農業に関する日韓共同研究計画の実施のための技術協力に関する日本国政府と大韓民国政府との間の協定
AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE REPUBLIC OF KOREA CONCERNING TECHNICAL COOPERATION FOR THE IMPSEMENTATION OF THE JAPAN-KOREA JOINT RESEARCH PROGRAMME ON AGRICULTURE
日本国政府及び大韓民国政府は、大韓民国における農業の生産力を向上させるため相互に協力することを希望して、次のとおり協定した。
The Government of Japan and the Government of the Republic of Korea, desiring to cooperate with each other to improve agricultural productivity in the Republic of Korea, have agreed as follows:
第一条 (1) 両政府は、農業に関する日韓共同研究計画(以下「計画」という。)と呼ばれる水稲、畑作物及び野菜についての研究計画を相互に協力して実施する。
Article I (1) The two Governments will cooperate with each other in implementing a research programme on rice, upland crops and vegetables which will be called as Japan-Korea Joint Research Programme on Agriculture (herein-after referred to as "the Programme").
(2) 計画は付表Iに掲げる研究課題について及び研究機関において実施される研究業務及び研究業務に関するその他の活動で両政府の関係当局間で合意されるものから成る。
(2) The Programme will consist of research work on such themes and at such research institutions as listed in Annex I and other activities in connection with the research work to be agreed upon between the authorities concerned of the two Governments.
(3) 計画は、第八条(2)にいう合同委員会が毎年作成し、両政府の関係当局が承認した作業計画に従つて実施される。
(3) The Programme will be implemented in accordance with an operational work plan formulated annually by the Joint-Committee referred to in paragraph (2) of Article VIII and approved by the authorities concerned of the two Governments.
第二条 (1) 日本国政府は、日本国において施行されている法令に従い、付表IIに掲げる日本人専門家の役務を自己の負担において供与するため必要な措置をとる。
Article II (1) The Government of Japan will, in accordance with laws and regulations in force in Japan, take necessary measures to provide at its own expense the services of Japanese experts as listed in Annex II.
(2) コロンボ計画技術協力計画に基づく通常の手続によつて、若干名の専門家が必要に応じて更に追加派遣されることがある。
(2) Some additional experts may also be dispatched, as necessity arises, through the normal procedures under the Colombo Plan Technical Cooperation Scheme.
(3) (1)及び(2)にいう日本人専門家並びにその家族は、大韓民国において、付表IIIに掲げる特権、免除及び便宣を与えられ、かつ、同様の任務に基づき活動する第三国又は国際機関の専門家に大韓民国において与えられるものよりも不利でない特権、免除及び便宣を与えられる。
(3) The Japanese experts referred to in paragraphs (1) and (2) above and their families will be granted, in the Republic of Korea, privileges, exemptions and benefits as listed in Annex III and will be granted privileges, exemptions and benefits no less favourable than those granted in the Republic of Korea to experts of third countries or of international organizations performing under similar missions.
第三条 (1) 日本国政府は、日本国において施行されている法令に従い、付表IVに掲げられているような計画の実施に必要な設備、機械、車両、器具、工具、それらの予備部品及びその他の資材を自己の負担において供与するため必要な措置をとる。
Article III (1) The Government of Japan will, in accordance with laws and regulations in force in Japan, take necessary measures to provide at its own expense such equipment, machinery, vehicles, instruments, tools, their spare parts and other materials required for the implementation of the Programme as listed in Annex IV.
(2) (1)にいう物品は、陸揚港において、c・i・f建てで大韓民国政府の関係当局に引き渡された時に、大韓民国政府の財産となる。
(2) The articles referred to in paragraph (1) above will become the property of the Government of the Republic of Korea upon being delivered c. i. f. at the port of disembarkation to the authorities concerned of the Government of the Republic of Korea.
(3) 大韓民国政府は、これらの物品を計画の実施のためにのみ使用する。
(3) The Government of the Republic of Korea will utilize these articles exclusively for the purpose of implementation of the Programme.
第四条 日本国政府は、日本国において施行されている法令に従い、計画に携わる韓国の研究者及びその他の職員をコロンボ計画技術協力計画に基づく通常の手続によつて日本国に受け入れ、訓練又は研修旅行を行うために必要な措置をとる。
Article IV The Government of Japan will, in accordance with laws and regulations in force in Japan, take necessary measures to receive Korean researchers and other officials engaged in the Programme for training or study tour in Japan through the normal procedures under the Colombo Plan Technical Cooperation Scheme.
第五条 大韓民国政府は、日本人専門家のこの協定に基づく大韓民国における職務の遂行に起因し、その遂行中に発生し、又はその遂行に関連して日本人専門家に対する請求が生じた場合には、その請求に関する責任を負うことを約束する。ただし、日本人専門家の故意又は重大な過失から生ずる責任については、この限りでない。
Article V The Government of the Republic of Korea undertakes to bear claims, if any arises, against the Japanese experts resulting from, occurring in the course of, or otherwise connected with the discharge of their official functions in the Republic of Korea covered by the present Agreement, except for those claims arising from the wilful misconduct or gross negligence of the Japanese experts.
第六条 大韓民国政府は、大韓民国において施行されている法令に従い、自己の負担において次のものを提供するため必要な措置をとる。
Article VI The Government of the Republic of Korea will, in accordance with laws and regulations in force in the Republic of Korea, take necessary measures to provide at its own expense:
(a) 付表Vに掲げる韓国人専門家及びその他の職員の役務
(a) services of Korean counterpart officials and other personnel as listed in Annex V;
(b) 付表VIに掲げる土地及び建物並びに附帯施設
(b) land and buildings as listed in Annex VI as well as incidental facilities;
(c) 計画の実施のために必要な設備、機械、車両、器具、工具、それらの予備部品及びその他の資材(第三条(1)に基づき日本国政府によつて供与されるものを除く。)又は補充品
(c) supply or replacement of equipment, machinery, vehicles, instruments; tools, their spare parts and other materials required for the implementation of the Programme other than those provided by the Government of Japan under paragraph (1) of Article III; and
(d) 日本人専門家及びその家族のための適当な家具付きの住居並びにこの協定に基づく職務遂行中の日本人専門家のための交通の便宣
(d) suitable and furnished housing accommodation for the Japanese experts and their families and transportation facilities for the Japanese experts in the course of their duty under the present Agreement.
第七条 大韓民国政府は、大韓民国において施行されている法令に従い、次のものを負担するため必要な措置をとる。
Article VII The Government of the Republic of Korea will, in accordance with laws and regulations in force in the Republic of Korea, take necessary measures to meet:
(a) 第三条(1)にいう物品について大韓民国において課されることがある関税、内国税及びその他これらに類する課徴金
(a) customs duties, internal taxes and other similar charges, if any, imposed in the Republic of Korea in respect of the articles referred to in paragraph (1) of Article III;
(b) 第三条(1)にいう物品の大韓民国における輸送並びにこれらの物品の据付け、操作及び維持に必要な経費
(b) expenses necessary for the transportation within the Republic of Korea of the articles referred to in paragraph (1) of Article III as well as for the installation, operation and maintenance of such articles; and
(c) 計画の実施に必要な運営費
(c) running expenses necessary for the implementation of the Programme.
第八条 (1) 大韓民国政府は、計画の運営及び実施について責任を負い、日本人専門家は、計画の実施のための技術的事項について必要な助言を与える。
Article VIII (1) The Government of the Republic of Korea will be responsible for the administration and the implementation of the Programme, and the Japanese experts will provide necessary advice on technical matters for the implementation of the Programme.
(2) 計画の円滑かつ効果的な実施のため合同委員会が設置される。合同委員会の構成は、付表VIIに定める。
(2) There will be established a Joint-Committee for the smooth and effective implementation of the Programme. The composition of the Joint-Committee is specified in Annex VII.
第九条 計画の実施を成功させるため、両政府は、第二回日韓閣僚会議の際に発表された千九百六十八年八月二十九日付けの共同コミュニケの第十四項にいう日韓農林水産技術協力委員会を含む公式の経路を通じて相互に協議を行う。
Article IX There will be mutual consultation between the two Governments for successful implementation of the Programme through the official channels including the Japan-Korea Technical Cooperation Committee for Agriculture, Forestry and Fishery referred to in paragraph 14 of the Joint-Communique dated August 29, 1968 issued on the occasion of the Second Japan-Korea Ministerial Conference.
第十条 この協定は、署名の日に効力を生じ、五年の期間効力を有する。
Article X The present Agreement will come into force on the date of signature and remain in force for a period of five years.
もつとも、いずれの政府も、他方の政府に対していつでもこの協定を終了させる意思を通告することができ、その場合には、この協定は、そのような通告が行われた後六箇月で終了する。
However, either Government may at any time give notice to the other Government of its intention to terminate the Agreement, in which case the Agreement will terminate six months after such notice has been given.

2. Exemptions from import and export duties and any other charges in respect of personal and household effects, including one motor vehicle per family, which may be brought into the Republic of Korea from abroad.
