日本国政府と大韓民国政府との間の特許権及び実用新案権の相互保護に関する交換公文

(Japanese Note)


　

　Tokyo, January 25, 1973


　書簡をもつて啓上いたします。本大臣は、特許及び実用新案に関する諸権利の相互保護に関して日本国政府の代表者と大韓民国政府の代表者との間で行なわれた最近の交渉に言及し、同交渉の結果合意された次の取極を確認する光栄を有します。

　Excellency,
I have the honour to refer to the recent negotiations held between the representatives of the Government of Japan and the Government of the Republic of Korea concerning the mutual protection of rights on patents and utility models and to confirm the following arrangements agreed as a result of these negotiations:


1　大韓民国国民は、日本国の領域内において、日本国の関係法令の下で、特許及び実用新案に関する諸権利の享有に関し、日本国民に与えられる待遇よりも不利でない待遇を与えられる。

1. Nationals of the Republic of Korea shall, within the territory of Japan, be accorded, subject to the relevant laws and regulations of Japan, treatment no less favourable than that accorded to nationals of Japan with respect to the enjoyment of rights on patents and utility models.


2　日本国民は、大韓民国の領域内において、大韓民国の関係法令の下で、特許及び実用新案に関する諸権利の享有に関し、大韓民国国民に与えられる待遇よわも不利でない待遇を与えられる。

2. Nationals of Japan shall, within the territory of the Republic of Korea, be accorded,subject to the relevant laws and regulations of the Republic of Korea, treatment no less favourable than that accorded to nationals of the Republic of Korea with respect to the enjoyment of rights on patents and utility models.


3　1及び2にいう「国民」とは法人を含む。

3. "Nationals" as referred to in the preceding provisions shall include juridical persons.


4　前記の規定は、千九百七十四年一月一日から適用が開始される。

4. The foregoing provisions shall become applicable from January 1, 1974.


5　この取極は、いずれか一方の政府が、他方に対し、六箇月前に交書による予告を与えることにより終了させることができる。

5. The present arrangements may be terminated by either Government giving six months' notice in writing to the other.


　本大臣は、さらに、この書簡及び大韓民国政府に代わつて前記の取極を確認される閣下の返簡が、両政府間の合意を構成するものとみなすことを提案する光栄を有します。

　I have further the honour to propose that the present Note and Your Excellency's Note in reply thereto confirming the foregoing arrangements on behalf of the Government of the Republic of Korea shall be regarded as constituting an agreement between the two Governments.


　本大臣は、以上を申し進めるに際し、ここに閣下に向かつて敬意を表します。

　I avail myself of this opportunity to extend to Your Excellency the assurance of my highest consideration.

　書簡をもつて啓上いたします。本使は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。

　Excellency,
I have the honour to acknowledge the receipt of Your Excellency's Note of today's date, which reads as follows :

　本使は、さらに、大韓民国政府に代わり、前記の取極を確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成するものとみなすことに同意する光栄を有します。

　I have further the honour to confirm the foregoing arrangements on behalf of the Government of the Republic of Korea and to agree that Your Excellency's Note and this Note shall be regarded as constituting an agreement between the two Governments.


　本使は、以上を申し進めるに際し、ここに閣下に向かつて敬意を表します。

　I avail myself of this opportunity to extend to Your Excellency the assurance of my highest considerarion.
