AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE FEDERAL REPUBLIC OFGERMANY ON COOPERATION IN THE FIELD OF SCIENCE AND TECHNOLOGY

　日本国政府及びドイツ連邦共和国政府は、

　The Government of Japan and the Government of the Federal Republic of Germany,

　科学技術の分野における両政府間の緊密な協力がそれぞれの国における生活の質を高めるという共通の目標を達成する上で相互の利益となることを信じ、また、

　Believing that close cooperation in the field of science and technology between the two Governments is of mutual advantage in attaining their common aims to enhance the quality of life in each country, and

　この協力を一層強化し及びその重要性を明らかにすることを希望して、

　Desiring to further strengthen such cooperation and to demonstrate its importance,

　次のとおり協定した。

　Have agreed as follows:

第一条
　両政府は、科学技術の分野における協力を促進する。この協力は、次の形態により行うことができる。

Article 1
　The two Governments will promote cooperation in the field of science and technology. Such cooperation may take the following forms:

(a)　科学的及び技術的側面について討議し及び情報を交換するための専門家の会合のような各種の形態の会合

(a) Meeting of various forms, such as those of experts, to discuss and exchange information on scientific and technological aspects;

(b)　科学者及び技術者の交流

(b) Exchange of scientists and technicians;

(c)　合意された協力計画の作成及び実施

(c) Planning and implementation of agreed cooperative programmes; and

(d)　情報の交換

(d) Exchange of information.

第二条
1　協力は、次の分野において行われる。

Article 2
1. Cooperation shall be undertaken in the following areas:

(a)　海洋科学技術

(a) Marine science and technology;

(b)　原子炉の安全性の研究

(b) Reactor safety research;

(c)　生物学及び医学の科学技術

(c) Biological and medical science and technology;

(d)　新たな環境保護技術の研究及び開発

(d) Research and development for new environmental protection technologies;

(e)　新たなエネルギー源及びエネルギー技術

(e) New energy resources and technologies; and

(f)　原子力船の開発

(f) Nuclear ship development.

2　協力は、両政府の間で合意されるその他の科学技術の分野においても行うことができる。

2. Cooperation may also be undertaken in such other areas of science and technology as may be agreed upon between the two Governments.

第三条
1　両政府は、この協定の実施に関連する主要な科学技術の政策事項を討議し、この協定に基づく活動及び成果を検討し並びにこの協定の実施について必要な勧告を両政府に行うことを任務とする合同委員会を設置する。合同委員会は、少なくとも年一回日本国及びドイツ連邦共和国において交互に会合する。

Article 3
1. The two Governments will establish a Joint Committee the functions of which will be to discuss major scientific and technological policy issues relating to the implementation of this Agreement, to review activities and accomplishments under this Agreement and to make necessary recommendations to the two Governments with regard to the implementation of this Agreement. The Joint Committee will meet at least once a year alternately in Japan and the Federal Republic of Germany.

2　両政府は、更に、合同委員会の全般的な指導の下に第二条に掲げる各専門分野における協力活動を検討し、調整し及び促進することを任務とするパネルを各分野につき原則として一つずつ設置する。

2. The two Governments will further establish Panels, as a rule one for each specialized area mentioned in Article 2, the functions of which will be, under the overall guidance of the Joint Committee, to review, coordinate and promote cooperative activities in the respective areas.

第四条
　この協定は、それぞれの国において施行されている法令に従つて適用される。

Article 4
　The provisions of this Agreement shall be applied in accordance with the laws and regulations in force in each country.

第五条
　この協定は、ドイツ連邦共和国政府がこの協定の効力発生の日から三箇月以内に日本国政府に対して反対の宣言を行わない限り、ベルリン地区についても、また、適用する。

Article 5
　This Agreement shall also apply to Land Berlin, provided that the Government of the Federal Republic of Germany does not make a contrary declaration to the Government of Japan within three months after the date of entry into force of this Agreement.

第六条
　この協定は、署名の日に効力を生ずる。この協定は、二年間効力を有し、その後は、最初の二年の期間の終りに又はその後いつでもいずれか一方の政府が他方の政府に対しこの協定を終了させる意思を少なくとも六箇月の事前の予告をもつて書面により通告することによつて終了させない限り効力を存続する。

Article 6
　This Agreement shall enter into force on the date of signature thereof. It shall remain in force for two years and will continue in force thereafter unless terminated by either Government at the end of the initial two year period or at any time thereafter by giving to the other Government at least six months' written advance notice of its intention to terminate this Agreement.

　千九百七十四年十月八日に東京で、日本語、ドイツ語及び英語により本書二通を作成した。日本文及びドイツ文は、ひとしく正文であり、日本文及びドイツ文の解釈に相違がある場合には、英文による。

　Done at Tokyo, on October 8, 1974, in duplicate in the Japanese, German and English languages. The Japanese and German texts are equally authentic and, in case there is any divergence of interpretation between the Japanese and German texts, the English text shall prevail.

Agreed Minutes

　日本国政府の代表者及びドイツ連邦国共和国政府の代表者は、本日署名された科学技術の分野における協力に関する日本国政府とドイツ連邦共和国政府との間の協定の交渉において到達した次の了解を記録する。

　The representatives of the Government of Japan and of the Government of the Federal Republic of Germany wish to record the following understandings reached during the negotiations for the Agreement between the Government of Japan and the Government of the Federal Republic of Germany on Cooperation in the field of Science and Technology, signed today.

1　情報の交換に関し、次のことが了解される。いずれの政府も前記の協定の下で送達される情報の正確性を点検する義務を負わない。ただし、政府自身(法的に政府の部分を構成する研究所を含む。)がその情報の作成者である場合には、自らが義務を負うことを明確にした限度において政府はその義務を負う。

1. Regarding the exchange of information, it is understood that neither Government is under an obligation to check the correctness of the information to be transmitted under the above-mentioned Agreement, except that in cases where the Government (including any research institute which forms legally part of the Government) is itself the author of such information, it is under such obligation to the extent it has expressly assumed.

　ただし、次のことも、また、了解される。前記の了解は、それぞれの国の国民が情報の不正確性に関連してその情報の作成者に対して有することがある請求権を害するものではない。

　It is also understood, however, that the above-statement is without prejudice to any claim that a national of either country may have to the author of such information in relation to the incorrectness of the information.

2　経済的な価値を有する情報の交換に関し、合同委員会がその情報のそれぞれの国の法令に従つた妥当な取扱いを検討することが了解される。

2. Regarding the exchange of such information of economic value, it is understood that the Joint Committee will consider the appropriate treatment of such information in accordance with the laws and regulations in each country.
