　Agreement between the Government of Japan and the United Nations Development Programme concerning Assistance for the Establishment and Operation of the Asian Statistical Institute

　The Government of Japan (hereinafter referred to as "the Government") and the United Nations Development Programme (hereinafter referred to as "the UNDP").

　Desiring to assist in the establishment and operation of the Asian Statistical Institute (hereinafter referred to as "the Institute"). which was called for by the United Nations Economic Commission for Asia and the Far East (hereinafter refereed to as "the ECAFE")at its twenty-third session held in Tokyo in April 1967.

　Considering that the UNDP is prepared to provide assistance for that purpose (hereinafter referred to as "the project") at the request of the Governments of Ceylon, China, India, Indonesia, Iran, Japan, Laos, Malaysia, Nepal, Pakistan, Philippines, Republic of Korea, Republic of Vietnam, Singapore, Thailand, United Kingdom (Hong Kong), and Western Samoa, for the purpose of promoting social progress and better standards of life and advancing economic, social and technical development in the ECAFE region,

　Considering that the Government is pre pared to provide facilities for the Institute to be located in Tokyo Japan, and agreed to make the required local cost contribution and fulfill other requirements in relation to the UNDP assistance,

　Have agreed as follows:

Article I Scope of this Agreement

1. This Agreement embodies the basic conditions under which the UNDP and the Government will assist in the execution of the project.

2. A Plan of Operation for the project shall be agreed to in writing by the Government, the Government, the governments of the member countries of the ECAFE, the governments responsible for the conduct of the foreign relations of associate member countries of the ECAFE, the UNDP and the United Nations acting as the Executing Agency (hereinafter referred to as "the Executing Agency"). The terms of this Agreement shall apply to the Plan of Operation.

3. The establishment of the Institute is referred to in the Plan of Operation.

4. The Government and the UNDP hereby agree that the Execution Agency shall participate on behalf of the UNDP as an independent contractor in the execution or administration of the project. The sums referred to in Article II shall be disbursed to the Executing Agency be agreement between the UNDP and the Executing Agency.

5. Any arrangement between the Government and the Executing Agency concerning the execution of the project shall be subject to the provisions of this Agreement and shall require the prior concurrence of the Administrator of the UNDP.

6. Any equipment, materials, supplies and other property belonging to the UNDP or the Executing Agency which may be utilized or provided by either or both in the execution of the project shall remain their property unless and until such time as title thereto may be transferred to the Government on terms and conditions mutually agreed upon between the Government and the UNDP or Execution Agency.

Article II Assistance to be provided by the UNDP

　The UNDP undertakes to made available such sums as may be specified in the Plan of Operation for the execution of the project in accordance with the relevant and applicable resolutions and decisions of the appropriate United Nations organs, in particular, resolutions 1240 (XIII) and 2029 (XX) of the General Assembly, and subject to the availability of funds.

Article III Participation and contribution of the Government in execution of project 

1. The Government shall perform, as the host country to the Institute, all the sets required of it in Articles IV and VIII and in the Plan of Operation.

2. The Government shall participate and co-operate in the execution of the project covered by this Agreement. It shall, in particular, perform all the acts required of it in the Plan of Operation, including the provision of materials, equipment, supplies, labour and professional services available within the country. It assumes the obligation for, and undertakes to provide its contribution under this paragraph and Article IV on the basis of its relevant and applicable laws and regulations and in accordance with its annual budgetary appropriations.

3. the Government shall, as appropriate, display signs at the project site identifying it as one assisted by the UNDP and the Executing Agency.

Article IV Local facilities to be provided by the Government to the UNDP and the Executing Agency 

1. The Government shall assist the UNDP and the Executing Agency in executing the project by paying or arranging to pay for the following local facilities as specified in the Plan of separation, required to fulfill the programme of work:

(a) Local administrative and clerical services, including the necessary local secretarial help, interpreter-translators, and related assistance;

(b) Transportation of personnel, supplies and equipment within the country;

(c) Postage and telecommunications for official purposes;

(d) Local living coat of experts.

2. Moneys paid under the provisions of this Article shall be paid to the UNDP and shall be administered in accordance with the applicable financial regulations of the UNDP.

3. The4 government also undertakes to furnish in kind the following local services and facilities:

(a) The necessary office space and other premises;

(b) Appropriate medical facilities and services for officials and experts of the UNDP, the Executing Agency and the Specialized Agencies of the United Nations engaged in the project.

4. The Government undertakes to provide such assistance as it may be in a position to provide for the purpose of finding suitable housing accommodation for officials and experts referred to in paragraph 3 (b) above.

Article V Information concerning project

1. The Government shall furnish the UNDP with such relevant documents, accounts, records, statements and other information as the UNDP may request concerning the execution of the project or its continued feasibility and soundness, or concerning the compliance by the Government with nay of its responsibilities under this Agreement.

2. The UNDP shall furnish the Government with current information of the progress of operation on the project executed under this Agreement. Either Party shall have the right, at any time, to observe the progress of any operations Carrie out under this Agreement.

3. The Government shall, subsequent to the completion of the project, make available to the UNDP at its request information as to benefits derived from and activities undertaken to further the purposes of the project, and will permit observation by the UNDP for this purpose.

4. The Government will also make available to the Executing Agency all information concerning the project necessary or appropriate to its execution and all information necessary or appropriate to an evaluation, after its completion, of the benefits derived from and activities undertaken to further the purpose of the project.

5. The Parties shall consult each other regarding the publication as appropriate of any information relating to the project or to benefits derived therefrom.

Article VI Relation to assistance from other sources

　In the event that either Party obtains assistance towards the execution of the project from other source, the Parties shall consult each other and the Execution Agency with a view to effective co-ordination and utilization of assistance received from all sources. The obligations of the Government hereunder shall not be modified by any arrangements with other entities co-operating with the Government in the execution of the project.

Article VII Use of Assistance 

　The Government shall exert its best efforts to make the most effective use of the assistance provided by the UNDP and the Executing Agency and shall use such assistance for the purpose for which it is intended. The Government shall take such steps to this end as are specified in the Plan of Operation.

Article VIII Facilities, privileges and immunities 

1. The Government shall apply to the United Nations and its organs, including the UNDP, its property, funds and assets, and to its officials, the provisions of the Convention on the Privileges and Immunities of the United Nations.

2. The Government shall apply to the Specialized Agencies of the United Nations engaged in the project, their property, funds and assets, and to their officials, the provisions of the Convention on the Privileges and Immunities of the Specialized Agencies.

3. The Government shall take any measures which may be necessary to ensure that the UNDP and the Executing Agency and their officials could carry out without interference operations under this Agreement, and to grant them such other facilities as may be necessary for the speedy and efficient execution of the project. It shall, in particular, grant them in accordance with procedures prescribed in the Government's regulations, the following rights and facilities:

(a) The prompt issuance without cost of necessary visas, licences or permits;

(b) Access to the site of work and all necessary rights of way;

(c) Free movement, whether within or to or from the country ,to the extent necessary for proper execution of the project;

(d) The most favourable legal rate of exchange;

(e) Any permits necessary for the importation of equipment, materials and supplies in connection with this Agreement and for their subsequent exportation; and 

(f) Any permits necessary for importation of property belonging to and intended for the personal use of or consumption of officials of the UNDP or of the Executing Agency and for the subsequent exportation of such property.

4. Without prejudice to the provisions of the Conventions on the Privileges and Immunities of the United Nations and the Specialized Agencies, the Government shall take necessary measures to ensure that all participants in the project including holders of project fellowships could exercise their functions in connection with the project.

5. All participants in the project including holders of project fellowships who are not nationals of Japan shall be permitted, on the basis of national laws and regulations, to enter into and exit from Japan and to sojourn there for the period necessary for their training and be granted facilities for speedy travel. Visas, where required, shall be granted promptly and free of charge.

6. The Government shall be responsible for dealing with any claims which may be brought by third parties against the UNDP or the Executing Agency, or against the personnel of either, and shall hold the UNDP, the Executing Agency and the above -mentioned persons harmless in case of any claims or liabilities resulting from operations under this Agreement, except where it is agreed by the Parties hereto and the Executing Agency that such claims or liabilities arise from the gross negligence or wilful misconduct of such persons.

Article IX Settlement of disputes 

　Any dispute between the Government and the UNDP arising out of or relating to this Agreement which cannot be settled by negotiation or other agreed mode of settlement shall be submitted to arbitration at the request of either Party. Each Party shall appoint one arbitrator, and the two arbitrators so appointed shall appoint the third, who shall be the chairman. If within thirty days of the request for arbitration either Party has not appointed an arbitrator or if within fifteen days of the appointment of two arbitrators the third arbitrator has not been appointed, either Party any request the President of the International Court of Justice to appoint an arbitrator .The procedure of the arbitration shall be fixed by the arbitrators, and the expenses of the arbitration shall be borne by the Parties as assessed by the arbitrators. The arbitral award shall contain a statement of the reasons on which it is based and shall be accepted by the Parties as the final adjudication of the dispute.

Article X General Provisions

1. This Agreement shall enter into force on the date on which the Administrator of the UNDP receives from the Government a Note indicating its acceptance of this Agreement, and shall continue in force until terminated under paragraph 3 below.

2. Any relevant matter for which no provision is made in this Agreement shall be settled by the Parties in keeping with the relevant resolutions and decisions of the appropriate organs of the United Nations. Each Party shall give full and sympathetic consideration to any proposal by the other Party under this paragraph.

3. This Agreement may be terminated by either Party by written notice to the other and shall terminate sixty days after receipt of such notice.

4. The obligations assumed by the Parties under Article V and Article VII shall survive the termination of this Agreement. The obligations assumed by the Government under Article VIII hereof shall survive the termination of this Agreement to the extent necessary to permit orderly withdrawal of personnel, funds and property of the UNDP and of the Executing Agency, and all participants in the project including holders of project fellowships.

　IN WITNESS WHEREOF the undersigned, duly appointed representatives of the Government of Japan and of the United Nations Development Programme, respectively, have on behalf of the Parties signed the present Agreement at New York this 9th day of September 1969.

　Sir,With reference to the Agreement between the Government of Japan and the United Nations Development Programme concerning Assistance for Establishment and Operation of the Asian Statistical Institute signed today, I have the honour to inform you of the following:

1. With regard to Article VIII, paragraphs 1 and 2, these paragraphs are understood to apply "in regard to the execution of the project".

2. With regard to Article VIII, paragraph 6:

(a) The claims referred to in the phrase "The Government shall be responsible for dealing with any claims which may be brought by third parties against the UNDP or the Executing Agency, or against the personnel of either ,..............." are to be understood as meaning claims resulting from operations under this Agreement.

(b) It is further understood that the responsibility for dealing with such claims will not be interpreted as placing the obligation on the Government of Japan to become a party, or to act on behalf of a party, in litigation. However, the Government of Japan will make other arrangements to provide necessary legal services to the UNDP, the Executing Agency of their personnel. 

(c) The expression "operations under this Agreement " means the "acts done by the United Nations Development Programme, the Executing Agency or the personnel of either in the course of, or directly connected with, the performance of their mission".

3. The Government of Japan is willing to consider entering in due course into a basic Agreement, which, upon its entry into force will supersede the Agreement signed today.

　With regard to Article VIII , paragraph 3 (d), the basic rate of exchange of the Japanese currency is, according to the regulations of Japan, unitary for all kinds of transactions, but the actual rate of buying and/or selling may fluctuate within a narrow range around the basic rate.　For example, the basic rate for one U.S. dollar is 360 yen. Around this basic rate, the authorized Foreign Exchange Banks are allowed to decide the actual commercial buying and/or selling rate within a certain range. To illustrate, the T.T. rate for one U.S. dollar is between 362.70 yen and 357.80 yen.

　PREAMBLE

　For the purpose of executing the project for the Asian Statistical Institute, (hereinafter referred to as the "Institute") to be undertaken Indonesia, Iran, Japan, Laos, Malaysia, Nepal, New Zealand, Pakistan, Philippines, Republic of Korea, Republic of Vietnam, Singapore, Thailand, United Kingdom (Hong Kong), Western Samoa, (hereinafter referred to as the "Governments"), in co-operation with the united Nations Development Programme (Special Fund)(hereinafter referred to as the "UNDP"), for which the United Nations (hereinafter referred to as the "Executing Agency"), in association with the United Nations Educational, Scientific and Cultural Organization (UNESCO) and the Food and Agriculture Organization of the United Nations Development Programme concerning Assistance for the Establishment and Operation of the Asian Statistical Institute signed in New York on 9 September 1969 and in such agreements as the other Governments may have entered into with the UNDP concerning assistance from the UNDP as follows:

I OBJECTIVES OF THE PROJECT

1. The purpose of the project, the duration of which is five and one half years, is to provide training of professional statisticians for government service, research and related activities, as recommended by the Resolution 75 (XXIII) of the United Nations Economic Commission for Asia and the Far East (Hereinafter referred to as "the FCAFE"), for member and associate member countries within the geographical scope of the ECAFE.

2. The Institute will be established in Tokyo, Japan by the Governments in conformity with the said resolution.

II ORGANIZATION OF THE PROJECT 

A. General Responsibilities

3. The Governments, the UNDP and the Executing Agency shall jointly be responsible for the execution of the project and the realization of its objectives as described in Article I above.

4. The Government of Japan shall, on the basis of its relevant and applicable laws and regulations and in accordance with its annual budgetary appropriations, provide land and buildings, including hostel facilities, equipment, and services of a Project Co-Manage and national project personnel for the Institute. The co-operation Agency of the Government of Japan will be the administrative Management Agency. Prime Minister's Office (hereinafter referred to as "the Co-operating Agency"). The C0-operating Agency will be mainly responsible. for the implementation of the contribution of the Government of Japan.

5. The UNDP undertakes to complement and supplement the Governments' participation and will provide through the Executing Agency, to required expert services, training equipment and other services within the funds available to the project.

6. Upon commencement of the project the Executing Agency shall assure primary responsibility for the project execution. However that primary responsibility shall be exercised in consultation with the Co-operating Agency. Arrangements shall be concluded thereafter, as expressed in the Work Plan (Appendix I). for a progressive transfer of the primary responsibility to the Governments. Upon completion of the project, the UNDP expects the Institute to be continued by the Governments.

7. The Governments' participation may take the form of a cash contribution to the UNDP. In such case, the Executing Agency will provide the related services and facilities and will account annually to the UNDP and to the Governments for the expenditure incurred.

B. Participation of the Governments

8. The services and facilities specified in the Work Plan (Appendix I) which are to be provided to the project by the Governments by means of a contribution in cash ($117,733) are set forth in the Project Budget (Appendix II B) Payment of this amount shall be made in local currency to the UNDP in accordance with the Schedule of Payments by the Governments (Appendix IV).

9. As a contribution towards the local costs of thew project, the Governments shall pay to the UNDP the local currency equivalent of the amounts indicated in the Schedule of Payments by the Governments (Appendix IV). This contribution shall be deemed to fulfill the Governments' obligations to pay for the local costs specified in the agreements referred to in the Preamble to this Plan of Operation, except for the contribution in kind of the government of Japan specified in Appendix IIA of this Plan of Operation. The total of this contribution listed in U.S. dollars (%213,000) shall represent approximately 15 per cent of the total estimated cost to the UNDP of internationally recruited project personnel.

10. Payment of the above-mentioned contributions to the UNDP on or before the3 dates specified in the Schedule of Payments by the Governments (Appendix IV) is a prerequisite to commencement or continuation of project operations.

11. The Governments will, at the end of three years of this project, examine into the ways to continue and finance the Institute after completion of the project, taking due consideration of the expectation of the UNDP that the Institute will be continued by the Governments upon completion of project.

12. The Government of Japan shall, on basis of its relevant and applicable laws and regulations and in accordance with its annual budgetary appropriations, provide to the project the revises, fellowships, equipment and facilities in the quantities and at the times specified in the work Plan (Appendix I) of this Plan of Operation. Budgetary provision - either in kind or in cash - for the participation of the Government of Japan so specified is set forth in the Project Budgets for the Governments contribution (Appendices II.A and IV).

13. The Co-operating Agency shall in consultation with the Executing Agency assign a Project Co-Manager to the Project on a full time basis. He shall carry out such responsibilities in th3 project as are assigned to him by the Co-operating Agency 

14. The estimated cost of items included in the Contribution of the government of Japan as detailed in Appendix II of this Plan of Operation, are based on the best information available at the time of drafting this Plan of Operation. It is understood that price fluctuations during the period of execution of the project may necessitate and adjustment of said contribution in monetary terms; the latter shall at all times be determined by the value of the services, equipment and facilities required for the proper execution of the project.

15. Within the given number of man-months of personnel services descried in the Work Plan (Appendix I, part D) minor adjustments of individual assignments of project personnel provided by the Government of Japan may be made by the Government of Japan in consultation with the Executing Agency, if this is found to be in the best interests of the project.

16. The Government of Japan shall, on the basis of its relevant and applicable laws and regulations defray, if necessary, customs duties and other charges related to the clearance of project equipment, its transportation, handling, storage and related expenses within the country, and shall be responsible for safe custody of the equipment, its installation, maintenance, and replacement after delivery to the project site.

17. The Government of Japan shall assist officials and experts of the UNDP, the Executing Agency and the Specialized Agencies of the United Nations engaged in the project in finding suitable housing accommodation at reasonable rents.

C. Participation of the UNDP and of the Executing Agency

18. The UNDP shall provide to the project through the Executing Agency the services, equipment and facilities described in the Work Plan (Appendix I) of this Plan of Operation. Budgetary provision for the UNDP contribution so specified is set forth in the Project Budget for the UNDP contribution (Appendix III)

19. The Executing Agency. In consultation with th4e Governments shall assign a Project Manager who under the direction of the Executing Agency will be responsible for the Executing Agency's participation in the project. The Project Manager shall supervise the inter national experts assigned to the project. He shall be responsible for the control of all equipment provided to the project from UNDP funds.

20. The Executing Agency, in consultation with the Governments, shall assign experts and other personnel to the project as provided for in the work Plan (Appendix I); select candidates for fellowships provided by the UNDP.

21. If it is considered to be in the best interest of the project the Executing Agency, in consultation with the Governments may make minor adjustments within:

(a) The number of man-months of expert services described in the Work Plan (Appendix I);

(b) the number of man-months of fellowships described in the Work Plan (Appendix I)

(c) the provision for material, equipment and supplies from UNDP resources.

22. Fellowships provided by the UNDP shall be administered in accordance with the Fellowships regulations of the Executing/agency.

23. All material equipment and supplies which are purchased from UNDP resources will be used exclusively for the execution of the project, and will remain the property of the UNDP in whose name it is held by the Executing Agency Equipment supplied by the UNDP shall be marked with the insignia of the UNDP and of the Executing Agency.

24. Arrangement may be made, if necessary, for a temporary transfer of custody of equipment, to locate authorities during the life time of the project, without prejudice to the final transfer 

25. Prior to completion of UNDP assistance to the project, the Governments, the UNDP and the Executing Agency shall consult as to the disposition of all Project equipment provided by the UNDP. Title to such equipment shall normally be transferred to the Institute or to another entity nominated by the Governments, when it is required for continued operation of the project or for activities following directly therefrom. The UNDP may, however, at its discretion retain title to part or all of such equipment.

26. At an agreed time after the completion of UNDP assistance to the project, the Governments and the UNDP and/or the Executing Agency shall review the activities continuing from or consequent upon the project with a view to evaluating its results.

D. Facilities, Privileges and Immunities.

27. In accordance with the Agreements concluded by the UNDP and the Governments, referred to in the Preamble to this Plan of Operation, the personnel of the UNDP and of the Executing Agency and of other United Nations organizations associated with this project, shall be accorded facilities, privileges and immunities specified in the said Agreements.

28. The executing agency shall provide the host Government through the Resident Representative with the list of personnel to whom the privileges and immunities referred to in paragraph 27 of this Article shall apply.

III REPORTS

29. On 30 June and 31 December each year the Project Manager/Director of the Institute shall submit a report to the Institute shall submit a report to the Executing Agency on the work carried out by the Institute during the preceding six months.

30. In the course of project operations, the Executing Agency shall submit reports on particular components and /or subject areas of the project, to the Governments and UNDP.

31. The Governments and the Executing Agency shall, as appropriate, submit to the UNDP a joint inventory of project equipment purchased from the UNDP contribution and for which title remains with the UNDP.

32. Upon completion of project fieldwork the Executing Agency will submit a terminal statement assessing Project results, and setting forth its concluding and recommendations. The UNDP will transmit this statement and its own views thereon to the Governments for appropriate follow-up action.

33. The Governments shall, within three months of receiving the Executing Agency's terminal statement, communicate their views to the UNDP on project results and shall indicate the steps envisaged or under way to implement the recommendation arising from the project.

IV REVIEW AND REVISION OF THE PLAN OF OPERATOIN

34. The Governments, the UNDP and the Executing Agency may make joint decisions at any time during the normal course of project operations which affect the Word Plan or Project Budgets and agree to modifications required in the Plan of Operation. Provided they are within the scope and intent of the project.

35. Where so indicated in the Work Plan and without prejudice to any other periodic reviews, the Governments, the UNDP and Executing Agency shall undertake a mid - project review of the Plan of Operation for the following purposes:

a. To review the design and objectives of the project in order to ensure their continuing efficacy and if necessary to agree on modifications thereof:

b. To assess progress towards the attainment of project objectives;

c. To identify problem areas, if any, impeding the execution of the project with a view to reaching joint agreement on indicated solutions; and

d. To agree on revisions, as necessary, of the Work Plan and Project Budgets.

36. All agreed modifications to either the text or the Appendices shall be reflected in adjustments or Amendments to this Plan of Operation which shall be prepared by the Executing Agency

APPENDIX I WORK PLAN

A. Description of Project 

　The Asian Statistical Institute will be located in Tokyo, Japan. The Institute will provide the following:

(a) A general training course for professional statisticians for Government service, with a capacity of thirty trainees, which would last for one academic year (ten months from May 1970).*1 The course will comprise a compulsory and an optional part: the compulsory part to consist of and introductory course in mathematics and economics, statistical methods, statistical operations and statistical systems and organization: the optional part to enable participants to specialize in selected areas of applied statistics;

(b) An advanced course of training for statisticians of senior standing, in specialized fields of statistics, for about four to six weeks;

(c) Advanced seminars and applied courses in specific subjects, for statisticians of senior standing in the countries, for about four to eight weeks;

(d) Facilities for preparation of manuals and other training expositions required for teaching;

(e) Facilities for research by the teaching staff of the Institute, in co-operation with the ECAFE secretariat;

(f) Facilities for officers and research workers deputed from the countries to carry out special studies and research of and applied nature; and 

(g) Assistance in the organization and improvement of facilities for statistical education and training at all levels in the national and sub-regional centres.

　Candidates will be selected from members and associate members of countries within the geographical scope of ECAFE. Participants from the developed countries in the region may also be admitted to the courses to the extent that the facilities of the Institute allow. In their case, the full cost is to be borne by the countries concerned.

　The language of instruction shall be English at the Institute in Tokyo, Should seminars or courses be organized in countries other the Japan, languages other than English can be considered.

　*1 Subject to entry into force of the Agreement between the Government of Japan and the United Nations Development Programme concerning Assistance for the Establishment and Operation of the Asian Statistical Institute.

B. Schedule of Operations

1. The Executing Agency shall commence execution of the project upon receipt of written authorization from the UNDP.

2. Following a period of pre-operational activities on the part of governments and Executing Agency personnel, field operations on the project are planned to commence November 1969 and to continue on the project until approximately March 1975.

　Brief Description of Work Programme, including Planned Timing of Major Operations is as follows:

1969 Preparation of advises to countries concerning the course; letters, brochures, application forms etc., to be sent to countries during Fourth Quarter of 1969.

　Planning of course in detail, determining teaching responsibilities and schedules, planning student selection procedures, determining Institute rules and regulations to ensure the satisfactory provision of the physical needs of the Institute and hostel.

1970 Countries to submit their nominations for the first general (10 - month) course of the Institute by the end of February 1970.

　Detailed planning of courses and preparation of lecture notes by the lecturers.

　Nominations to be considered by the Project Manager/Director so as to complete any inquiries or tests required in order that selections may be made during March 1970. Countries to be notified of selection and of arrangements for trainees to proceed to Tokyo.

　Appointment of trainees for the first general course to arrive in Tokyo in time to commence training in May 1970

1) Trainees to completes training in the first general course at the end of February 1971;

2) Advanced courses in specialized subjects to be held in Tokyo over 4 - 6 weeks at an appropriate time.

3) A seminar or seminars to be held in countries of the region in accordance with their needs, over a period of 4 - 8 weeks, at appropriate times.

After 1970 The teaching cycle and other concurrent research activities are to follow a pattern similar in general outline to that proposed for 1969 - 1970. However, the detailed work programme after 1970 shall be determined by the Project Manager/Director in consultation with the Advisory Council.

　An evaluation of the project will be carried out after two years of project operations, i. e., around the middle of 1972. Any provisions beyond that date are subject to change depending on the outcome of said evaluation.

C. Special Provisions 

　The Institute will be established by the Governments as an autonomous institution under the aegis of ECAFE, guided by an Advisory Council of eleven members. The administrative arrangements for the Institute will be as follows:

(a) Advisory Council: The Advisory Council, which will have the responsibilities of advising on the programmes and working of the Institute, will be composed of the following members;

i) The Executive Secretary of ECAFE as Chairman ex-officio;

ii) The Chief of the Statistics Division of ECAFE as an ex-officio member;

iii) A representative of the host government, namely the Government of Japan;

iv) Five members of recognized professional standing from the member and associate member countries (other than Japan) in the ECAFE region who would be elected by the United Nations Economic Commission for Asia and the Far East. In electing the members, care should be taken to ensure equitable geographical representation. These members would be elected for a term of three years and be eligible for re-election.

v) The Project Manager/Director of the Institute (referred to in (b) below) as ex-officio member and Secretary of the Advisory Council, participating in its deliberations without vote.

vi) A representative of UNESCO as ex-officio member.

vii) A representative of FAO as ex-officio member.

　The Advisory Council will meet once a year or when necessary, more often during the period of the project. The Chairman would invite representatives of the United Nations, and the other related Specialized Agencies and of the Asian Institute for Economic Development and Planning and non-governmental organizations in statistical education to participate in a consultative capacity in dealing with matters of common concern. 

(b) Project Manager/Director of the Institute  The Project Manager/Director will be responsible to the Executing Agency for execution of the project in accordance with the plan of Operation. He will also be in charge of administration of the Institute in accordance with the guidance of the Advisory Council, and will submit a general repot each year to the annual session of ECAFE for its consideration and such action as may be necessary to promote the objectives and the work of the Institute. In the project Manager/Director's absence, the Deputy Director appointed by the United Nations shall act on his behalf.

(c) Executing Agency: The United Nations will serve as the Executing Agency for the United Nations Development Programme (Special Fund); within the United Nations, ECAFE will carry out the substantive and other responsibilities of the Executing Agency, in consultation with the Statistical Office of the United Nations, FAO, UNESOO, and the other Specialized Agencies. FAO and UNESCO will also be consulted concerning lecturers in their fields and will have responsibility directly with the Project Manager/Director in organizing seminars in their areas of statistical responsibility. Similar arrangements are envisaged with other interested specialized agencies.

(d) Participation and contributions of participating Governments: The contributions from participating Governments may be found in Appendix IV.

　In the event that a seminar is to be held outside Japan, the project Manager/Director of the Institute shall, in consultation with the host Government, prepare a detailed budget of the local expenses for any such seminar within a host country shall be in addition to that Government's cash contribution towards the local costs of the project. There expenses shall include salaries of the local staff, living and other expenses of the trainees and office overhead.
