国政府は、(d)及び(e)に掲げる支払計画で、それに従つて、同国政府が商業上の関係債務を決済するために1(b)にいう額の支払を行うことができるもの(以下「支払計画」という。)を債権者に通告する。

2.(a) The Government of the Republic of Chile shall notify the creditors of the payment scheme (hereinafter referred to as "the Payment Scheme") as set out in sub-paragraphs (d) and (e) below in accordance with which the Government of the Republic of Chile will be able to pay the amount referred to in paragraph 1(b) above in order to settle the commercial debts concerned.

(b)　チリ共和国政府は、1(b)にいう額を支払計画に従い関係契約により指定された通貨によつて支払う。

(b) The Government of the Republic of Chile shall pay such amount in the currency designated in the contracts concerned in accordance with the Payment Scheme.

(c)　日本国政府は、チリ共和国の国際収支上の困難にかんがみ、商業上の関係債務が、支払計画に従つて行われる支払によつて決済されることを容易にするため、日本国において施行されている関係法令の範囲内で可能な措置をとる。

(c) The Government of Japan, in view of the balance of payments difficulties of the Republic of Chile, will take possible measures, within the scope of the relevant laws and regulations in force in Japan, to facilitate for the commercial debts con-cerned to be settled by the payment to be made in accordance with the Payment Scheme.

(d)　1(b)にいう総額の三十パーセントは、次の計画に従つて支払われる。

(d) Thirty per cent (30%) of the total amount referred to in the paragraph 1(b) above will be paid in accordance with the following schedule:

　千九百七十五年十二月三十一日に十パーセント

　Ten per cent (10%) on 31 December 1975

　千九百七十六年七月一日に十パーセント

　Ten per cent (10%) on 1 July 1976

　千九百七十七年七月一日に十パーセント

　Ten per cent (10%) on 1 July 1977

(e)　1(b)にいう総額の七十パーセントは、千九百七十八年一月一日から始まる半年ごとの十三回均等分割払により支払われる。

(e) Seventy per cent (70%) of the total amount referred to in paragraph 1(b) above will be paid as from 1 January 1978 in thirteen (13) equal semi-annual installments.

3　支払計画について適用される利子率は、年七パーセントとし、チリ共和国政府は、債権者に対し、弁済期限が到来している商業上の関係債務のいかなる額についても、その債務が決済されていない限り、前記の利子を2(d)及び(e)に定める各支払日に支払う。

3. The rate of interest to be applied for the Payment Scheme will be seven per cent (7%) per annum, and the Government of the Republic of Chile will pay to the creditors such interest, on each date of payment referred to in the paragraphs 2(d) and (e), on the amount of any of the commercial debts con-cerned due to the extent that it has not been settled.

4　チリ共和国政府は、商業上の関係債務の決済に伴つて生ずる銀行手数料を支払う。

4. The Government of the Republic of Chile shall pay bank charges incidental to the settlement of the commercial debts concerned.

5　2、3及び、4の規定にかかわらず、債務者がある商業上の債務についてチリ共和国において必要とされる措置をとらなかつた場合には、チリ共和国政府は、その債務が、関係契約に従つて債務者と債権者との間で決済されることを、チリ共和国において施行されている関係法令の範囲内で容易にし、かつ、その契約により指定された通貨による債務の支払のための送金の自由を保証する。

5. Notwithstanding the provisions of paragraphs 2, 3 and 4 above, if the debtors fail to take such measures in respect of certain commercial debts as are required in the Republic of Chile, the Government of the Republic of Chile shall facilitate, within the scope of the relevant laws and regulations in force in the Republic of Chile, for the debts to be settled between the debtors and the creditors in accordance with the contracts concerned, and also guarantee the free transferability in the currency designated in the contracts, of the payments of the debts.

6　チリ共和国政府は、商業上の関係債務の基因となつた関係契約の条件のうちこの書簡に特に言及されていないものは、関係契約当事者間で別段の合意がある場合を除くほか、引き続き変更されないことを確認する。

6. The Government of the Republic of Chile hereby confirms that the terms and conditions not specifically referred to in this Note, of the contracts concerned under which the commercial debts concerned were incurred, shall remain unchanged, unless otherwise agreed upon by the parties to the contracts concerned.

　本大臣は、更に、この書簡及び前記のことを貴国政府に代わつて確認される閣下の返簡が両政府間の合意を構成し、かつ、その合意は、日本国政府がチリ共和国政府からその効力発生に必要な国内手続を完了した旨の書面による通告を受領したときに効力を生ずるものとみなすことを提案する光栄を有します。

　I have further the honour to propose that this Note and Your Excellency's reply con-firming the foregoing on behalf of your Government shall be considered as constituting an agreement between the two Governments, which will become effective upon the receipt by the Government of Japan of the written notification from the Government of the Republic of Chile of the completion of necessary domestic procedures for the entry into force of such agreements.

　本使は、更に、本国政府に代わつて、前記のことがチリ共和国政府の了解でもあることを確認するとともに、閣下の書簡及びこの返簡が、両政府間の合意を構成し、かつ、その合意は、日本国政府がチリ共和国政府からその効力発生に必要な国内手続を完了した旨の書面による通告を受領したときに効力を生ずるものとみなすことに同意する光栄を有します。

　I have further the honour, to confirm behalf of my Government that the foregoing is also the understanding of the Government of the Republic of Chile and to agree that Your Excellency's Note and this reply shall be considered as constituting an agreement between the two Governments, which will become effective upon the receipt by the Government of Japan of the written notification from the Government of the Republic of Chile of the completion of necessary domestic procedures for the entry into force of such agreement.

　書簡をもつて啓上いたします。本大臣は、チリの債務者が負担する商業上の債務についての債務救済措置に関する本日交換された書簡に関し、閣下に次のことを通報する光栄を有します。

　Excellency,With reference to the Notes exchanged today concerning debt relief measures in respect of commercial debts owed by Chilean debtors, I have the honour to inform Your Excellency of the following:

　前記の書簡の第三項に盛られた取極の実施のために、日本国政府は、日本国の債権者が政府に協力するよう必要な行政指導を行う。もつとも、この取極は、日本国政府が債権者に対して一定の利子率を受諾するよう強制する法的立場にはないことを前提としてなされたものである。したがつて、理論的には、日本国の居住者である債権者がチリ共和国政府又は関係債務者に対して関係契約に定められている利子で、七パーセントを超えることがあるものを要求する場合が生じ得る。そのような場合には、日本国政府は、チリ共和国政府又は関係債務者が要求された利子を支払うため必要な措置をとるものと了解する。

　For the implementation of the arrangements contained in the paragraph 3 of the said Notes, the Japanese Government will make necessary administrative guidance so that the creditors in Japan will cooperate will the Government. However, the arrangements have been made on the premise that the Japanese Government is not in a legal position to en-force the creditors to accept a certain rate of interest. Therefore, theoretically there may arise cases that creditors resident in Japan may request the Government of the Republic of Chile of debtors concerned interests as provided for in the contracts con-cerned--which may be above 7%. In such cases, the Government of Japan understands that the Government of the Republic of Chile or the debtors concerned shall take necessary measures to pay such requested interests.
