ARRANGEMENT BETWEEN JAPAN AND THE UNION OF SOVIET SOCIALIST REPUBLICS FOR THE REGULATION OF PELAGIC WHALING IN THE SOUTHERN HEMISPHERE

　千九百四十六年十二月二日にワシントンで署名された国際捕鯨取締条約(以下「条約」という。)の締約政府である日本国及びソヴィエト社会主義共和国連邦は、

　The Governments of Japan and of the Union of Soviet Socialist Republics, being Parties to the International Convention for the Regulation of Whaling, signed at Washington on December 2, 1946 (hereafter referred to as "the Convention"):

　次のとおり協定した。

　Have agreed upon the following arrangements:

第一条
　この取極の適用上、「解禁期」とは、条約の付表2(a)から(d)までの規定に基づき南氷洋におけるひげ鯨及び南半球におけるまつこう鯨の捕獲が許される期間をいう。

Article 1
　For the purpose of the present Arrangement, the term "season" shall mean the season during which the taking of baleen whales in the Antarctic and sperm whales in the Southern Hemisphere is permitted under sub-paragraphs (a), (b), (c) and (d) of paragraph 2 of the Schedule to the Convention.

第二条
　千九百七十四年・千九百七十五年解禁期において、条約に基づき南緯四十度以南の水域における母船による捕獲を認められたひげ鯨の総割当て及び条約に基づき南半球における母船による捕獲を認められたまつこう鯨の総割当ては、次のとおり署名政府の国の間に配分する。

Article 2
　In the 1974/75 season, the total quotas of baleen whales, authorized under the Convention to be taken in waters south of 40° South Latitude by pelagic expeditions and those of sperm whales, authorized under the Convention to be taken in the Southern Hemisphere by pelagic expeditions shall be allocated between the countries of the signatory Governments in the following manner:

第三条
(1)　次のいずれかの区域におけるいずれか一方の政府の管轄下にある母船による捕獲頭数は、次の限度を超えてはならない。

Article 3
(1) The catches taken in any of the Areas as described below by factory ships under the jurisdiction of either Government shall not exceed the limits shown below:

(2)　(1)の規定にかかわらず、いずれか一方の政府の管轄下にある母船による区域別捕獲頭数の合計は、前条においてそれぞれの国に配分された割当てを超えてはならない。

(2) Notwithstanding the above provisions, the sum of the area catches by factory ships under the jurisdiction of either Government shall not exceed the quotas for their respective countries as allocated in Article 2.

第四条
　この取極の締約政府でない政府の管轄下にある母船が南半球における捕鯨に従事し、かつ、当該政府が条約の締約政府であり又は締約政府となつた場合には、この取極は、終了する。

Article 4
　If a factory ship under the jurisdiction of a Government which is not a Party to the present Arrangement should engage in pelagic whaling in the Southern Hemisphere and that Government is or becomes a Party to the Convention, the present Arrangement shall be terminated.

第五条
　この取極は、前文に掲げる政府によつて署名された日に効力を生ずる。

Article 5
　The present Arrangement shall enter into force on the day upon which it is signed by the Governments referred to in the preamble.

第六条
　この取極は、千九百七十四年・千九百七十五年解禁期の終了まで実施する。

Article 6
　The present Arrangement shall be operative until the end of the 1974/75 season.

　以上の証拠として、下名は、各自の政府から正当に委任を受けてこの取極に署名した。
