日本国産米の売買に関する契約に関連する日本国政府とインドネシア共和国政府との間の交換公文

Tokyo, October 16, 1972.
書簡をもつて啓上いたします。本使は、インドネシア共和国政府がインドネシア共和国の食糧需給事情を緩和するため日本の協力を要請したことに基づき、かつ、同政府と日本国政府との間の千九百七十二年七月二十四日付けの千九百七十二年の日本の援助に関する交換公文Ｖに従つて、千九百七十二年九月一日に東京においてインドネシア共和国食糧調達庁と日本国農林省食糧庁との間で締結された「日本国産米の売買に関する契約」(以下「契約」という。)に言及する光栄を有します。契約には、なかんずく次の事項が定められています。
Excellency,I have the honour to refer to the Contract for Sale and Purchase of Japanese Rice concluded between Badan Urusan Logistik, the Republic of Indonesia and the Food Agency,Ministry of Agriculture and Forestry of Japan on September 1, 1972 in Tokyo (hereinafter referred to as "the Contract"), at the request of my Government for Japanese cooperation in meeting the food requirements in the Republic of Indonesia, and pursuant to Article V of the Exchange of Notes regarding Japanese assistance for 1972 dated July 24, 1972 between the Government of the Republic of Indonesia and the Government of Japan. The Contract provides, inter alia, for the following:
(a) 日本国農林省食糧庁は、十五日間の猶予期間付きで千九百七十二年九月から千九百七十三年二月末までの間に、インドネシア共和国食糧調達庁に対し、千九百六十九年産日本国産水稲うるち精米十五万七千五百メトリック・トンを、延払によつて、売り渡す。
(a) The Food Agency, Ministry of Agriculture and Forestry of Japan shall supply on a deferred payment basis to Badan Urusan Logistik of the Republic of Indonesia during the period from September, 1972 to the end of February,1973 with fifteen days allowance, a total of one hundred and fifty-seven thousand five hundred (157,500) metric tons of milled rice processed from Japanese non-glutinous brown rice cropped in 1969;
(b) その米穀の引渡しは、日本国の港における本船積込み渡しによる。
(b) The said rice shall be delivered on the basis of F.O.B. stowed at Japanese ports;
(c) その米穀の価格は、本船積込み渡しにより、一メトリック・トンにつき四万九千三百二十円とする。
(c) The price of the said rice shall be forty-nine thousand three hundred and twenty (49,320) yen per metric ton on the basis of F.O.B. stowed;
(d) インドネシア共和国食糧調達庁は、その米穀をインドネシア共和国の国内消費のために使用しなければならない。
(d) The Badan Urusan Logistik of the Republic of Indonesia shall be bound to use the said rice for the domestic consumption of the Republic of Indonesia;
(e) 延払の条件は、次のとおりとする。
(e) The terms and conditions of the deferred payment shall be as follows;
(i) 元本の支払は、十年の据置期間の後二十年の期間にわたり、均等年賦によつて行なう。
(i) The payment of the principal shall be made in equal annual installments over a period of twenty years after ten years' grace period;
(ii) 利子率は、据置期間においては年二パーセント、及び据置期間の後二十年の期間においては年三パーセントとし、かつ、その利子は、毎年支払う。
(ii) The rate of interest shall be two per cent (2%) per annum during the grace period and three per cent (3%)per annum during the period of twenty years after the grace period, and such interest shall be paid annually;
(f) 契約から生ずるすべての債務及び義務は日本国通貨で表示され、かつ、インドネシア共和国食糧調達庁から日本国食糧庁への支払は日本円で行なわれる。
(f) All liabilities and obligations accruing from the Contract shall be quoted in Japanese currency and the payment from the Badan Urusan Logistik of the Republic of Indonesia to the Food Agency of Japan shall be made in Japanese yen.
本使は、インドネシア共和国政府が契約の締結についてきわめて満足している旨を閣下に通報するとともに、契約に関連する次の了解を本国政府に代わつて確認します。
I wish to inform Your Excellency that the Government of the Republic of Indonesia is highly satisfied with the conclusion of the Contract and to confirm on behalf of my Government the following understanding relating to the Contract:
1 両政府は、それぞれの国において施行されている法令の範囲内で、契約の円滑なかつ適時の実施を容易にするものとし、このため必要な措置をとる。
1. The two Governments will, within laws and regulations in force in their respective countries, facilitate smooth and timely implementation of the Contract and take necessary measures to this end.
2 両政府は、生産及び国際通商貿易の通常の形態に有害な影響を与えることを避けるという原則が、契約による日本国産米の供給を規律すべきであることを認める。したがつて、インドネシア共和国政府は、日本国政府と必要な協議を行ないつつ、前記の日本国産米の購入との関連でこの原則を遵守するためのすべての妥当な措置をとる。
2. The two Governments recognize that the principle to avoid harmful interference with normal patterns of production and international commercial trade should govern the supply of Japanese rice under the Contract. The Government of the Republic of Indonesia will, therefore, in due consultation with the Government of Japan, take all appropriate measures for the observance of the said principle in connection with the purchase of the said Japanese rice.
3 両政府は、この了解から又はそれに関連して生ずることがあるいかなる問題についても、相互に協議する。
3. The two Governments will consult with each other on any problems that may arise out of this understanding or in connection therewith.
本使は、閣下が前記のことが日本国政府の了解でもあることを貴国政府に代わつて確認されれば幸いであります。
I should be grateful if Your Excellency would confirm on behalf of Your Excellency's Government that this is also the understanding of the Government of Japan.
本使は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。
