日本国と大韓民国との間の日本国産米の売買に関する契約に関連する交換公文

(Korean Note)

　August 28, 1971

　書簡をもつて啓上いたします。本使は、大韓民国政府が大韓民国の食糧需給事情を緩和するため日本の協力を要請したことに基づき、千九百七十一年七月二十八日に東京において大韓民国調達庁と日本国農林省食糧庁との間で締結された「大韓民国と日本国との間の日本国産米の売買に関する契約」( 以下「契約」という。)に言及する光栄を有します。契約には、なかんずく次の事項が定められています。

　Excellency,
I have the honour to refer to the "Contract for Sale and Purchase of Japanese Rice between the Republic of Korea and Japan"　concluded between the office of Supply of the Republic of Korea and the Food Agency, Ministry of Agriculture and Forestry of Japan on July 28, 1971, in Tokyo (hereinafter referred to as "the Contract"), at the request of my Government for Japanese cooperation in meeting the food requirements in the Republic of Korea. The Contract provides, inter alia,　for the following:

(a) 日本国農林省食糧庁は、千九百七十一年七月から千九百七十一年十月までの間に、大韓民国調達庁に対し、日本国産水稲うるち玄米二十万メトリック・トン(千九百六十九年産十五万メトリック・トン、千九百七十年産五万メトリック・トン)を、延払によつて、売り渡す。

(a) The Food Agency, Ministry of Agriculture and Forestry of Japan shall supply on a deferred payment basis to the 0ffice of Supply of the Republic of Korea during the period from July 1971 to October 1971, a total of two hundred thousand (200,000) metric tons of Japanese non-glutinous brown rice, one hundred and fifty thousand (150,000) metric tons cropped in 1969, fifty thousand　(50,000) metric tons cropped in 1970;

(b) その米穀の引渡しは、日本国の港における本船積込み渡しによる。

(b) The said rice shall be delivered on the basis of F.O.B. stowed at Japanese ports;

(c) その米穀の価格は、本船積込み渡しにより、一メトリック・トンにつき、次のとおりとする。

(c) The price of the said rice shall be as follows:

　三等米　千九百六十九年産四万六千七百六十四円、千九百七十年産四万九千六百四十四円

　for grade No.3, cropped in 1969, forty-six thousand seven hundred and sixty-four (46,764) yen, and cropped in 1970, forty-nine thousand six hundred and forty-four (49,644) yen per metric ton on the basis of F.O.B. stowed; and

　四等米　千九百六十九年産四万五千八百六十四円、千九百七十年産四万八千七百四十四円

　for grade No.4, cropped in 1969, forty-five thousand eight hundred and sixty-four (45, 864) yen and, cropped in 1970, forty-eight thousand seven hundred and forty-four (48,744) yen per metric ton on the basis of F.O.B. stowed;

(d) 延払の条件及び手続は、次のとおりとする。

(d) The terms and conditions of the deferred payment shall be as follows;

(i) 元本の支払は、十年の据置期間の後二十年の期間にわたり均等年賦によつて行なう。

(i) The payment of the principal shall be made in equal annual instalments over a period of twenty years after ten years' grace period;

(ii) 利子の率は、据置期間においては年二パーセント、及び据置期間の後二十年の期間においては年三パーセントとし、かつ、その利子は、毎年支払う。

(ii) The rate of interest shall be two per cent (2%) per annum during the grace period and three per cent (3%) per annum during the period of twenty years after the grace period, and such interest shall be paid annually;

(e) 前記の勘定及び契約の実施から生ずるその他の債務であつて日本国食糧庁に支払われるものは、日本円で表示され、かつ、日本円で支払われる。

(e) The above accounts and such other liabilities as may arise from the execution of the Contract and are paid to the Food Agency of Japan shall be quoted and paid in Japanese Yen.

　本使は、契約に関連する次の了解を本国政府に代わつて確認します。

　I would like to confirm on behalf of my Government the following understanding relating to the Contract:

1 両政府は、それぞれの国において施行されている法令の範囲内で、契約の円滑な及び適時の実施を容易にするものとし、このため必要な措置をとる。

1. The two Governments will, within laws and regulations in force in their respective countries, facilitate smooth and timely implementation of the Contract and take necessary measures to this end.

2 両政府は、生産及び国際通商貿易の通常の形態に有害な影響を与えることを避けるという原則が、契約による日本国産米の供給を規律すべきであることを認める。したがつて、大韓民国政府は、日本国政府と必要な協議を行ないつつ、前記の日本国産米の購入との関連でこの原則を遵守するためのすべての妥当な措置をとる。

2. The two Governments recognize that the principle to avoid harmful interference with normal patterns of production and international commercial trade should govern the supply of Japanese rice under the Contract. The Government of the Republic of Korea will, therefore, in due consultation with the Government of Japan, take all appropriate measures for the observance of the said principle in connection with the purchase of the said Japanese rice.

3 両政府は、この了解から又はそれと関連して生ずることがあるいかなる問題についても相互に協議する。

3. The two Governments will consult with each other on any problems that may arise out of this understanding or in connection therewith.

　本使は、閣下が前記のことが日本国政府の了解でもあることを貴国政府に代わつて確認されれば幸いであります。

　I should be grateful if Your Excellency l would confirm, on behalf of Your Excellency's Government, that this is also the understanding of the Government of Japan.

　本使は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。
