一部査証及び査証料の相互免除に関する日本国政府とポルトガル政府との間の取極(口上書)

NOTE VERBALE
日本国大使館は、外務省に敬意を表するとともに、日本国政府が、日本国とポルトガルとの間の観光並びに文化及び通商に関する関係を促進するために、日本国に入国することを希望するポルトガル国民に対する査証及び査証料の免除に関し、千九百七十四年三月一日から次の措置をとる用意を有することを同省に通報する光栄を有する。
The Embassy of Japan presents its compliments to the Ministry of Foreign Affairs and has the honour to inform the latter that the Government of Japan, with a view to facilitating tourism as well as cultural and commercial relations between Japan and Portugal, is prepared to take the following measures from March 1, 1974 concerning the waiving of visas and visa fees for Portuguese nationals seeking entry into Japan:
(1) ポルトガル本土(マデイラ諸島及びアソーレス諸島を含む。)において発給された有効なポルトガル旅券(団体旅行身分証明書を除く。)又はポルトガル本土(マデイラ諸島及びアソーレス諸島を含む。)において発給されたポルトガル旅券の代わりに再発給された有効なポルトガル旅券を所持するポルトガル国民であつて、継続して三箇月を超えない期間滞在する意図をもつて日本国に入国することを希望するものは、査証を取得することなく、日本国に入国することができる。
(1) Portuguese nationals in possession of valid Portuguese passports (excluding collective identity and travel certificates) issued in the Metropolitan Portugal (including Madeira and Azores Islands) or of valid Portuguese passports reissued in substitution of Portuguese passports issued in the Metropolitan Portugal (including Madeira and Azores Islands) who are seeking entry into Japan with the intention of staying there for a period not exceeding there consecutive months may enter Japan without obtaining a visa.
(2) 日本国政府は、(1)の規定に基づいて査証なしに日本国に入国したポルトガル国民であつて、滞在期間を三箇月を超えて延長することを希望するものの滞在期間の延長を許可することができる。
(2) The Government of Japan may grant extensions of the period of stay to Portuguese nationals who, having entered Japan without a visa under paragraph (1) above, desire to extend the period of stay beyond three months.
(3) (1)の規定に基づく査証の要件の免除は、ポルトガル国民であつて、就職し、永住し、自由職業若しくは他の生業を営み、報酬を得る目的で芸能(スポーツを含む。)に従事し、又は継続して三箇月を超える期間滞在する意図をもつて日本国に入国することを希望するものについては、適用しない。
(3) The waiver of the visa requirement under paragraph (1) above shall not apply to Portuguese nationals seeking entry into Japan with the intention of seeking employment or permanent residence, of exercising a profession or other occupation or of engaging in public entertainment (including sport) for remunerative purposes or with the intention of staying there for a period exceeding three consecutive months.
(4) (1)の規定に基づく査証の要件の免除は、日本国に入国するポルトガル国民に対し、外国人の入国、滞在、居住、出国及びその他の管理に関する日本国の法令に服することを免除するものではない。
(4) The waiver of the visa requirement under paragraph (1) above does not exempt Portuguese nationals entering Japan from the necessity of complying with the Japanese laws and regulations concerning the entry, stay, residence, exit and other controls of aliens.
(5) 査証が必要とされ、かつ、(1)にいう旅券を所持するポルトガル国民に付与されるときは、日本国の権限のある外交及び領事当局は、その査証についていかなる手数料をも徴収しない。
(5) For visas, when required and granted to the Portuguese nationals in possession of the passports mentioned in paragraph (1) above, the competent Japanese diplomatic and consular authorities will not charge any fees.
(6) 日本国政府は、好ましくないと認めるポルトガル国民に対し、日本国に入国し又は滞在することを拒否する権利を留保する。
(6) The Government of Japan reserves the right to refuse the entry into or stay in Japan to Portuguese nationals considered undesirable.
(7) 日本国政府は、書面による一箇月の予告をもつて前記の諸規定を終了させることができる。
(7) The Government of Japan may terminate the foregoing by giving one month's written notice.
日本国大使館は、以上を申し進めるに際し、ここに重ねて外務省に向かつて敬意を表する。
The Embassy of Japan avails itself of this opportunity to renew to the Ministry of Fore Foreign Affairs the assurance of its highest consideration.

外務省は、日本国大使館に敬意を表するとともにポルトガル政府が、ポルトガルと日本国との間の観光並びに文化及び通商に関する関係を促進するために、ポルトガルに入国することを希望する日本国民に対する査証及び査証料の免除に関し、千九百七十四年三月一日から次の措置をとることを同大使館に通報する光栄を有する。
1 有効な日本国旅券を所持する日本国民は、継続して三箇月を超えない期間滞在するためポルトガル大陸本土、マデイラ諸島及びアソーレス諸島に、査証を取得することなく、入国することができる。
2 ポルトガル政府は、１の規定に基づいて査証なしにポルトガル大陸本土、マデイラ諸島及びアソーレス諸島に入国した日本国民であつて、滞在期間を三箇月を超えて延長することを希望するものの滞在期間の延長を許可することができる。
3 1の規定に基づく査証の免除は、日本国民であつて、就職し、永住し、自由職業若しくは他の生業を営み、報酬を得る目的で芸能(スポーツを含む。)に従事し、又は継続して三箇月を超える期間滞在する意図をもつてポルトガル大陸本土、マデイラ諸島及びアソーレス諸島に入国することを希望するものについては、適用しない。
4 1の規定に基づく査証の免除は、ポルトガルに入国する日本国民に対し、外国人の入国、滞在、居住、出国並びにその他の外国人の管理に関するポルトガルの法令に服することを免除するものではない。
5 ポルトガル大陸本土、マデイラ諸島及びアソーレス諸島に入国するための査証が必要とされるときは、ポルトガルの権限のある外交、領事及び行政当局は、その査証の付与についていかなる手数料をも徴収しない。
6 ポルトガル政府は、好ましくないと認める日本国民に対し、ポルトガルに入国し又は滞在することを拒否する権利を留保する。
7 ポルトガル政府は、書面による一箇月の予告をもつて前記の諸規定を終了させることができる。
