日本国とフィリピン共和国との間の日本国産米の売買に関する契約に関連する交換公文

Tokyo, November 10, 1971.
書簡をもつて啓上いたします。本官は、フィリピン共和国政府がフィリピンの食糧需給事情を緩和するため日本の協力を要謂したことに基づき、千九百七十一年九月二十九日に東京においてフィリピン共和国米・とうもろこし庁と日本国農林省食糧庁との間で締結された「フィリピン共和国と日本国との間の日本国産米の売買に関する契約」(以下「契約」という。)に言及する光栄を有します。契約には、なかんずく次の事項が定められています。
Excellency, I have the honour to refer to the "Contract for Sale and Purchase of Japanese Rice between the Republic of the Philippines and Japan" concluded between the Rice and Corn Administration of the Republic of the Philippines and the Food Agency, Ministry of Agriculture and Forestry of Japan on September 29, 1971, in Tokyo(hereinafter referred to as "the Con-tract")at the request of my Government for Japanese cooperation in meeting the food requirements in the Republic of the Philippines. The Contract provides, inter alia, for the following:
(a) 日本国農林省食糧庁は、十五日間の猶予期間付きで千九百七十一年十月末までに、フィリピン共和国米・とうもろこし庁に対し、千九百六十八年産日本国産水稲うるち精米一万メトリック・トンを、延払いによつて、売り渡す。
(a) The Food Agency, Ministry of Agriculture and Forestry of Japan shall supply on a deferred payment basis to the Rice and Corn Administration of the Republic of the Philippines by the end of October, 1971, with fifteen days allowance, a total of ten thousand (l0,000) metric tons of milled rice processed from Japanese non-glutinous brown rice cropped in 1968;
(b) その米穀の引渡しは、日本国の港における本船積込み渡しによる。
(b) The said rice shall be delivered on the basis of F.O.B. stowed at Japanese ports;
(c) その米穀の価格は、本船積込み渡しにより、一メトリック・トンにつき、四万九千三百二十円とする。
(c) The price of the said rice shall be forty-nine thousand three hundred and twenty (49,320) yen per metric ton on the basis of F.O.B. stowed;
(d) その米穀は、フィリピン共和国の国内消費に使用されなければならない。
(d) The said rice shall be bound to be used for the domestic consumption of the Republic of the Philippines;
(e) 延払の条件及び手続は、次のとおりとする。
(e) The terms and conditions of the deferred payment shall be as follows:
(i) 元本の支払は、この契約の署名の日から千九百七十六年八月三十一日までの据置期間の後十年の期間にわたり、均等年賦によつて行なう。
(i) The payment of the principal shall be made in equal annual instalments over a period of ten years after the grace period from the date of signing of this Contract to August 31, 1976;
(ii)利子の率は、据置期間においては年二パーセント、及び据置期間の後十年の期間においては年三パーセントとし、かつ、その利子は、毎年支払う。
(ii) The rate of interest shall be two per cent (2%) per annum during the grace period and three per cent (3%) per annum during the period of ten years after the grace period, and such interest shall be paid annually;
(f) 前記の勘定及び契約の実施から生ずるその他の債務であつて日本国食糧庁に支払われるものは、日本円で表示され、かつ、日本円で支払われる。
(f) The above accounts and such other liabilities as may arise from the execution of the Contract and are paid to the Food Agency of Japan shall be quoted and paid in Japanese yen.
本官は、フィリピン共和国政府が契約の締結にきわめて満足している旨を閣下に通報するとともに、契約に関連する次の了解を本国政府に代わつて確認します。
I wish to inform Your Excellency that the Government of the Republic of the Philippines is highly satisfied with the conclusion of the Contract and to confirm on behalf of my Government the following understanding relating to the Contract:
1 両政府は、それぞれの国において施行されている法令の範囲内で、契約の円滑な及び適時の実施を容易にするものとし、このため必要な措置をとる。
1. The two Governments will, within laws and regulations in force in their respective countries, facilitate smooth and timely implementation of the Contract and take necessary measures to this end.
2 両政府は、生産及び国際通商貿易の通常の形態に有害な影響を与えることを避けるという原則が、契約による日本国産米の供給を規律すべきであることを認める。したがつて、フィリピン共和国政府は、日本国政府と必要な協議を行ないつつ、前記の日本国産米の購入との関連でこの原則を遵守するためのすべての妥当な措置をとる。
2. The two Governments recognize that the principle to avoid harmful interference with normal patterns of production and international commercial trade should govern the supply of Japanese rice under the Contract. The Government of the Re-public of the Philippines will, therefore, in due consultation with the Government of Japan, take all appropriate measures for the observance of the said principle in connection with the purchase of the said Japanese rice.
3 両政府は、この了解から又はそれと関連して生ずることがあるいかなる問題についても相互に協議する。
3. The two Governments will consult with each other on any problems that may arise out of this understanding or in connection therewith.
本官は、閣下が前記のことが日本国政府の了解であることを貴国政府に代わつて確認されれば幸いであります。
I should be grateful if Your Excellency would confirm, on behalf of Your Excellency's Government, that this is also the understanding of the Government of Japan.
本官は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。
