Japanese Note
Dacca, December 5,1972.
書簡をもつて啓上いたします。本官は、バングラデシュ人民共和国政府が同国経済の安定と開発を図るために日本国政府に対して行なつた合成繊維製の布及び糸、河川用船舶並びに小型トラック(以下「繊維その他の製品」という。)に関する援助要請にこたえて日本国政府とバングラデシュ人民共和国政府との間で最近行なわれた交渉に言及し、かつ、次の取極を提案する光栄を有します。
Sir,I have the honour to refer to the recent negotiations held between the Government of Japan and the Government of the People's Republic of Bangladesh in response to the aid request concerning synthetic textile fabrics and yarn, river boats and light trucks (hereinafter referred to as "textile and other goods") made by the Government of the People's Republic of Bangladesh to the Government of Japan in order to stabilize and develop the Bangladesh economy and to propose the following arrangements:
1 日本国政府は、日本国の関係法令に従い、バングラデシュ人民共和国政府に対し、両政府間の合意によつて延長されない限り、この取極が効力を生ずる日から千九百七十三年三月三十一日までの期間に三十六億九千二百六十万円(三、六九二、六○○、○○○円)を限度とする額の贈与を行なう。
1. The Government of Japan will extend to the Government of the People's Republic of Bangladesh, in accordance with the relevant laws and regulations of Japan, a grant up to three thousand six hundred and ninety-two million six hundred thousand yen (3,692,600,000), which will be made available during the period between the date of coming into force of the present arrangements and March 31, 1973, unless the period is extended by mutual agreement between the two Governments.
2 この贈与は、バングラデシュ人民共和国政府が次の日本国の生産物及び日本人の役務を購入するために使用される。
2. The grant for the purchase of the following products of Japan and services of Japanese people:
(1) 三十億二百六十万円(三、○○二、六○○、○○○円)を限度とする合成繊維製の布及び糸並びにそのバングラデシュ人民共和国の港までの輸送に必要な役務並びに
(1) Synthetic textile fabrics and yarn and services necessary for their transportation to the port of the People's Republic of Bangladesh up to three thousand and two million and six hundred thousand yen (3,002,600,000); and
(2) 六億九千万円(六九○、○○○、○○○円)を限度とする河川用船舶及び小型トラック並びにそのバングラデシュ人民共和国の港までの輸送に必要な役務。
(2) River boats and light trucks and services necessary for their transportation to the port of the people's Republic of Bangladesh up to six hundred and ninety million yen (690,000,000).
3 バングラデシュ人民共和国政府又はその指定する当局は、前項にいう生産物及び役務の購入のため日本国民又は日本国民の支配する法人と日本円で契約を締結する。この契約は、日本国政府によりこの贈与の対象として適格である旨認証されなければならない。
3. The Government of the People's Republic of Bangladesh or its designated authority will enter into contracts in Japanese yen with Japanese nationals or juridical persons controlled by Japanese nationals for the purchase of the products and services referred to in the preceding paragraph. Such contracts shall be verified by the Government of Japan to be eligible for the grant.
4 この贈与は、日本国政府が、認証された契約によりバングラデシュ人民共和国政府又はその指定する当局が負う債務の弁済に充てるための資金を日本国の外国為替公認銀行(以下「銀行」という。)に開設されるバングラデシュ人民共和国政府名義の勘定に日本円で払い込むことによつて実施される。
4. The grant will be executed by the Government of Japan making payments in Japanese yen to cover the obligations incurred under the verified contracts by the Government of the People's Republic of Bangladesh or its designated authority to an account to be opened in an authorized foreign exchange bank of Japan (hereinafter referred to as "the Bank") in the name of the Government of the People's Republic of Bangladesh.
5 4にいう払込みは、バングラデシュ人民共和国政府が発行する支払授権書に基づき銀行が支払請求書を提出した時に行なわれる。
5. The payments referred to in paragrah 4 will be made when payment requests are presented by the Bank under an authorization to pay issued by the Government of the People's Republic of Bangladesh.
6 4にいう勘定の目的は、日本国政府が支払う日本円を受領すること及び日本国民又は日本国民の支配する法人に対する支払を行なうことに限られる。
6. The purpose of the account referred to in paragraph 4 is only to receive the payments in Japanese yen by the government of Japan and to pay to Japanese nationals or juridical persons controlled by Japanese nationals.
7 贈与に基づく繊維その他の製品及び役務の供給に関し、日本国民又は日本国民の支配する法人は、バングラデシュ人民共和国政府において課されるすべての関税、内国税その他課徴金を免除される。
7. With respect to the supply of the textile and other goods and services under the grant, Japanese nationals or juridical persons controlled by Japanese nationals shall be exempt from any duties, taxes and charges to be imposed in the People's Republic of Bangladesh.
8 贈与に基づいて購入される繊維その他の製品は、バングラデシュ人民共和国から再輸出されてはならない。
8. The textile and other goods purchased under the grant shall not be re-exported from the People's Republic of Bangladesh.
9 2(1)にいう合成繊維製の布及び糸の供給に関し、バングラデシュ人民共和国は、日本円による払込み額と等価額から関連する検査、陸揚げ、貯蔵、国内輸送及び配分についてバングラデシュ人民共和国政府が負担する費用を差し引いたバングラデシュ通貨による額を千九百七十三年十二月三十一日までに自己の名義でバングラデシュ銀行の特別勘定に積み立てるものとする。このようにして積み立てられた通貨は、両政府間で別途合意される取極に従つて、バングラデシュ人民共和国における経済開発の目的のために利用される。
9. With respect to the supply of the synthetic textile fabrics and yarn as prescribed in sub-paragraph (1) of paragraph 2, the Government of the People's Republic of Bangladesh shall deposit in a special account in its name in the Bank of Bangladesh by December 31,1973,the amount in Bangladesh currency which shall be the equivalent of the yen disbursement less the cost to the government of the People's Republic of Bangladesh for related survey, unloading, storage, internal transportation and distribution. The currency thus deposited shall be utilized for economic development purposes in Bangladesh in accordance with separate arrangements to be agreed upon between the two Governments.
10 4にいう勘定への貸記及び借記に関する手続細目は、銀行とバングラデシュ人民共和国政府又はその指定する当局との間の協議により合意される。
10. The procedural details concerning the credit to and the debit from the account referred to in paragraph 4 will be agreed upon through consultation between the Bank and the Government of the People's Republic of Bangladesh or its designated authority.
11 両政府は、この取極に関連して生ずることがあるいかなる事項についても相互に協議する。
11. The two Governments will consult with each other in respect of any matter that may arise connection with the present arrangements.
本官は、さらに、この書簡及びバングラデシュ人民共和国政府に代わつて前記の取極を確認される貴官の返簡が貴官の返簡の日付の日に効力を生ずる両政府間の合意を構成するものとみなすことを提案する光栄を有します。
I have further the honour to propose that the present Note and your Note in reply confirming on behalf of the Government of the People's Republic of Bangladesh the above arrangements will be regarded as constituting an agreement between the two Governments, which will enter into force on the date of your reply.

I have further the honour to confirm on behalf of the Government of the People's Republic of Bangladesh the arrangements embodied in the Note will be regarded as constituting an agreement between the two Governments, which will enter into force on the date of this reply.
