繊維製品（綿布及び合成繊維製の布）の贈与に関する日本国政府とバングラデシュ人民共和国政府との間の交換公文
(日本側書簡)
(Japanese Note) Dacca, March 28, 1975.
書簡をもつて啓上いたします。本使は、バングラデシュ人民共和国政府が同国経済の安定を図るために日本国政府に対して行つた綿布及び合成繊維製の布の供与のための援助要請にこたえて日本国政府とバングラデシュ人民共和国政府との間で最近行われた交渉に言及し、かつ、次の取極を提案する光栄を有します。
Sir,I have the honour to refer to the recent negotiations held between the Government of Japan and the Government of the People's Republic of Bangladesh in response to the aid request for the supply of cotton fabrics and synthetic textile fabrics made by the Government of the People's Republic of Bangladesh to the Government of Japan in order to stabilize the Bangladesh economy, and to propose the following arrangements:
1 日本国政府は、日本国の関係法令及びこの取極の規定に従い、バングラデシュ人民共和国政府に対し、両政府間の合意によつて延長されない限り、この取極が効力を生ずる日から千九百七十五年八月三十一日までの期間に十五億円(一、五〇〇、〇〇〇、〇〇〇円)を限度とする額の贈与を行う。
1. The Government of Japan will extend to the Government of the People's Republic of Bangladesh, in accordance with the relevant laws and regulations of Japan and the provisions of the present arrangements, a grant up to one billion and five hundred million yen (1,500,000,000), which will be made available during the period between the date of coming into force of the present arrangements and August 31, 1975, unless the period is extended by mutual agreement between the two Governments.
2 この贈与は、バングラデシュ人民共和国政府が、日本国の生産物である綿布及び合成繊維製の布並びにこれらの布のバングラデシュ人民共和国の港までの輸送に必要な日本国民の役務を購入するために使用される。
2. The grant will be used by the Government of the People's Republic of Bangladesh for the purchase of cotton fabrics and synthetic textile fabrics which will be products of Japan and of services of Japanese nationals necessary for the transportation of those fabrics to ports in the People's Republic of Bangladesh.
3 バングラデシュ人民共和国政府又はその指定する当局は、2にいう生産物及び役務の購入のため、日本国民又は日本国民の支配する法人と日本円で契約を締結する。そのような契約は、日本国政府によりこの贈与の対象として適格である旨認証されなければならない。
3. The Government of the People's Republic of Bangladesh or its designated authority will enter into contracts in Japanese yen with Japanese nationals or juridical persons controlled by Japanese nationals for the purchase of the products and services referred to in paragraph 2. Such contracts shall be verified by the Government of Japan to be eligible for the grant.
4 この贈与は、認証された契約によりバングラデシュ人民共和国政府又はその指定する当局が負う債務の弁済に充てるための資金をバングラデシュ人民共和国政府によつて指定される日本国の外国為替公認銀行(以下「銀行」という。)に開設されるバングラデシュ人民共和国政府名義の勘定に日本国政府が日本円で払い込むことによつて実施される。
4. The grant will be executed by the Government of Japan making payments in Japanese yen to cover the obligations incurred under the verified contracts by the Government of the People's Republic of Bangladesh or its designated authority to an account to be opened in the name of the Government of the People's Republic of Bangladesh in an authorized foreign exchange bank of Japan designated by the Government of the People's Republic of Bangladesh (hereinafter referred to as "the Bank")
5 4にいう払込みは、バングラデシュ人民共和国政府が発行する支払授権書に基づき銀行が日本国政府に対して支払請求書を提出した時に行われる。
5. The payments referred to in paragraph 4 will be made when payment requests are presented by the Bank to the Government of Japan under an authorization to pay issued by the Government of the People's Republic of Bangladesh.
6 4にいう勘定の目的は、日本国政府が支払う日本円を受領すること及び日本国民又は日本国民の支配する法人に対する支払を行うことに限られる。
6. The purpose of the account referred to in paragraph 4 is only to receive the payments in Japanese yen by the Government of Japan and to pay to Japanese nationals or juridical persons controlled by Japanese nationals.
7(1) バングラデシュ人民共和国政府は、次のことを行うためのすべての必要な措置をとる。
7.(1) The Government of the People's Republic of Bangladesh will take all the necessary measures:
(a) この贈与により供与される生産物及び役務が、バングラデシュ経済の安定のために適正に使用されることを確保てること。
(a) to ensure that the products and services provided by the grant be properly used for the stabilization of the Bangladesh economy;
(b) 日本国民又は日本国民の支配する法につき、この贈与に基づく生産物及び役務の供与に関してバングラデシュ人民共和国において課されることがある関税、内国税その他の課徴金を免除すること。
(b) to exempt the Japanese nationals or juridical persons controlled by Japanese nationals from the payment of customs duties, internal taxes and other fiscal levies to be imposed in the People's Republic of Bangladesh with respect to the supply of products and services under the grant;
(c) この贈与により供与される生産物のバングラデシュ人民共和国内の陸揚港における陸揚げ及び国内輸送を速やかに行うことを確保すること。
(c) to ensure prompt unloading at ports of disembarkation in the People's Republic of Bangladesh and internal transportation of the products provided by the grant;
(d) この贈与の実施に関達して生ずる銀行手数料を負担すること。
(d) to bear banking charges or fees arising in connection with the execution of the grant.
(2) この贈与により供与される生産物は、バングラデシュ人民共和国から再輸出されてはならない。
(2) The products provided by the grant shall not be re-exported from the People's Republic of Bangladesh.
8 バングラデシュ人民共和国政府は、日本円による払込額と等価額から関連する検査、陸揚げ、貯蔵、国内輸送及び配分についてバングラデシュ人民共和国政府が負担する費用を差し引いたバングラデシュ通貨による額を千九百七十六年六月三十日までに自己の名義でバングラデシュ銀行の特別勘定に積み立てるものとする。このようにして積み立てられた通貨は、両政府間で別途合意される取極に従つて、バングラデシュ人民共和国における経済及び社会開発の目的のために利用される。
8. The Government of the People's Republic of Bangladesh shall deposit in a special account in its name in the Bank of Bangladesh by June 30, 1976, the amount in Bangladesh currency which shall be the equivalent of the yen disbursement less the cost to the Government of the People's Republic of Bangladesh for related survey, unloading, storage, internal transportation and distribution. The currency thus deposited shall be utilized for economic and social development purposes in the People's Republic of Bangladesh in accordance with separate arrangements to be agreed upon between the two Governments.
9 4にいう勘定への貸記及び借記に関する手続細目は、銀行とバングラデシュ人民共和国政府との間の協議により合意される。
9. The procedural details concerning the credit to and the debit from the account referred to in paragraph 4 will be agreed upon through consultation between the Bank and the Government of the People's Republic of Bangladesh.
10 両政府は、この取極から又はそれに関連して生ずることがあるいかなる事項についても、相互に協議する。
10. The two Governments will consult with each other in respect of any matter that may arise from or in connection with the present arrangements.
本使は、更に、この書簡及びバングラデシュ人民共和国政府に代わつて前記の取極を確認される貴官の返簡が貴官の返簡の日付の日に効力を生ずる両政府間の合意を構成するものとみなすことを提案する光栄を有します。
I have further the honour to propose that the present Note and your Note in reply confirming on behalf of the Government of the People's Republic of Bangladesh the above arrangements will be regarded as constituting an agreement between the two Governments, which will enter into force on the date of your reply.

I have further the honour to confirm on behalf of the Government of the People's Republic of Bangladesh the foregoing arrangements and to agree that Your Excellency's Note and this Note shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of this reply.
