書簡をもつて啓上いたします。本大臣は、チリの債務者が負担する商業上の債務についての債務救済措置に関し、千九百七十二年四月十七日から四月十九日までパリで開催されたチリ共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した了解に基づいて日本国政府の代表者とチリ共和国政府の代表者との間で到達した次の了解を確認する光栄を有します。
Excellency, I have the honour to confirm the following understanding reached between the representatives of the Government of Japan and of the Government of the Republic of Chile concerning debt relief measures in respect of commercial debts owed by Chilean debtors on the basis of the understanding reached during the consultations between the representatives of the Government of the Republic of Chile and of the Governments of the creditor countries concerned held at Paris from 17 April to 19 April, 1972.
1(a) この取極は、一方においてチリ共和国政府、同政府企業及びチリの民間企業(以下「債務者」という。)と他方において日本国の居住者である関係債権者(以下「債権者」という。)との間で千九百七十一年一月一日以前に契約され、日本国政府が保険を引き受けた商業上の債務であつて千九百七十一年十一月一日から千九百七十二年十二月三十一日までの間(両期日を含む。)に弁済期限が到来したか又は到来するもののうち、弁済期間が一年をこえるものの元本及び利子の七十パーセントをこえない額に適用される。
1.(a) The present arrangements shall apply to an amount not exceeding seventy per cent (70%) of the principal of and interest on the commercial debts with a repayment period exceeding one year, contracted between the Government and governmental corporations of the Republic of Chile and Chile an private enterprises (hereinafter referred to as "the debtors") on the one hand and creditors concerned resident in Japan (hereinafter referred to as "the creditors") on the other before 1 January, 1971, insured by the Government of Japan, and already due or falling due between 1 November, 1971, and 31 December, 1972, both dates inclusive.
(b) この取極が適用される商業上の債務の元本及び利子の総額は、二百八十五万七千八百五十五合衆国ドル五十七セント(二、八五七、八五五合衆国ドル五七セント)と見積もられている。
(b) The total amount of the principal of and interest on the commercial debts to which the present arrangements shall apply is estimated at two million eight hundred and fifty-seven thousand eight hundred and fifty-five United States dollars and fifty-seven cents (U.S.$2,857,855.57).
2(a) チリ共和国政府は、(d)に掲げる支払計画で、同国政府が商業上の関係債務を決済するために1にいう額の支払を行なうことができるもの(以下「支払計画」という。)を債権者に通告する。
2.(a) The Government of the Republic of Chile shall notify the creditors of the payment scheme (hereinafter referred to as "the Payment Scheme") as set out in sub-paragraph (d) below in accordance with which the Government of the Republic of Chile will be able to pay the amount referred to in paragraph 1 above in order to settle the commercial debts concerned.
(b) チリ共和国政府は、1にいう額を支払計画に従い関係契約により指定された通貨によつて支払う。
(b) The Government of the Republic of Chile shall pay such amount in the currency designated in the contracts concerned in accordance with the Payment Scheme.
(c) 日本国政府は、チリ共和国の国際収支上の困難にかんがみ、商業上の関係債務か、支払計画に従つて行なわれる支払によつて決済されることを容易にするため、日本国において施行されている関係法令の範囲内で可能な措置をとる。
(c) The Government of Japan, in view of the balance of payments difficulties of the Republic of Chile, will take possible measures, within the scope of the relevant laws and regulations in force in Japan, to facilitate for the commercial debts concerned to be settled by the payment to be made in accordance with the Payment Scheme.
(d) 1にいう額は、半年ごとの十三回均等分割払により支払われる。第一回の支払は、千九百七十五年一月一日に行なわれる。
(d) The amount referred to in paragraph 1 above will be paid in thirteen (13) equal semi-annual installments, the first payment being made on 1 January, 1975.
3(a) チリ共和国政府は、債権者に対し、弁済期限が到来している商業上の関係債務のいかなる額についても、その債務が決済されていない限り、延滞利子を毎年各年の七月一日に支払う。
3.(a) the Government of the Republic of Chile shall pay to the creditors moratorium interest annually on 1 July of each year on the amount of any of the commercial debts concerned due to the extent that it has not been settled.
(b) 延滞利子率は、年六パーセントとする。
(b) The rate of moratorium interest will be six per cent (6%) per annum.
4 チリ共和国政府は、商業上の関係債務の決済に伴つて生ずる銀行手数料を支払う。
4. The Government of the Republic of Chile shall pay bank charges incidental to the settlement of the commercial debts concerned.
5 2、3及び4の規定にかかわらず、債務者がある商業上の債務についてチリ共和国において必要とされる措置をとらなかつた場合には、チリ共和国政府は、その債務が、関係契釣に従つて債務者と債権者との間で決済されることを、チリにおいて施行されている関係法令の範囲内で容易にし、かつ、その契約により指定された通貨による債務の支払のための送金の自由を保証する。
5. Notwithstanding the provisions of paragraphs 2, 3 and 4 above, if the debtors fail to take such measures in respect of certain commercial debts as are required in the Republic of Chile, the Government of the Republic of Chile shall facilitate, within the scope of relevant laws and regulations in force in Chile, for the debts to be settled between the debtors and the creditors in accordance with the contracts concerned, and also guarantee the free transferability in the currency designated in the contracts, of the payments of the debts.
6 チリ共和国政府は、商業上の関係債務の基因となつた関係契約の条件のうちこの書簡に特に言及されていないものは、引き続き変更されないことを確認する。
6. The Government of the Republic of Chile hereby confirms that the terms and conditions not specifically referred to in this Note, of the contracts concerned under which the commercial debts concerned were incurred, shall remain unchanged.
本大臣は、さらに、この書簡及び前記のことを貴国政府に代わつて確認される閣下の返簡が両政府間の合意を構成し、かつ、その合意は、日本国政府がチリ共和国政府からその効力発生に必要な国内手続を完了した旨の書面による通告を受領したときに効力を生ずるものとみなすことを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency's reply confirming the foregoing on behalf of your Government shall be considered as constituting an agreement between the two Governments, which will become effective upon the receipt by the Government of Japan of the written notification from the Government of the Republic of Chile of the completion of necessary domestic procedures for the entry into force of such agreement.

書簡をもつて啓上いたします。本大臣は、チリの債務者が負担する商業上の債務についての債務救済措置に関する本日交換された書簡に関し、閣下に次のことを通報する光栄を有します。
Excellency, With reference to the Notes exchanged today concerning debt relief measures in respect of commercial debts owed by Chilean debtors, have the honour to inform Your Excellency of the following:
前記の書簡に盛られた取極の実施のために、日本国政府は、日本国の債権者が政府に協力するよう必要な行政指導を行なう。もつとも、この取極は、日本国政府が債権者に対して一定の延滞利子率を受諾するよう強制する法的立場にはないことを前提として締結されたものである。したがつて、理論的には、日本国の居住者である債権者がチリ共和国政府又は関係債務者に対して関係契約に定められている延滞利子で、六パーセントをこえることがあるものを要求する場合が生じうる。そのような場合には、日本国政府は、チリ共和国政府又は関係債務者が要求された利子を支払うため必要な措置をとるものと了解する。
For the implementation of the arrangements contained in the said Notes, the Japanese Government will make necessary administrative guidance so that the creditors in Japan will cooperate with the Government. However, the arrangements have been made on the premise that the Japanese Government is not in a legal position to enforce the creditors to accept a certain rate of moratorium interest. Therefore, theoretically there may arise cases that creditors resident in Japan may request the Government of Republic of Chile or debtors concerned moratorium interests as provided for in the contracts concerned which may be above 6%. In such cases, the Government of Japan understands that the Government of the Republic of Chile or the debtors concerned shall take necessary measures to pay such requested interests.
