Tokyo, February 13, 1974.
書簡をもつて啓上いたします。本官は、マダガスカル共和国政府がマダガスカル共和国の食糧需給事情を緩和するため日本の協力を要請したことに基づき、千九百七十三年十二月二十日に東京においてマダガスカル共和国政府と日本国農林省食糧庁との間で締結された日本国産米の売買に関する契約(以下「契約」という。)に言及する光栄を有します。
Excellency,I have the honour to refer to the Contract for Sale and Purchase of Japanese Rice concluded between the Government of the Malagasy Republic and the Food Agency, Ministry of Agriculture and Forestry of Japan on December 20, 1973 in Tokyo (hereinafter referred to as "the Contract") at the request of my Government for Japanese cooperation in meeting the food requirements in the Malagasy Republic.
契約には、なかんずく次の事項が定められています。
The Contract provides, inter alia, for the following:
(a) 日本国農林省食糧庁は、マダガスカル共和国政府に対し、日本国産水稲うるち玄米八千メトリック・トンを、延払によつて、売り渡す。
(a) The Food Agency, Ministry of Agriculture and Forestry of Japan shall supply on a deferred payment basis to the Government of the Malagasy Republic a total of eight thousand (8, 000) metric tons of Japanese non-glutinous brown rice;
(b) その米穀の船積みは、千九百七十四年一月に開始し、できる限り速やかに完了する。
(b) The shipment of the said rice shall be started in January, 1974 and be completed as early as possible;
(c) その米穀の引渡しは、日本国の港における本船積込み渡しによる。
(c) The said rice shall be delivered on the basis of F.O.B. stowed at Japanese ports;
(d) その米穀の価格は、本船積込み渡しにより、一メトリック・トンにつき、五万九千六百円とする。
(d) The price of the said rice shall be fifty-nine thousand six hundred (59, 600) yen per metric ton on the basis of F.O.B. stowed;
(e) マダガスカル共和国政府は、その米穀をマダガスカル共和国の国内消費に使用しなければならない。
(e) The Government of the Malagasy Republic shall be bound to use the said rice for the domestic consumption of the Malagasy Republic;
(f) 延払の条件は、次のとおりとする。
(f) The terms and conditions of the deferred payment shall be as follows;
(i) 元本の支払は、千九百七十八年十二月一日の後五年の期間にわたり、均等年賦によつて行う。
(i) The payment of the principal shall be made in equal annual instalments over a period of five years after December 1, 1978;
(ii) 利子率は、千九百七十八年十一月三十日までは年二パーセント、及びその後五年の期間においては年三パーセントとし、かつ、その利子は、毎年支払う。
(ii) The rate of interest shall be two per cent (2%) per annum until November 30, 1978 and three per cent (3%) per annum during the period of five years thereafter and such interest shall be paid annually;
(g) 契約から生ずるすべての債務及び義務は、日本国通貨で表示され、かつ、マダガスカル共和国政府から日本国農林省食糧庁への支払は、日本円で行われる。
(g) All liabilities and obligations accruing from the Contract shall be quoted in Japanese currency and the payment from the Government of the Malagasy Republic to the Food Agency, Ministry of Agriculture and Forestry of Japan shall be made in Japanese yen.
本官は、マダガスカル共和国政府が契約の締結について極めて満足している旨を閣下に通報するとともに、契約に関連する次の了解を本国政府に代わつて確認します。
I wish to inform Your Excellency that the Government of the Malagasy Republic is highly satisfied with the conclusion of the Contract and to confirm on behalf of my Government the following understanding relating the Contract:
1 両政府は、それぞれの国において施行されている法令の範囲内で、契約の円滑なかつ適時の実施を容易にするものとし、このため必要な措置をとる。
1. The two Governments will, within laws and regulations in force in their respective countries, facilitate smooth and timely implementation of the Contract and take necessary measures to this end.
2 両政府は、生産及び国際通商貿易の通常の形態に有害な影響を与えることを避けるという原則が、契約による日本国産米の供給を規律すべきであることを認める。したがつて、マダガスカル共和国政府は、日本国政府と必要な協議を行いつつ、前記の日本国産米の購入との関連でこの原則を遵守するためのすべての妥当な措置をとる。
2. The two Governments recognize that the principle to avoid harmful interference with normal patterns of production and international commercial trade should govern the supply of Japanese rice under the Contract. The Government of the Malagasy Republic will, therefore, in due consultation with the Government of Japan, take all appropriate measures for the observance of the said principle in connection with the purchase of the said Japanese rice.
3 両政府は、この了解から又はそれに関連して生ずることがあるいかなる問題についても、相互に協議する。
3. The two Governments will consult with each other on any problems that may arise out of this understanding or in connection therewith.
本官は、閣下が前記のことが日本国政府の了解でもあることを貴国政府に代わつて確認されれば幸いであります。
I should be grateful if Your Excellency would confirm on behalf of Your Excellency's Government that this is also the understanding of the Government of Japan.
本官は、以上を申し進めるに際し、ここに閣下に向かつて敬意を表します。
