書簡をもつて啓上いたします。本大臣は、カンボディア共和国の経済安定計画の枠内におけるカンボディア共和国為替支持基金(以下「基金」という。)の設立に関するカンボディア共和国政府の代表者とオーストラリア、日本国、マレイシア、ニュー・ジーランド、タイ、グレート・プリテン及び北部アイルランド連合王国並びにアメリカ合衆国の政府(以下「拠出諸政府」という。)の代表者との間で最近行なわれた討議に言及し、かつ、次の了解の下に、基金に対する日本国政府の拠出を要請する光栄を有します。
Excellency,I have the honour to refer to the recent discussions held between the representatives of the Government of the Khmer Republic and the Governments of Australia, Japan, Malaysia, New Zealand, Thailand, the United Kingdom of Great Britain and Northern Ireland and the United States of America (hereinafter referred to as the "Contributing Governments" ) concerning the establishment of an Exchange Support Fund for the Khmer Republic (hereinafter referred to as the "ESF") within the framework of the economic stabilization program of the Khmer Republic and to request the contribution of the Government of Japan to the ESF with the following understandings:
1 カンボディア共和国政府は、カンボディア国立銀行(以下「銀行」という。)の下に基金を設立する。
1. The Government of the Khmer Republic shall establish the ESF within the Banque Nationaledu Cambodge (hereinafter referred to as the"BNC" ).
2 基金の目的は、カンボディア共和国の通貨と他の諸国の通貨との間の現実的な為替相場を維持しつつ、カンボディア共和国の非軍事的経済に必要とされる７に規定する輸入及び輸入関連役務並びにその他一定の役務及び商品の輸入のためのカンボディア共和国の外国為替費用に充てるための資金の調達を援助することにある。
2. The purpose of the ESF shall be to assist in the financing of the Khmer Republic's foreign exchange costs of imports and related services and of certain other services and commodities, as provided for in paragraph 7 below, which will be required for the civilian economy of the Khmer Republic, at realistic rates of exchange between the currency of the Khmer Republic and currencies of other countries.
3 基金の存続期間は、千九百七十二年三月一日から千九百七十二年十二月三十一日までとする。
3. The duration of the ESF shall be for the period from March 1,1972 through December 31,1972.
4 外国為替による基金の当初の資金は、三千四百四十九万二千七百四十二アメリカ合衆国ドル(三四、四九二、七四二ドル)に等しい額が見込まれ、その内訳は、次のとおりである。
4. The amount of the initial resources of the ESF in foreign exchange are expected to be the equivalent of 34,492,742 U.S. dollars comprising the following components:
(a)カンボディア共和国政府による八百七十五万アメリカ合衆国ドル(八、七五○、○○○ドル)に等しい拠出
(a) A contribution equivalent to 8,750,000 U.S. dollars by the Government of the Khmer Republic;
(b) カンボディア共和国政府が国際通貨基金から補償融資による引出しを行なおうとしている六百二十五万アメリカ合衆国ドル(六、二五○、○○○ドル)に等しい資金
(b) The proceeds of a compensatory financing drawing equivalent to 6,250,000 U.S. dollars which the Government of the Khmer Republic expects to make on the International Monetary Fund; and
(c) 拠出諸政府による千九百四十九万二千七百四十二アメリカ合衆国ドル(一九、四九二、七四二ドル)に等しい拠出
(c) Contributions equivalent to 19,492,742 U.S. dollars by the Contributing Governments.
5 カンボディア共和国政府を代表する銀行及び各拠出諸政府のそれぞれ一名の代表者により構成される作業部会が設置される。
5. A Working Group shall be established, composed of a representative from the BNC on behalf of the Government of the Khmer Republic and each of the Contributing Governments.
(a) 作業部会は、特に、
(a) The Working Group shall, inter alia:
(i) 基金の運営に関する政策について責任を有する。
(i) Be responsible for the policies concerning the operations of the ESF;
(ii) 基金の管理のための作業の指針を、必要に応じ、決定し、かつ指示する。
(ii) Determine and issue operational guidelines, as needed, for the management of the ESF;
(iii) 基金の運営を審査し、かつ、６にいう管理者の運営に関する報告を討議するため、毎月一回又は他の合意された期間をおいて会合する。
(iii) Meet once a month or at other agreed intervals to review the operations of the ESF and to discuss reports of the manager, mentioned in paragraph 6 below, on these operations;
(iv) カンボディア共和国政府の経済安定計画の進捗状況に関する銀行の代表者からの報告を受領する。
(iv) Receive reports from the representative of the BNC on the progress of the economic stabilization program of the Government of the Khmer Republic;
(v) 本暦年の第三・四半期において、基金の運営を審査し、かつ、カンボディア共和国の全体的な経済政策計画の効果的な実施に関する基金の寄与を評価する。この審査の認定は、カンボディア共和国政府及び拠出諸政府に対し文書により報告される。
(v) Review, during the third quarter of this calendar year, the operations of the ESF and assess its contribution to the effective implementation of the overall economic policy program of the Government of the Khmer Republic. The findings of this review shall be submitted in a written report to the Government of the Khmer Republic and the Contributing Governments; and
(vi) 国際通貨基金常駐代表を作業部会の会合に出席するよう招請する。
(vi) Invite the Resident Representative of the International Monetary Fund to attend meetings of the Working Group.
(b) 作業部会は、議長の選任手続を含むその手続規則を決定する。
(b) The Working Group shall determine its own rules of procedure, including the procedure for the election of the chairman.
(c) 作業部会の決定は、会合に出席しかつ投票する作業部会構成員の全会一致の投票によつて行なわれる。
(c) Decisions of the Working Group shall be made by a unanimous vote of the members present and voting.
6(a) 基金を管理するための専門的資格を有する管理者(以下「管理者」という。)が、作業部会の同意をえて銀行により任命される。管理者は、基金の外国為替及び現地通貨の取引に関連する自己の作業に関し、作業部会に対し責任を負う。管理者は、自ら必要と判断する、若しくは作業部会の指示に従い、基金の外国為替及び現地通貨の勘定を記帳する。管理者は、作業部会が指示する諸点につき、同部会の指示する期間をおいて基金の運用状況につき同部会に報告する。
6.(a) A professionally qualified manager(hereinafter referred to as the "Manager") shall be appointed by the BNC with the concurrence of the Working Group for the administration of the ESF. In his work relating to foreign exchange and local currency transactions of the ESF, the Manager shall be responsible to the Working Group. The Manager shall keep such foreign exchange and local currency accounts for the ESF as he may deem necessary or as instructed by the Working Group. The Manager shall report to the Working Group on such aspects of the operations of the ESF and at such intervals as the Working Group may instruct.
(b) 管理者の俸給及び関連外国為替費用は、国際通貨基金が負担する。
(b) The salary and associated foreign exchange costs of the Manager are to be financed by the International Monetary Fund.
(c) 作業部会は、基金の運営費を調達するために必要とされる基金の資産の一定の額を配分する権限を有する。
(c) The Working Group shall have authority to allocate such amount of the ESF assets as may be required to finance the costs of administration of the ESF.
7(a) 基金の外国為替資産は、次の外国為替費用のための資金を調達するため、7(b)、7(c)及び7(d)の規定に従つて銀行のみにより購入される。
7.(a) Foreign exchange assets of the ESF may be purchased only by the BNC, subject to the provisions of subparagraphs 7(b) , 7(c) and 7(d) below, for financing the foreign exchange costs of:
(i)カンボディア共和国の法令の下で許される非軍事的経済のためのすべての輸入及び輸入関連役務。ただし、アメリカ合衆国又は他の援助供与国の商品輸入計画によりもつぱら調達されることとなつている輸入及び役務を除く。
(i) all imports for the civilian economy and related services permissible under the laws and regulations of the Khmer Republic, except such imports and services which are reserved to be financed exclusively under the commodity import programs of the United States or any other aid-providing country; and
(ii)作業部会が承認する手統に従い認められるカンボディア共和国の非軍事的経済のための政府又は民間部門における技術援助又は資本参加事業計画に関連して必要とされる工学、建築その他の専門的な役務又は調達役務若しくは商品。ただし、基金により調達される技術援助又は資本参加事業計画のための役務又は商品は、基金に拠出する諸国によつてのみ供給される。
(ii) engineering, construction or other professional services, or procurement services or commodities, as are required in connection with technical assistance or capital projects in public or private sectors for the civilian economy of the Khmer Republic, in accordance with the procedures to be approved by the Working Group. Such services or commodities for technical assistance or capital projects as financed by the ESF shall be provided only by the countries contributing to the ESF.
(b) 銀行が基金から購入する外国為替の累積額は、千九百七十二年六月三十日までに千五百万アメリカ合衆国ドル(一五、○○○、○○○ドル)を、また千九百七十二年九月三十日までに二千五百万アメリカ合衆国ドル(二五、○○○、○○○ドル)をこえてはならない。
(b) The cumulative total purchase by the BNC of foreign exchange from the ESF shall not exceed the amount of 15,000,000 U.S. dollars by June 30, 1972; and of 25,000,000 U.S. dollars by September 30, 1972;
(c) 銀行は、基金から外国為替を購入するための要請を行なうときには、その外国為替が７(a)に規定された目的のために使用されることを確認する輸入信用状の写しあるいは管理者が必要と認める同様の書類を提出しなければならない。
(c) Whenever the BNC makes a request to purchase foreign exchange from the ESF, it shall submit copies of import letters of credit or similar documents as deemed necessary by the Manager to confirm that the foreign exchange is to be used for the purposes specified in subparagraph 7 (a) above; and
(d) 銀行が行なう基金からの外国為替のいかなる購入も、これに対応する銀行と市中銀行及びカンボディア共和国政府との間の取引において銀行自身が適用する為替相場で計算された現地通貨(カンボディア・リエル貨)の全額払込みと引換えに行なわれなければならない。
(d) All BNC purchases of foreign exchange from the ESF shall be made against full payment in local currency (Khmer riel),calculated at the exchange rates applied by the BNC itself in its corresponding transactions with the commercial banks and the Government of the Khmer Republic.
8 基金の外国為替売却により生ずる現地通貨資金(以下「見返り資金」という。)は、当初、基金が銀行に保有する見返り資金勘定に貸記される。管理者は、カンボディア共和国と各拠出諸政府との間の二国間取極の見返り資金の使用に関する規定に従い、拠出諸政府により拠出された外国為替の基金による売却から生ずる見返り資金の処理に関する細目手続を作業部会と協力して準備する。
8. The local currency proceeds (hereinafter referred to as the "Counterpart") of sales of foreign exchange by the ESF shall be credited initially to a Counterpart Account which shall be maintained by the ESF with the BNC. The Manager, in cooperation with the Working Group, shall prepare detailed procedures for handling the Counterpart arising from the sales by the ESF of foreign exchange contributed by the Contributing Governments, in accordance with the provisions concerning the utilization of the Counterpart in bilateral arrangements between the Government of the Khmer Republic and each of the Contributing Governments.
この見返り資金は、次のとおり使用される。
Such Counterpart shall be used as follows:
(a) カンボディア共和国政府は、見返り資金を(i)カンボディア共和国政府により事前に承認されている予算支出で、その資金を銀行から借り入れる必要のあるものを補なうことにより、又は(ii)カンボディア共和国政府の銀行に対する債務を返済することにより、同政府の予算上の援助のために使用することができる。
(a) The Counterpart may be used by the Government of the Khmer Republic to support its budget, either (i) by covering budget expenditures previously approved by the Government of the Khmer Republic for which funds would otherwise need to be borrowed from the BNC, or (ii) by repaying debts of the Government of the Khmer Republic to the BNC;
(b) ある拠出政府がその拠出額に相当する見返り資金の額の全部あるいは一部につき前記のごとく使用することに同意しない旨を表明するときは、当該の見返り資金額は、凍結される。すなわち、基金の存続期間中基金が保有する。
(b) If a contributing government indicates that it will not be agreeable to such use, in whole or in part, an amount of the Counterpart proportionate to its contribution shall be sterilized, that is, held by the ESF for the duration of the ESF;
(c) 基金の終了に際し、凍結された見返り資金の使用は、カンボディア共和国政府と各拠出諸政府との間の合意による。
(c) On the termination of the ESF, utilization of sterilized Counterpart shall be by agreement between the Government of the Khmer Republic and each of the Contributing Governments;
(d) このように凍結された見返り資金の合意された割合については、国際金融機関により是認された計画を優先的に対象とすることとして、経済、社会福祉及び開発の目的のためのカンボディア共和国政府の特定の計画の現地通貨費用を調達するために凍結が解除されることができる。
(d) An agreed percentage of such sterilized Counterpart may be desterilized to finance local costs of specific projects of the Government of the Khmer Republic for economic, social welfare and development purposes, with preference to those projects endorsed by an international financial institution; and
(e) 基金の運営費のための現地通貨は、6の規定に従い、見返り資金から調達されることができる。
(e) Local costs of administration of the ESF may be financed from the Counterpart as provided for in paragraph 6.
9 カンボディア共和国の公認為替市場における外国為替の購入及び売却は、千九百七十一年十月二十二日に国際通貨基金により承認された同国の為替制度(ただし、千九百七十二年一月十七日に、援助供与国との間で直接行なわれる援助取引につき別建ての相場を設定する旨の修正がなされているもの)に従つて行なわれる。為替相場は、銀行と国際通貨基金常駐代表との間の不断の協議に基づき、必要に応じ、随時銀行により調整される。
9. Buying and selling of foreign exchange in the official exchage market of the Khmer Republic shall be in accordance with the exchange system for the Khmer Republic approved by the International Monetary Fund on October 22, 1971, as modified on January 17, 1972 by the establishment of a separate rate for aid transactions effected directly with donor countries. The exchange rates shall be adjusted by the BNC, if necessary, from time to time, on the basis of continuing consultations between the BNC and the Resident Representative of the International Monetary Fund.
10(a) 管理者は、基金が毎月受領し、保有し、又は支出した資金の状態を示す月次報告を作業部会に提出する。
l0.(a) The Manager shall submit monthly reports to the Working Group, indicating the status of funds received by, held in or disbursed by the ESF each month.
(b) 基金の勘定は、作業部会が選定する国際的に認められた独立の監査事務所により監査を受ける。監査事務所は、監査計画を準備するにあたつて作業部会及び個個の拠出政府の特定の調査事項及び要請を考慮に入れる。
(b) The ESF's accounts shall be audited by an internationally recognized independent audit firm selected by the Working Group.In preparing the audit program, this audit firm shall take into account specific inquiries and requests of the Working Group and of individual Contributing Government.
(c) カンボディア共和国政府は、各拠出諸政府との間で締結する二国間取極の規定に従つて適正に使用されなかつた基金のいかなる資産についても、各拠出諸政府の基金に対する拠出に比例してこれを拠出諸政府に返済する。
(c) The Government of the Khmer Republic shall reimburse the Contributing Governments, in proportion to their contributions to the ESF, for any ESF assets which have not been properly used in accordance with any provision of bilateral arrangements to be entered into between the Government of the Khmer Republic and each of the Contributing Governments.
11 基金の終了に際し、基金の外国為替資産は、拠出諸政府の基金に対する拠出に比例してカンボディア共和国政府と拠出諸政府との間で配分される。
11. On the termination of the ESF, any foreign exchange assets in the ESF shall be divided among the Government of the Khmer Republic and the Contributing Governments in proportion to their contributions to the ESF.
12 カンボディア共和国政府と日本国政府は、この了解から又はそれに関連して生ずることがあるいかなる事項についても相互に協議する。
l2. The Government of the Khmer Republic and the Government of Japan shall consult with each other in respect of any matter that may arise from or in connection with the present understandings.
本大臣は、さらに、前記の了解が日本国政府にとつて受諾しうるときは、この書簡及び閣下のその旨の返簡が閣下の返簡の日付の日に効力を生じ、かつ、基金の終了とともに自動的に終了する両政府間の合意を構成するものとみなすことを提案する光栄を有します。
I have further the honour to propose that, if the foregoing understandings are acceptable to the Government of Japan, the present Note and Your Excellency's Note to that effect shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of your reply and be automatically terminated with the expiry of the ESF.
本大臣は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

Excellency, I have the honour to acknowledge receipt of Your Excellency's Note of today's date, which reads as follows:

I have further the honour to confirm on behalf of my Government that the foregoing understandings are acceptable to the Government of Japan and to agree that Your Excellency's Note and this Note shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of this reply and be automatically terminated with the expiry of the ESF.
本使は、さらに、本国政府に代わつて、次のことを閣下に通報する光栄を有します。
I have further the honour to inform Your Excellency on behalf of my Government as follows:
1 日本国政府は、その予算措置に従い、五百万アメリカ合衆国ドル(五、○○○、○○○ドル)に相当する額の範囲内で基金に拠出する意図を有する。
1. The Government of Japan has an intention to contribute to the ESF, within the limit of the amount equivalent to 5,000,000 U.S. dollars in accordance with its budgetary appropriation.
2 前記の了解8に関し、日本国政府の拠出に帰せられる基金の見返り資金の額は、基金の存続期間中凍結される。
2. With reference to paragraph 8 of the foregoing understandings, the amount of the Counterpart or the ESF attributable to the contribution by the Government of Japan should be sterilized for the duration of the ESF.
本使は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。
