一部旅券査証及び査証料の相互免除に関する日本国政府とマルタ政府との間の取極（口上書）

在イタリア日本国大使館は、在イタリア・マルタ大使館に敬意を表するとともに、日本国政府が、日本国とマルタとの間の旅行並びに文化及び通商に関する関係を促進するために、日本国に入国することを希望するマルタ国民に対する査証及び査証料の免除に関し、千九百七十三年三月一日から相互主義に基づき次の措置をとる用意を有することを同大使館に通報する光栄を有する。
The Embassy of Japan in Italy presents its compliments to the Embassy of Malta in Italy and has the honour to inform the latter that the Government of Japan, with a view to facilitating the tourism and the cultural and commercial relations between Japan and Malta, is prepared to take, on a reciprocal basis, the following measures from the 1st of March, 1973, concerning the waiving of visas and visa fees for the Maltese nationals seeking entry to Japan:
(1) 有効なマルタ旅券を所持するマルタ国民であつて、継続して三箇月をこえない期間滞在する意図をもつて日本国に入国することを希望するものは、査証を取得することなく、日本国に入国することができる。
(1) The Maltese nationals in possession of valid Maltese passports who are seeking entry to Japan with the intention of staying there for a period not exceeding three consecutive months, may enter Japan without obtaining visas.
(2) 日本国政府は、(1)の規定に基づいて査証なしに日本国に入国したマル国民であつて、滞在期間を三箇月をこえて延長することを希望するものの滞在期間の延長を許可することができる。
(2) The Government of Japan may grant extensions of the period of stay to the Maltese nationals who, having entered Japan without visas under paragraph (1) above, desire to extend the period of stay beyond three months.
(3) (1)の規定に基づく査証の要件の免除は、マルタ国民であつて、就職し、永住し、自由職業若しくは他の生業を営み、報酬を得る目的で芸能(スポーツを含む。)に従事し、又は継続して三箇月をこえる期間滞在する意図をもつて日本国に入国することを希望するものについては、適用しない。
(3) The waiver of visa requirements under paragraph (1) above shall not apply to the Maltese nationals who desire to enter Japan with the intention of seeking employment or permanent residence, of exercising a profession or other occupation or of engaging in a public entertainment (including sport) for remunerative purposes or with the intention of staying there for a period exceeding three consecutive months.
(4) (1)の規定に基づく査証の要件の免除は、日本国に入国するマルタ国民に対し、外国人の入国、滞在、居住、出国その他の管理に関する日本国の法令に服することを免除するものではない。
(4) The waiver of the visa requirements under paragraph (1) above does not exempt the Maltese nationals entering Japan from the necessity of complying with the Japanese laws and regulations concerning the entry, stay, residence, exist and other control of aliens.
(5) 査証が必要とされ、かつ、付与されるときは、日本国の権限ある外交及び領事当局は、その査証についていかなる手数料をも微収しない。
(5) For visas, when required and granted, the competent Japanese diplomatic and consular authorities will not charge any fees.
(6) 日本国政府は、好ましくないと認めるマルタ国民に対し、日本国に入国し又は滞在することを拒否する権利を留保する。
(6) The Government of Japan reserves the right to refuse entry into or stay in Japan to the Maltese nationals considered undesirable.
(7) 日本国政府は、書面による一箇月の予告をもつて前記の諸規定を終了させることができる。
(7) The Government of Japan may terminate the foregoing by giving one month written notice.
日本国大使館は、以上を申し進めるに際し、ここに重ねてマルタ大使館に向かつて敬意を表する。
The Embassy of Japan avails itself of this opportunity to renew to the Embassy of Malta the assurances of its highest consideration.
