エジプト・アラブ共和国の商業上の債務の弁済期限延長に関する日本国政府とエジプト・アラブ共和国政府との間の交換公文

(Japanese Note) 


　

　Cairo, April 28, 1973.


　書簡をもつて啓上いたします。本使は、ある種の商業上の債務の弁済期限の延長に関し、日本国政府の代表者とエジプト・アラブ共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。

　Excellency,
I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and the Government of the Arab Republic of Egypt concerning a rescheduling of the repayment period s of certain commercial debts:


1　この取極は、この書簡の日付の日において弁済の行なわれていない商業上の債務のうち、原契約が日本国の居住者である関係債権者とエジプト・アラブ共和国の居住者である関係債務者との間で締結されたものであつて、エジプトの債務者が負担する商業上の債務の弁済期限の延長に関する千九百六十九年六月六日付けの交換公文に盛られた取極に基づき、エジプト中央銀行(以下「中央銀行」という。)により正当に引き受けられ、かつ、その弁済期限が延長された債務に適用される。前記の商業上の債務には、前記の交換公文に盛られた取極に基づいて行なわれた前記の商業上の債務の弁済期限の延長から生ずる利子は、含まれない。

1. The present arrangements shall apply to the commercial debts, outstanding at the date of the present Note, originally contracted between the creditors concerned resident in Japan and the debtors concerned resident in the Arab Republic of Egypt, duly assumed by the Central Bank of Egypt (hereinafter referred to as "C.B.E.") and the repayment periods of which were extended under the arrangements contained in the Exchange of Notes dated June 6, 1969 concerning a rescheduling of the repayment periods of commercial debts owed by Egyptian debtors. The said commercial debts shall not include interest accruing from the extension of the repayment period s of the said commercial debts effected under the arrangements contained in the said Exchange of Notes.


2(a)　エジプト・アラブ共和国政府は、1にいう商業上の債務に関し、中央銀行が、日本国の居住者である債権者に対し、(c)に掲げる弁済計画に従い、弁済期限をさらに延長することを要請することを確保する。

2.(a) The Government of the Arab Republic of Egypt shall ensure that, with respect to the commercial debts mentioned in paragraph 1 above, C.B.E. request the creditors resident in Japan to extend further the repayment periods in accordance with the repayment scheme set out in sub-paragraph (c) below.


(b)　日本国政府は1にいう商業上の債務に関し、(c)に掲げる弁済計画に従い、日本国の居住者である債権者が弁済期限の延長についての中央銀行の要請に応ずることを容易にするため、日本国の法令の範囲内で、あらゆる可能な措置をとる。

(b) The Government of Japan will take all possible measures,　within the scope of  the laws and regulations in Japan,　to  facilitate for the creditors resident in  Japan to comply with the requests of  C.B.E.　for the extension of the repayment periods,　in accordance with the repayment scheme set out in sub-paragraph (c)below, with respect to the commercial debts mentioned in paragraph 1 above.


(c)(i)　この取極に基づいて弁済期限が繰り延べられる商業上の債務は、合衆国ドルにより契約されたもの及びスターリング・ポンドにより契約されたものから成つている。合衆国ドルにより契約された債務の額は、一千五百三十六万二千六百八十八合衆国ドル七十九セント(一五、三六二、六八八合衆国ドル七九セント)、スターリング・ポンドにより契約された債務の額は、五万七千四百四十九スターリング・ポンド六十一ペンス(五七、四四九スターリング・ポンド六一ペンス)と見積もられている。

(c)(i) The commercial debts,　the repayment periods of which will be rescheduled under the present arrangements,　consist of debts contracted in  United States dollars and debts contracted in sterling pounds. The amount of the former debts is estimated to  be fifteen million three hundred and  sixty-two thousand six hundred and eighty-eight United States dollars and seventy-nine cents (US$15,362,688,79) and the amount of the latter debts is estimated to be fifty-seven thousand four hundred and forty-nine sterling pounds and sixty-one pences (￡57,449,61).


(ii)　(i)にいう額は、この書簡の附表Iに掲げる商業上の債務の弁済のための計画に従つて弁済される。

(ii) The amount mentioned in sub-paragraph (i)above will be repaid in accordance with the schedule for the  repayments of the commercial debts set out in Annex I to the present Note.


(iii)　この取極に基づいて行われる弁済期限の延長から生ずる延滞利子の率は、年六パーセントとする。延滞利子の額は(ii)に従つて行われる商業上の債務のそれぞれの弁済の額に関し、千九百七十年七月一日から当該弁済の期日までの期間について計算される。この延滞利子の額は、この書簡の附表IIに掲げる利子の支払いのための実施計画に従つて支払われる。この延滞利子については、エジプト・アラブ共和国のすべての租税及び課徴金が免除される。

(iii) The rate of moratorium interest accruing from the extension of the  repayment periods,　which will be effected under the present arrangements, will　be six per cent (6%) per annum. The amount of moratorium interest will be calculated on the amount of each repayment of the commercial debts to be made in accordance with sub-paragraph (ii) above in respect of the period from July 1,1970 until　the date for such repayment.　Such amount of moratorium interest will be paid in accordance with the schedule for the payments of interest set out in Annex II to  the present Note.　Such moratorium interest shall be exempt from all taxes and duties of the Arab Republic of Egypt.


(d)　エジプト・アラブ共和国政府は、関係契約の条件のうちこの書簡で特に言及されていないものは、引き続き変更されないことを確認する。

(d) The Government of the Arab Republic of Egypt hereby confirms that the terms and conditions of the contracts concerned which are not specifically referred to in the present Note shall remain unchanged.


3　ここに取り扱われているもの以外の事項については、中央銀行と関係債権者が合意するところによる。弁済期限の延長に伴つて生ずる銀行手数料は、日本国において生じたものを除き、中央銀行により負担される。

3. Matters other than those dealt with herein shall be as agreed upon between C.B.E. and the creditors concerned. Bank charges incidental to the extension of the repayment periods,　other than those incurred in Japan, shall be borne by C.B.E.


4　エジプト・アラブ共和国政府は、この取極に基づいて行われる商業上の債務の弁済及び利子の支払が交換可能通貨によつて行われることを確保する。

4. The Government of the Arab Republic of Egypt shall ensure that the repayments of the commercial debts and payments of interest to be made under the present arrangements shall be made in a convertible currency or currencies.


　本使は、閣下がエジプト・アラブ共和国政府に代わつて前記の了解を確認されれば幸いであります。

　I should be grateful if Your excellency would confirm the foregoing understanding on behalf of the Government of the Arab Republic of Egypt.
