電気通信研究センターの設置に関する日本国政府とイラン帝国政府との間の協定

AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE IMPERIAL GOVERNMENT OF IRAN CONCERNING THE ESTABLISHMENT OF TELECOMMUNICATION CENTRE

　日本国政府及びイラン帝国政府は、両国間の経済及び技術強力を推進し、かつ、両国間に伝統的に存在する友好関係を一層強化することを真摯に希望して、次のとおり協定した。

　The Government of Japan and the Imperial Government of Iran, earnestly desiring to advance the economic and technical cooperation between the two countries and thereby to strengthen further the friendly relations which traditionally exist between the two countries, have agreed as follows:

第一条
(1)　両政府は、相互に協力してテヘラン大学内に電気通信研究センターを設置する。同センターの名称は、「イラン電気通信研究センター」(以下「センター」という。)とする。

ARTICLE I
(1) The two Governments shall cooperate with each other in establishing a Telecommunication Research Centre in the Tehran University, Iran, which shall be called "Iran Telecommunication Research Centre" (hereinafter referred to as "the Centre").

(2)　センターの業務は、電気通信に関する理論的及び実際的研究を行なうこと、電気通信の研究についてイラン人に対する訓練を行なうこと、電気通信の方式及び設備の開発を促進すること並びにイランにおける電気通信業務に関する基準及び手続の制定について援助を行なうこととする。

(2) The functions of the Centre shall be to conduct theoretical and practical research in telecommunication, to train Iranian nationals in telecommunication research, to promote development of telecommunication systems and equipment and to assist in establishing rules and procedures concerning telecommunication services in Iran.

第二条
(1)　日本国政府は、日本国において施行されている法令に従い、附表Iに掲げる日本人顧問その他の必要な日本人専門家の役務を自己の負担において供与するため必要な措置をとる。

ARTICLE II
(1) In accordance with laws and regulations in force in Japan, the Government of Japan will take necessary measures to provide at its own expense the services of a Japanese advisor and other requisite Japanese experts, as listed in Annex I.

(2)　日本人専門家及びその家族は、イランにおいて、附表IIに掲げる特権及び免除並びに千九百六十六年七月十四日付けの規則又はこの協定の署名の後施行される規則で前記の規則より有利な待遇を規定するものに定める特権及び免除を与えられる。

(2) The Japanese experts and their families shall be granted in Iran privileges and exemptions as listed in Annex II and those stipulated in the regulation dated July 14th, 1966 (Tir 23rd, 1345) or in the regulation which may enter into force after the signature of this Agreement which provides for more favourable treatment.

第三条
(1)　日本国政府は、日本国において施行されている法令に従い、センターの設置に必要な附表IIIに掲げる機械、設備、工具及び資材を自己の負担において供与するため必要な措置をとる。

ARTICLE III
(1) In accordance with laws and regulations in force in Japan, the Government of Japan will take necessary measures to provide at its own expense machinery, equipment, tools and materials required for the establishment of the Centre as listed in Annex III.

(2)　前記の物品は、ホッラムシャヘル港においてc・i・f建てでイランの関係当局に引き渡された時に、イラン帝国政府の財産となる。

(2) The articles referred to above shall become the property of the Imperial Government of Iran upon being delivered c.i.f. at the port of Khorramshahr to the Iranian authorities concerned.

(3)　前記の物品は、日本人専門家の助言により、センターの目的のためにのみ使用される。

(3) The articles referred to above shall be utilized exclusively for the purpose of the Centre with the advice of the Japanese experts.

第四条
　日本国政府は、日本国において施行されている法令に従い、日本人専門家に対応するイラン人要員に日本国における必要な技術訓練上の便宜を自己の負担において供与するため必要な措置をとる。

ARTICLE IV
　In accordance with laws and regulations in force in Japan, the Government of Japan will take necessary measures to provide Iranian personnel, counterpart to the Japanese experts, at its own expense, with necessary technical training facilities in Japan.

第五条
　この協定に基づきイランに派遣される日本人顧問及び専門家は、この協定に定めるその任務の遂行に関連して過失により与えた損害につき、それぞれ毎年、五百万リアルを最高保険金額とするテヘランのイラン保険会社の保険に付される。相当の保険料は、イラン帝国政府が支払う。

ARTICLE V
　The Japanese advisor and experts who are dispatched to Iran in accordance with this Agreement, will be insured, individually, every year, with the Iran Insurance Company, Tehran, to a maximum compensation up to 5,000,000 Rials, for any damage caused through negligence by Japanese advisor and experts in connection with the execution of their tasks under this Agreement. The appropriate insurance premium will be paid by the Imperial Government of Iran.

第六条
(1)　イラン帝国政府は、自己の負担において、次のものを供与する。

ARTICLE VI
(1) The Imperial Government of Iran undertakes to provide at its own expense;

(a)　附表IVに掲げるイラン人理事長その他の必要なイラン人職員

(a) an Iranian director and other requisite Iranian personnel, as listed in Annex IV;

(b)　附表Vに掲げる必要な土地及び建物並びにその附帯施設

(b) requisite land and buildings as listed in Annex V as well as incidental facilities required therefor;

(c)　第三条の機械、設備、工具及び資材の補充品、それらの予備部品並びにセンターの維持運営に必要なその他の資材、部品等

(c) replacement of machinery, equipment, tools, and materials referred to in Article III and spare parts thereof and supply of any other materials, parts, components, etc., necessary for the operation and maintenance of the Centre;

(d)　日本人専門家のための家具付きの適当な宿舎及び交通の便宜

(d) suitable furnished accommodations and transportation facilities for the Japanese experts;

(e)　野外実験用の自動車

(e) Motor vehicles for field testing.

(2)　イラン帝国政府は、次のものを負担する。

(2) The Imperial Government of Iran undertakes to meet;

(a)　第三条の物品についてイランにおいて課されることがある関税、内国税その他類似の課徴金

(a) customs duties, internal taxes and other similar charges, if any, imposed in Iran in respect of the articles referred to in Article III;

(b)　第三条の物品のイラン内における輸送並びにそれらの物品の据付け、操作及び維持に必要な経費

(b) expenses necessary for the transportation of the articles referred to in Article III within Iran as well as for the installation, operation and maintenance thereof;

(c)　センターの維持運営に必要なその他の運営費

(c) any other running expenses necessary for the operation and maintenance of the Centre.

第七条
　イラン人理事長は、センターの全般的管理について責任を負い、日本人顧問は、イラン人理事長と協議のうえ、センターの研究及び訓練活動を指導する。

ARTICLE VII
　The Iranian director shall be responsible for overall administration of the Centre, while the Japanese advisor shall guide the research and training activities of the Centre in consultation with the Iranian director.

　日本人顧問は、イラン人理事長と協力して、イランにおける電気通信の開発に関する助言をイランの関係当局に与える。

　The Japanese advisor will give advice on the development of telecommunication in Iran to the Iranian authorities concerned in coordination with the Iranian director.

第八条
　両政府は、センターの運営の成功を確保するため相互に協議を行なう。

ARTICLE VIII
　There shall be mutual consultation between the two Governments for the purpose of securing the successful operation of the Centre.

第九条
　第二条に規定する日本人専門家の役務が供与される期間は、三年をこえないものとする。

ARTICLE IX
　The period in which the services of he Japanese experts referred to in Article II are provided shall not exceed three years.

第十条
(1)　この協定は、それぞれの政府がこの協定の効力発生のための国内法上の要件を満たした旨の他方の政府に対する通告を完了した日に効力を生じ、効力発生の日から四年間効力を有する。

ARTICLE X
(1) This Agreement shall come into force on the date of the last notification by either party to the other that it has complied with the requirements of its internal Laws for the entry into force of this Agreement, and shall remain in force for a period of four years thereof.

(2)　この協定は、相互の合意によりさらに特定の期間延長することができる。

(2) This Agreement may be extended by mutual agreement for a further period.

　千九百七十年八月十六日にテヘランで、英語により本書二通を作成した。

　PRIVILEGES, EXEMPTI0NS AND BENEFITS

(1)　日本人専門家及びその家族用の日本食料品の輸入に対して課される税及び商業利得税の免除。ただし、年間一人当たりの輸入額は、一万リアル(日本国の積出し港におけるFOB価格)を限度とする。

(1) Exemption from payment of the customs duties and commercial profit taxes imposed on the importation of Japanese foodstuff for consumption of the expert and their families up to the amount of 10,000 Rials (FOB price: port of embarkation in Japan) per head and per annum.

(2)　日本人専門家及びその家族に対する医療役務及び便宜の無料供与

(2) Free medical services and facilities for the Japanese experts and their families.
