太平洋諸島信託統治地域に関する日本国とアメリカ合衆国との間の協定第一条の実施に関する日本国政府とアメリカ合衆国政府との間の交換公文

(Japanese Note)

　Washington, D.C., March 13, 1973

　書簡をもつて啓上いたします。本使は、千九百六十九年四月十八日に署名された太平洋諸島信託統治地域に関する日本国とアメリカ合衆国との間の協定（以下「協定」という。）に言及するとともに、協定第一条３の規定に従い、太平洋諸島信託統治地域の施政権者としてのアメリカ合衆国の政府に対し、次の取極を提案する光栄を有します。

　Excellency,
I have the honor to refer to the Agreement between Japan and the United States of America concerning the Trust Territory of the Pacific Islands signed on April l8, l969 (hereinafter referred to as "the Agreement") and to propose to the Government of the United States of America, as Administering Authority of the Trust Territory of the Pacific Islands , the following arrangements in accordance with the provisions of Article I, paragraph 3 of the Agreement:

1　日本国が信託統治地域の施政権者としてのアメリカ合衆国の使用に供する十八億円（一、八〇〇、〇〇〇、〇〇〇円）の金額が、日本国政府により、千九百七十二年五月二十七日から三年の期間に三回の年賦払により、かつ、日本国の毎年の予算措置に従い、2(1)にいう特別勘定に日本円で払い込まれる。

1. The amount of one billion and eight hundred million yen (l, 800,000,000) to be made avai1-able by Japan to the United States of America, in its capacity as Administering Authority of the Trust Territory, shall be paid in Japanese Yen into Special Accounts mentioned in sub-paragraph (l) of paragraph 2 by the Government of Japan in three annual instalments during the period of three years from May 27, 1972 and in accordance with annual budgetary appropriations of Japan.

2(1)　アメリカ合衆国の政府は、日本国民の支配する日本国の外国為替公認銀行（以下「銀行」という。）と取極を行ない、自己の名義で特別勘定を開設する。この取極は1にいう支払の受領及び4(1)にいう契約の当事者に対しての支払をアメリカ合衆国政府が振り出す小切手に基づき行なうことを銀行に授権し、並びにその他の銀行業務に関する事情を定めるものとし、その内容は、日本国政府に通告される。

2. (l) The Government of the United States of America shall enter into arrangements with an authorized foreign exchange bank of Japan controlled by Japanese nationals (hereinafter referred to as "the Bank") and shal1 open Special Accounts in its own name. The contents of such arrangements, authorizing the Bank to receive payments mentioned in paragraph I and to effect payments against checks drawn by the Government of the United States of America to the parties to contracts mentioned in sub-paragraph (1) of paragraph 4 and providing for other banking matters, shall be notified to the Government of Japan.

(2)　特別勘定は、4(2)に従つて確認された契約によりアメリカ合衆国の政府が負う債務の支払に充てるためにのみ使用される。

(2) The Special Accounts shall be used only for the purpose of covering the obligations incurred by the Government of the United States of America under contracts confirmed in accordance with sub-paragraph (2) of paragraph 4.

(3)　1に規定する支払に関連して生ずる利子は、両政府により別途合意される取極に従つて、信託統治地域の住民の福祉のために必要であると認められる日本国の生産物及び日本人の役務を日本国において購入するために使用される。

(3) Interests accrued in connection with the p8yments provided for in paragraph 1 shall be used for the purchase in Japan of the products of Japan and the services of the Japanese people to be deemed necessary for the welfare of the inhabit-ants of the Trust Territory of the Pacific Islands in accordance with separate arrangements to be agreed upon between the two Governments.

3　１の規定に従つて払い込まれる金額は、両政府間の協議により合意される。（以下「表」という。）に掲げられる日本国の生産物及び日本人の役務をアメリカ合衆国の政府が日本国において購入するために使用される。

3. The amount paid into in accordance with the provisions of paragraph 1 shall be used for the purchase in Japan by the Government of the United States of America of the pro-ducts of Japan and the services of the Japanese people which wi1l be ennumerated in a list (hereinafter referred to as "the List") to be agreed upon through consu1tation between the two Governments.

4(1)　アメリカ合衆国の政府は、表に従つて生産物及び役務を調達するため、アメリカ合衆国の政府に代わつて、日本国民又はその支配する日本国の法人と直接に日本円で契約を締結する調達官を任命する。

4. (1) The Government of the United States of America shall designate a procurement officer who shall conclude contracts in Japanese Yen, on behalf of the Government of the United States of America, directly with any Japanese national or any Japanese juridical person controlled by Japanese nationals for the purchase of products and services in accordance with the List.

(2)　すべての契約（その変更を含む。）は、協定及びこの取極の規定に合致するものであるかどうかについて確認を受けるため、(1)にいう調達官により日本国政府に提出される。契約は、日本国政府により正当に確認されるまで、かつ、確認されない限り効力を生じない旨の条項を含むものとする。

(2) All such contracts (including modification thereof) shall be transm1tted by the procurement officer mentioned above to the Government of Japan for confirmation as to whether the same are in conformity with the provisions of the Agreement and of the present arrangements. The contracts sha1l contain provisions to the effect that the contracts remain inoperative and without effect until and unless duly confirmed by the Government of Japan.

5　日本国の国民及び法人は、生産物及び役務の供与に関連して生ずる所得に関し、信託統治地域における課税を免除される。

5. With respect to income derived in connection with the supp1y of products and services, Japanese nationals and juridical persons shall be exempt from taxation in the Trust Territory.

6　生産物及び役務の供与に関連して信託統治地域において必要とされる日本国民は、その作業の遂行のため、信託統治地域への入国、同地域からの出国及び同地域における滞在に必要な便宜を与えられる。

6. Japanese nationals who may be needed in the Trust Territory in connection with the supply of products and services shall be accorded such facilities as may be necessary for their entry into, departure from and stay in the Trust Territory for the performance of their work.

7　協定及びこの取極に基づいて日本国により供与される生産物は、信託統治地域から再輸出してはならない。

7. The products supplied by Japan under the Agreement and the present arrangements shall not be re-exported from the Trust Territory.

8　この取極の実施に関する細目は、両政府間の協議により合意される。

8. Further detai1s for the implementation of the present arrangements shall be agreed upon through consu1tation between the two Governments.

　本使は、さらに、この書簡及び太平洋諸島信託統治地域の施政権者としてのアメリカ合衆国の政府に代わつて前記の取極を確認される閣下の返簡が閣下の返簡の日付の日に効力を生ずる協定第一条３の実施のための細目取極に関する両政府間の合意を構成するものとみなすことを提案する光栄を有しまず。

　I have further the honor to propose that this Note and Your Excellency's Note in reply confirming, on behalf of the Government of the United States of America, as Administering Authority of the Trust Territory, the foregoing arrangements shall be regarded as constituting an agreement between the two Governments on detailed arrangements for the implementation of Article I, paragraph 3 of the Agreement, which will enter into force on the date of Your Excel1ency`s reply.

　I have further the honor to confirm on behalf of my Government ) as Administering Authority of the Trust Territory of the Pacific Islands, the foregoing arrangements and to agree that Your Excellency's note and this note shall be regarded as constituting an agreement between the two Governments on detailed arrangements for the implementation of Article I, paragraph 3 of the Agreement, which will enter into force on the date of this reply.
