ペルーの商業上の債務の弁済期限延長に関する日本国政府とペルー共和国政府との間の交換公文

　Tokyo, December 22,1970

　書簡をもつて啓上いたします。本大臣は、ペルーの政府及び政府企業が負担する商業上の債務の弁済期限の繰延べに関し、千九百六十九年十一月十八日及び十九日にブラッセルで開催されたペルー共和国政府と関係債権諸国政府との間の協議の議事録を基礎として日本国政府の代表者とペルー共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。

　Excellency, I have the honour to confirm the following understanding reached between the representatives of the Government of Japan and the Government of the Republic of Peru on the basis of the "Proces Verbal' of the consultations between the Government of the Republic of Peru and the Governments of the creditor countries concerned held at Brussels on the 18th and 19th of November 1969 concerning the rescheduling of repayment period of the commercial debts owed by the Government and governmental corporations of Peru.

1(a)　一方において日本国の居住者である債権者と他方においてペルーの政府又は政府企業との間で千九百六十九年十月一日前に契約され千九百七十年一月一日から千九百七十一年十二月三十一日までの間に弁済期限が到来する商業上の債務で、現在ペルーの政府及び政府企業が負担しており、かつ、日本国政府が保険を引き受けた債務であつて、原契約による弁済期限が一年をこえるが十五年をこえないもののうちこの書簡の日付の日において弁済の行なわれていない商業上の債務の元金の七十五パーセントに相当する額に関し、ペルー政府は、ペルー経済財政省がペルーの法令に基づきこれらの元金を自己の債務として引き受けることを確保する。

1.(a) With respect to the amount equivalent to seventy five per cent (75%) of the principals of the commercial debts presently owed by the Government and governmental corporations of Peru and insured by the Government of Japan, outstanding at the date of the present note and with an original repayment period exceeding one year, but not exceeding fifteen years originally contracted between the creditors resident in Japan on the one hand and the Government or governmental corporations of Peru on the other hand before October 1, 1969 and falling due between January 1, 1970 and December 31, 1971 both dates inclusive, the Government of Peru shall ensure that the Ministry of Economy and Finance of Peru duly assume such amounts as its own debts under the laws and regulations of Peru.

(b)　ペルー政府は、さらに、ペルー経済財政省が日本国に居住する債権者に対し、同省が引き受ける商業上の債務の弁済期限を(d)(i)及び(ii)に掲げる弁済計画に従つて延長することを要請することを確保する。

(b) The Government of Peru shall also ensure that the Ministry of Economy and Finance of Peru request the creditors resident in Japan to extend, in accordance with the repayment scheme set out in sub-paragraphs 1 (d) (I) and (ii) below, the repayment period of the commercial debts to be assumed by the Ministry of Economy and Finance of Peru.

(c)　日本国政府は、(a)の商業上の債務に関し、(d)(i)及び(ii)に掲げる弁済計画に従い、日本国に居住する積権者が弁済期限の延長に関するペルー経済財政省の要請に応ずることを容易にするため、日本国において施行されている法令の範囲内で可能な措置をとる。

(c) The Government of Japan will take possible measures, within the scope of the laws and regulations in force in Japan, to facilitate the creditors resident in Japan in complying with the request of the Ministry of Economy and Finance of Peru, for the extension of the repayment period, according to the repayment scheme set out in sub-paragraphs (d) (i) and (ii) below, with respect to the commercial debts mentioned in sub-paragraph (a) above.

(d)(i)　ペルー経済財政省によつて引き受けられる元金であつてその弁済期限が繰り延べられるものの総額は、八百七十七万四百九十八合衆国ドル五十九セント(八、七七〇、四九八合衆国ドル五九セント)と見積もられている。

(d)(i) The total amount of the principals to be assumed by the Ministry of Economy and Finance of Peru, the repayment period of which is rescheduled, is estimated to be eight million seven hundred seventy thousand four hundred and ninety eight United States dollars and fifty nine cents (U.S.$8,770, 498.59).

(ii)　(d)(i)の額は、次の計画に従つて弁済されることになる。

(ii) The amount mentioned in the preceding sub-paragraph (d) (i) will be repaid in accordance with the following scheme:

　千九百七十年に弁済期限が到来する商業上の債務

　for the commercial debts falling due in 1970,

　千九召七十二年において十パーセント

　10% in 1972

　千九百七十三年において二十パーセント

　20% in 1973

　千九百七十四年において三十五パーセント

　35% in 1974

　千九百七十五年において三十五パーセント

　35% in 1975

　千九百七十一年に弁済期限が到来する商業上の債務

　for the commercial debts falling due in 1971,

　千九百七十三年において十パーセント

　10% in 1973

　千九百七十四年において二十パーセント

　20% in 1974

　千九百七十五年において三十五パーセント

　35% in 1975

　千九百七十六年において三十五パーセント

　35% in 1976

　弁済は、各年の六月及び十二月の末日に行なわれる。

　The repayment will be made on the last day of June and December of each year.

2(a)　ペルー経済財政省は、関係債権者に対し、元金の弁済期限の延長から生する延滞利子を四半期ごとに各年の一月、四月、七月及び十月の初日に支払う。ただし、延滞利子の第一回の支払は、この書簡の日付の日から一週間以内に行なわれる。

2. (a) The Ministry of Economy and Finance of Peru will pay to the creditors concerned moratorium interest accruing from the extension of the repayment period of principals quarter-annually on the first day of January, April, July and October of each year, provided that the first payment of such interest will be made within one week from the date of this Note.

(b)　弁済期限の延長から生ずる利子の率は、原契約において異なる利子率が定められている場合又は別段の合意がなされる場合を除くほか、年八パーセントとする。

(b) The rate of interest accruing from the extension of the repayment period will be eight per cent (8%) per annum, except in cases where different rates of moratorium interest are provided for in the original contracts or otherwise agreed to.

3　ペルー政府は、前記の繰延べ計画に従つて弁済期限が延長される商業上の債務に関し、すべての元金の弁済及び利子の支払が原契約によつて指定された通貨で行なわれることを確保する。

3. The Government of Peru shall ensure that all repayment of principal and payment of interest, in respect of the commercial debts, the repayment Period of which is extended in accordance with the above-mentioned rescheduling, shall be made in the currency which was designated in the original contracts.

4　ペルー経済財政省が引き受ける商業上の債務に関し、ここに取り扱われている事項以外の事項については、1(a)の日本国の居住者である債権者とペルー経済財政省との間で合意するところによる。弁済期限の延長に伴つて生ずる銀行手数料は、ペルー経済財政省によつて負担される。

4. With respect to the principal of the commercial debts to be assumed by the Ministry of Economy and Finance of Peru, matters other than those dealt with herein shall be as agreed upon between the creditors resident in Japan mentioned in sub-paragraph 1 (a) above and the Ministry of Economy and Finance of Peru. Bank charges incidental to the extension of the repayment period shall be borne by the Ministry of Economy and Finance of Peru.

5　ペルー政府は、1(a)の商業上の債務の基因となつた原契約の条件のうちこの書簡に特に言及されていないものは、引き続き変更されないことを確認する。

5. The Government of Peru hereby confirms that the terms and conditions not specifically referred to in this Note, of the original contracts under which the commercial debts mentioned in sub-paragraph 1 (a) above were incurred, shall remain unchanged.

6　日本国政府は、千九百七十二年に弁済期限が到来するペルーの商業上の債務の処理に関して取決めを行なう可能性につき適当な時期にペルー政府とともに検討する用意がある。

6. The Government of Japan is prepared to examine at an appropriate time, with the Government of Peru, the possibility of making arrangements concerning the settlement of Peruvian commercial debts falling due in 1972.

　本大臣は、閣下がペルー共和国政府に代わつて前記の了解を確認されれば幸いであります。

　I should be grateful if Your Excellency would confirm the foregoing understanding on behalf of the Government of the Republic of Peru.
