日本青年海外協力隊の派遣に関する日本国政府とバングラデシュ人民共和国政府との間の交換公文
日本側書簡
(Japanese Note)
Dacca, March 24, 1973
書簡をもつて啓上いたします。本使は、日本国とバングラデシュとの間の技術協力を促進するため日本青年海外協力隊計画(以下「計画」という。)に基づき協力隊員をバングラデシュに派遣することに関し、両政府の代表者の間でダッカにおいて行なわれた最近の討議に言及するとともに、これらの代表者の間で到達した次の了解を日本国政府に代わつて確認する光栄を有します。
Sir: I have the honour to refer to the recent discussions held in Dacca between the repre sentatives of the Government of Japan and the Government of the People's Republic of Bangladesh concerning the dispatch of volunteers under the Japan Overseas Cooperation Volunteers Programme (hereinafter referred to as "the Programme") to Bangladesh with a view to promoting technical cooperation between the two countries and to confirm on behalf of the Government of Japan the following unders tandings reached between them:
1 日本国政府は、バングラデシュ人民共和国政府の要請に基づき、日本国の現行法令に従い、バングラデシュの社会的及び経済的開発に寄与するため、両政府間で別個に合意される計画に従つて協力隊員をバングラデシュに派遣する。
1. At the request of the Government of the People's Republic of Bangladesh and in accordance with the laws and regulations in force in Japan, the Government of Japan will dispatch the volunteers to Bangladesh for the purpose of contributing to the social and economic development of Bangladesh, according to the schedules to be separately agreed upon by the two Governments.
2 日本国政府は、予算措置がとられることを条件として、協力隊員の日本国とバングラデシュとの間の渡航費及びバングラデシュにおける生活手当を負担し、並びに協力隊員の任務の遂行に必要な装備、機械、材料及び医薬品を供与する。
2. The Government of Japan will, subject to budgetary appropriations, bear the cost of international travel between Japan and Bangladesh and living allowances in Bangladesh for the volunteers and provide such equipment, machinery, materials and medical supplies as necessary for the performance of their duties.
3 バングラデシュ人民共和国政府は、協力隊員に対し、次の特権、免除及び利益を与える。
3. The Government of the People's Republic of Bangladesh will grant the volunteers the following privileges, exemptions and benefits:
(1) 2に掲げる装備、機械、材料及び医薬品に関連して課される関税、内国税その他すべての種類の課徴金の免除
(1) The exemption from customs duties, taxes and charges of any kind in respect of the equipment, machinery, materials and medical supplies mentioned in 2 above.
(2) 協力隊員の身回品及び家庭用品に関連して課される関税、内国税その他すべての種類の課徴金(ただし、保管、運送及び類似の役務に関する課徴金を除く。)の免除
(2) The exemption from customs duties, taxes and charges of any kind other than those for storage, cartage and similar services in respect of their personal and household effects.
(3) 2に掲げる生活手当等協力隊員に海外から送付される給与に関連して課される所得税その他すべての種類の課徴金の免除
(3) The exemption from income tax and charges of any kind in respect of any allowances to be remitted for them from overseas such as the living allowances mentioned in 2 above.
(4) バングラデシュ人民共和国の国家公務員に提供されるものと同様の医療の便宜
(4) Medical facilities equivalent to those extended to Government officials of the People's Republic of Bangladesh.
(5) 事情の許す限り、協力隊員がバングラデシュ人民共和国政府により与えられた任務を遂行する場所における無料の住居施設
(5) Rent-free accommodations, as circumstances permit, at places where they are to perform their duties to be assigned to them by the Government of the People's Republic of Bangladesh.
４(1) バングラデシュ人民共和国政府は、バングラデシュにおけるこの計画の活動に関連して日本国政府が与える任務を遂行するための協力隊の駐在員一人及び調整員を受け入れる。
4. (1) The Government of the People's Republic of Bangladesh will accept a Representative and Coordinators who will discharge the duties to be assigned to them by the Government of Japan relative to the activities of the Programme in Bangladesh.
(2) 駐在員及び調整員は、その任務の遂行に必要な装備及び材料並びにその身回品及び家庭用品に関連して課される関税、内国税その他すべての種類の課微金(ただし、保管、運送及び類似の役務に関する課徴金を除く。)を免除される。駐在員及び調整員は、また、一人につき一台の白動車を無税で輸入することを認められる。
(2) The Representative and the Coordinators will be exempted from customs duties, taxes and charges of any kind other than those for storage, cartage and similar services in respect of equipment and materials necessary for the performance of their functions as well as of their personal and household effects. The Representative and the Coordinators will also be allowed duty-free importation of one motorcar each.
(3) 駐在員及び調整員は、海外から送付される給与に関連して課される所得税その他すべての種類の課微金を免除される。
(3) The Representative and the Coordinators will be exempted from income tax and charges of any kind in respect of any allowances to be remitted for them from overseas.
5 3(1)及び(2)並びに4(2)の規定に従い関税、内国税及び課徴金を課されることなく輸入されるすべての耐久財(自動車を含む。)は、関税、内国税又は課徴金を支払うことなくバングラデシュ国内において売却し、又は贈与してはならない。ただし、これらの財を再輸出し、又はバングラデシュ人民共和国政府に対し、その承認を得て、贈与するときは、この限りではない。
5. All durable goods, including motorcars, imported free from customs duties, taxes and charges in accordance with the provisions of sub-paragraphs (1) and (2) of paragraph 3 and of sub-paragraph (2) of paragraph 4 will not be sold or donated in Bangladesh without the payment of the customs duties, taxes or charges unless they are re-exported, or donated to the Government of the People's Republic of Bangladesh on its approval.
6 両政府は、バングラデシュにおけるこの計画の実施を成功させるため随時協議する。
6. The two Governments shall enter into consultation, from time to time, for the successful implementation of the Programme in Bangladesh.
本使は、さらに、前記の了解がバングラデシュ人民共和国政府にとつて受諾しうるものであるときは、この書簡及びこの書簡に同意される貴官の返簡が貴官の返簡の日付の日に効力を生じ、かつ、いずれか一方の政府が他方の政府に対しこれを終了させる旨の意思を書面により通告する日の後六箇月の間効力を有する両政府間の合意を構成するものとすることを提案する光栄を有します。
I have further the honour to propose that, if the foregoing understandings are acceptable to the Government of the People's Republic of Bangladesh, this Note and your Note in reply concurring therein shall constitute an agreement between the two Governments, which shall take effect on the date of your reply and shall remain in force until six months after the date of written notification from either Government to the other of its intention to terminate it.

書簡をもつて啓上いたします。本官は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。
I have the honour to acknowledge the receipt of Your Excellency's Note of today's date which reads as follows:

本官は、さらに、閣下の書簡に述べられている了解をバングラデシュ人民共和国政府に代わつて確認するとともに、閣下の書簡及びこの返簡がこの返簡の日付の日に効力を生じ、かつ、いずれか一方の政府が他方の政府に対しこれを終了させる旨の意思を書面により通告する日の後六箇月の間効力を有する両政府間の合意を構成するものであることに同意する光栄を有します。
I have further the honour to confirm the understandings set forth in Your Excellency's Note on behalf of the Government of the People's Republic of Bangladesh and to agree that Your Excellency's Note and this Note shall constitute an agreement between the two Governments, which shall take effect on the date of this reply and shall remain in force until six months after the date of written notification from either Government to the Other of its intention to terminate it.
