ダニム発電所の完全な修復工事のための贈与に関する日本国政府とヴィエトナム共和国政府との間の交換公文

 Saigon, October 2, 1971

 書簡をもつて啓上いたします。本使は、ヴィエトナム共和国政府が行なつた千九百七十年十月十七日付けの両政府間の交換公文に基づく贈与の対象となつていない同発電所の施設の修復ための援助要請にこたえて日本国政府とヴィエトナム共和国政府との間で最近行なわれた交渉に言及し、かつ、ヴィエトナム共和国政府が修復工事の安全かつすみやかな実施のため必要なすべての措置(発電所周辺地域の治安確保のための措置を含む。)をとり、さらに、工事終了後は修復された施設の十分な維持及び効果的な管理のため必要なすベての措置をとる旨の同政府が前記の交渉において行なつた言明を考慮して、日本国政府に代わつて次の取極を提案する光栄を有します。
 Excellency,
I have the honour to refer to the recent negotiations held between the Government of Japan and the Government of the Republic of Vietnam in response to the aid request by the Government of the Republic of Vietnam for the restoration of the facilities of the Danhim Power Station which are not covered by the grant under the exchange of notes between the two Governments dated October 17, 1970 and, considering the statement made by the Government of the Republic of Vietnam in the course of the said negotiations that it would take all measures necessary for safe and smooth operation of the restoration works, including measures to ensure the security in the area around the Power Station and it would also take all measures necessary for full maintenance and effective operation of the restored facilities after the completion of the works, have further the honour to propose, on behalf of my Government, the following arrangements:

1 日本国政府は、ヴィエトナム共和国政府が前記の修復を実施してダニム発電所の完全な発電機能を回復することに協力するため、日本国の関係法令及びこの取極の規定に従い、六億八千七百九十万円(六八七、九〇〇、〇〇〇円)を限度とする額の贈与を行なう。
1. For the purpose of cooperating with the Government of the Republic of Vietnam in effecting the restoration described above and bringing the Danhim Power Station back to its full generating capacity, the Government of Japan will extend to the Government of the Republic of Vietnam, in accordance with the relevant laws and regulations of Japan and the provisions of the present arrangements, a grant up to six hundred eighty-seven million nine hundred thousand yen(687,900,0O0.-).

 この贈与は、両政府間の合意によつて延長されない限り、この取極が効力を生ずる日から千九百七十二年十二月三十一日までの期間にわたつてヴィエトナム共和国政府の使用に供される。
 The Grant will be made available to the Government of the Re public of Vietnam during a period from the date of comin9 into force of the present arran9ements to December 31,1972 unless the period is extended by the mutual agreement between the two Governments.

2 この贈与は、1にいう修復に必要な日本国の生産物及び日本人の役務をヴィエトナム共和国政府が購入するために使用される。
2. The grant will be used for the purchase by the Government of the Republic of Vietnam of products of Japan and services of Japanese people necessary for the restoration referred to in paragraph 1.

3ヴィエトナム電力公社は、2にいう生産物及び役務の購入のため、日本国民又は日本国民が支配する法人(以下「日本国民等」という。)と円貨建ての契約を締結する。
3  The Vietnam Power Company will enter into contracts in Japanese yen with Japanese nationals or juridical persons controlled by Japanese nationals (hereinafter referred to as "the Japanese nationals etc.") for the purchase of the  products and services referred to in paragraph 2.

 契約は、日本国政府によりこの贈与の対象として適格である旨認証されなければならない。
 The contracts will be verified by the Government of Japan to be eligible for the grant.

4 この贈与は、日本国政府が、契約によりヴィエトナム電力公社が負う積務の弁済にあてるための資金を東京銀行本店に開設されるヴィエトナム共和国政府名義の贈与勘定に日本円で払い込むことによつて実施される。
4  The grant will be executed by the Government of Japan making payments in Japanese yen to coven the obligations incurred by the Vietnam Power Company under the contracts referred to in paragraph 3 to a grant account to be opened in the name of the Government of the Republic of Vietnam in the head office of the Bank of Tokyo ,Ltd.

5 4の払込みは、ヴィエトナム電力公社が発行する支払授権書に基づき東京銀行が支払請求書を提出した時に行なわれる。
5. Th4e payments referred to in paragraph 4 will be made when payment requests are presented to the Government of Japan by the Bank of Tokyo, Ltd. under an authorization to pay issued by the Vietnam Power Company.

6 4の贈学勘定の目的は、日本国政府が支払う日本円を受領すること及び日本国民等に対する支払を行なうことに限られる。
6. The purpose of the grant account referred to in paragraph 4 is only to receive the payments in Japanese yen by the Government of Japan and to pay to the Japanese nationals etc.

7 ヴィエトナム共和国政府は、工事を円滑かつすみやかに実施するものとし、特に次の措置をとる。
7. The Government of the Republic of Vietnam will ensure the prompt and smooth execution of the works and take, inter alia, the following measures;

(a) 工事に必要なすべての生産物及び役務(この贈与に基づき日本国から購入されるものを除く。)を提供する。
(a) to provide all products and services required for the works other than those to be purchased from Japan under the grant.

(b) 日本国民等につき、この贈与に基づく生産物及び役務の供与に関してヴィエトナム共和国において課されることがある関税、内国税その他の課徴金を免除する。
(b) to exempt the Japanese nationals etc. from the payment of customs duties, internal taxes and other fiscal levies which may be imposed in the Republic of Vietnam with respect to the supply of products and services under the grant.

(c) この贈与に基づいて供与される生産物の陸揚港における陸揚げ及び目的地までの輸送を安全かつすみやかに行なうためすベての必要な措置をとる。
(c) to take all necessary measures for safe and smooth unloading at the port of disembarkation and transportation to the work site of the products supplied under the grant.

8 贈与勘定への貸記及び借記に関する手続綱目は、東京銀行とヴィエトナム電力公社との間の協議により合意される。
8. The procedural details concerning the credit to and the debit from the grant account will be agreed upon through consultation between the Bank of Tokyo, Ltd. and the Vietnam Power Company.

9 両政府は、この取概に関連して生ずることがあるいかなる事項についても相互に協議する。
9. The two Governments will consult with each other in respect of any matter which may arise in connection with the present arrangements.

 現他の状況が修復工事の安全な実施に適しなくなつた場合には、両政府は、いずれか一方の政府の要請により直ちに協議し、工事の中断を含む必要な措置をすみやかにとる。
 Should the local situation fail to be fitting to safe operation of the restoration work, the two Governments will, upon request of either Government, consult with each other and take immediately necessary measures including suspension of the works.

 本使は、さらに、この書簡及びヴィエトナム共和国政府に代わつて前記の取極を確認される閣下の返簡が閣下の返簡の日付の日に効力を生ずる両政府間の合意を構成するものとみなすことを提案する光栄を有します。
 I have further the honour to propose that the present note and Your Excellency's reply confirming on behalf of the Government of the Republic of Vietnam the above arrangements shall be regarded as constituting an agreement between the two Governments, which will enter into effect or the date of Your Excellency's reply.

 本使は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

I have the honour to acknowledge the receipt of Your Excellency's note of today date which reads as follows:

 本大臣は、さらに、ヴィエトナム共和国政府に代わつて前記の取極を確認するとともに、閣下の書簡及びこの返簡がこの返簡の日付の日に効力を生ずる両政府間の合意を構成するものとみなすことに同意する光栄を有します。
 I have further the honour to confirm on beha1f of my Government the foregoing arrangements and to agree that Your Excellency's note and this note shall be regarded as constituting an agreement between the two Governments, which will enter into effect the date of this reply.
