日本青年海外協力隊の派遣に関する日本国政府とエティオピア帝国政府との間の交換公文

書簡をもつて啓上いたします。本使は、日本国とエティオピア帝国との間の技術協力を促進するため日本青年海外協力隊(以下(協力隊)という。)をエティオピア帝国に派遣することに関し、日本国政府とエティオピア帝国政府の代表者との間でエティオピア帝国において行なわれた最近の討議に言及する光栄を有します。本使は、これらの代表者の間で到達した次の了解を日本国政府に代わつて確認いたします。
Excellency, I have the honour to refer to the recent discussions held in the Empire of Ethiopia by the representatives of the Government Japan and the Government of the Empire of Ethiopia, concerning the dispatch to the Empire of Ethiopia of the Japan 0verseas Cooperation Volunteers (hereinafter referred to as "the Volunteers"), with a view to promoting technical cooperation between Japan and the Empire of Ethiopia. I wish to confirm on behalf of the Government of Japan the following understandings reached between our representatives;
1 日本国政府は、エティオピア帝国政府の要請に基づき、日本国の現行法令に従い、かつ、予算措置がとられることを条件として、両政府間で別個に合意される計画に従つてエティオピア帝国の社会的及び経済的開発活動に従事する協力隊の隊員をエティオピア帝国に派遣する。
l. At the request of the Government of the Empire of Ethiopia, the Government of Japan shall, in accordance with the laws and relations in force in Japan and subject to budgetary appropriations, dispatch to the Empire of Ethiopia the members of the Volunteers to be assigned in social and economic development activities of the Empire of Ethiopia, according to the schedules to be separately agreed upon by the two Governments.
2 エティオピア帝国政府は、選抜に先だち協力隊の各隊員のための作業内容の説明を日本国政府に提供する。作業内容の説明は、協力隊の各隊員の任務及び必要とされる資格を定めるものとする。
2. Prior to recruitment, the Government of the Empire of Ethiopia shall provide the Government of Japan with the job description for each member of the Volunteers. The job description shall define the duties as well as the qualification of each member of the Volunteers.
日本国政府は、協力隊の各隊員に関するすべての入手可能な情報をエティオピア帝国政府に提供する。
The Government of Japan shall provide Government of the Empire of Ethiopia with all the available information concerning each member of the Volunteers.
3 日本国政府は、協力隊の隊員の日本国とエティオピア帝国との間の渡航費を負担し、協力隊の隊員のエティオピア帝国における任期中その生恬手当を支給し、並びに協力隊の隊員の任務の遂行に必要な機械、器具、材料及び医薬品を供与する。
3. The Government of Japan s hall bear the cost of international travel of the members of the Volunteers between Japan and the Empire of Ethiopia, and shall provide living allowances for the members of the Volunteers throughout their assignments in the Empire of Ethiopia, and shall also provide such equipment, machinery, materials and medical supplies as are necessary for the performance of the duties of the members of the Volunteer
4 協力隊の隊員は、その任務の遂行に際し、エティオピア帝国政府又は任命される機関若しくは機構の指示のみに従う。協力隊の隊員は、随時効力を有しているエティオピア帝国政府の規則及び命令に従う。
4. In the performance of their duties, the members of the Volunteers shall be under the exclusive direct ion of the Government of the Empire of Ethiopia or the Agency or Organization to which they are assigned. They shall comply with such regulations and orders of the Government of the Empire of Ethiopia which may be in force from time to time.
5 日本国政府は、エティオピア帝国における協力隊の活動に関連して日本国政府が与える任務を遂行するための協力隊の駐在員一人及び調整員二人を派遣する。
5. The Government of Japan will dispatch a Representative and two Coordinators of the Volunteers who will discharge the functions to be assigned to them by the Government of Japan relative to the activities of the Volunteers in the Empire of Ethiopia.
6 エティオピア帝国政府は、次のことを行なう。
6. The Government of the Empire of Ethiopia shall:
(a) 協力隊の駐在員、調整員及び隊員に日本国から送付される手当及び給付に対し又はこれらに関連して課される所得税その他すべての種類の課徴金を免除すること。
(a) exempt from income tax and charges of any kind imposed on or in connection with any emoluments and allowances to be remitted from Japan for the Representative, the Coordinators and the members of the Volunteers;
(b) 協力隊の駐在員、調整員及び隊員の任務の遂行に必要な機械、器具、材料その他の物品の輸入に対し又はこれに関連して課される関税その他すべての種類の課徴金を免除すること。
(b) exempt from customs duties and charge of any kind imposed on or in connection with the importation of the equipment machinery, materials and other supplies necessary for the performance of the duties of the Representative, the Coordinators and the members of the Volunteers;
(c) 協力隊の駐在員、調整員及び隊員の身回品及び家庭用品の輸入に対し又はこれに関連して課される関税その他すべての種類の課徴金を免除すること。ただし、それらの物品が着任後六箇月以内に輸入され、かつ、任務の完了に際して再輸出されること若しくは現地で売却される場合には、関税その他課徴金を支払うことを条件とする。
(c) exempt from customs duties and charges of any kind imposed on or in connection with the importation of the personal and ho use hold effects of the Representative, the Coordinators and the members of the Volunteers, provided that such effects are imported with in six months of their arrival and that they will be re-exported on completion of tour of duty or will be subject to payments of customs duties and other charges if sold locally;
(d) 駐在員及び調整員が公務に使用する一人につき一台の自動車を免税で輸入することを認めること。ただし、現地で売却される場合には、相当の輸入税を支払うものとする。
(d) allow the Representative and the Coordinators duty-free importation of one motor vehicle each for their official use, provided that appropriate import and other duties may be paid if sold locally; and
(e) 協力隊の各隊員に対し、適当な無料の住居施設若しくは適当な無料の住居施設が得られない場合には、住居費のための適当な月極めの補助金を供与する。この住居施設に関する細目取極は、1にいう計画中に定める。
(e) provide each member of the Volunteers with appropriate rent-free accommodation or appropriate monthly subsidy for housing allowance if the appropriate rent-free accommodation is not available. The detailed arrangements of this accommodation will be provided for in the schedules mentioned in 1 above.
7 両政府は、協力隊の計画の実施を成功させるため随時協議する。
7. The two Governments shall consult with each other, from time to time, concerning the successful implementation of the programme of the Volunteers.
8 前記の了解は、両政府間の交換公文によつて修正することができ、かつ、一方の政府が他方の政府に対しこの了解を終了させる意思を六箇月前に書面によつて通告することにより終了させることができる。
8. The understandings set out above may be amended by an exchange of notes between the two Governments and terminated by either Government by giving to the other six months' written not ice of its intention to terminate them.
本使は、さらに、前記の了解がエティオピア帝国政府にとつて受諾しうるものであるときは、この書簡及び閣下の返簡が閣下の返簡が閣下の返簡の日付の日に効力を生ずる日本政府とエティオピア帝国政府との間の合意を構成するものとすることを提案する光栄を有します。
I have further the honour to propose that, the foregoing understandings are acceptable the Government of the Empire of Ethiopia, this Note and Your Excellency's reply to that effect shall constitute an agreement between the two Governments, which shall come into force on the date of Your Excellency's reply.
本使は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

Excellency, I have the honour to acknowledge receipt of Your Excellency's note of today's date which reads as follows:

本委員長は、さらに、閣下の書簡に述べられている了解をエティオピア帝国政府に代わつて確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成するものであることに同意する光栄を有します。
I have further the honour to confirm the understandings set forth in Your Excellency, note on behalf of the Government of the Empire of Ethiopia and to agree that Your Excellency's note and this reply shall constitute an agreement between the two Governments.
