日本青年海外協力隊の派遣に関する日本国政府とネパール政府との間の交換公文 
(日本側書簡)

(Japanese Note) 


　

　Kathmandu, February 2,1970


　書簡をもつて啓上いたします。本使は、両国間の技術協力を促進するため日本青年海外協力隊(以下「協力隊」という。)をネパールに派遣することに関し、日本国政府の代表とネパール政府との間でカトマンズにおいて行なわれた最近の討議に言及するとともに、これらの代表の間で到達した次の了解を日本国政府に代わつて確認する光栄を有します。

　Excellency:I have the honour to refer to the recent discussions held in Kathmandu between the representatives of the Government of Japan and His Majesty's Government of Nepal concerning the dispatch of Japan Overseas Cooperation Volunteers (hereinafter referred to as "the Volunteers ") to Nepal with a view to promoting technical co-operation between the two countries and to confirm on beh8lf of the Government of Japan the following understandings reached between them:


1　日本国政府は、ネパール政府の要請に基づき、日本国の現行法令に従い、ネパールの社会的及び経済的開発に寄与するため、両政府間で別個に合意される計画に従つて協力隊を派遣する。

1. At the request of His Majesty's Government of Nepal, and in accordance with the laws and regulations in force in Japan, the Government of Japan will dispatch the Volunteers for the purpose of contributing to the social and economic development of Nepal, according to the schedule to be separately agreed upon by the two Governments.


2　日本国政府は、予算措置がとられることを条件として、協力隊の隊員の日本国とネパールとの間の渡航費及びネパールにおける生活手当を負担し、並びに協力隊の隊員の任務の遂行に必要な機械、器具、材料及び医薬品を供与する。

2. The Government of Japan will, subject to budgetary appropriations, bear the cost of international travel between Japan and Nepal and living allowances in Nepal for the member of Volunteers and make available such equipment, machinery, materials and medical supplies as necessary for the performance of their functions.


3　ネパール政府は、協力隊の隊員に対し、次の特権、免除及び利益を与える。

3. His Majesty's Government of Nepal will grant the members of the Volunteers the following privileges, exemptions and benefits:


(1)　2に掲げる機械、器具、材料及び医薬品並びに協力隊の隊員の身回品及び家庭用品の輸入に対し又はこれに関連して課される関税その他すべての種類の課徴金の免除

(1) The exemption from customs duties and charges of any kind imposed on or in connection with the import at ion of the equipment machinery, materials and medical supplies mentioned in 2. above as well as personal and household effects of the members of the Volunteers.


(2)　2に掲げる生活手当等協力隊の隊員に海外から送付される給与に対し又はこれに関連して課される所得税その他すべての種類の課徴金の免除

(2) The exempt ion from income tax and charges of any kind imposed on or in connection with any allowances to be remitted from overseas for the members of the Volunteers such as the living allowances mentioned in 2 above


(3)　ネパール政府の公務員に提供されるものと同様の医療便宜

(3) Medical facilities equivalent to those extended to Civil Servants of His Majesty's Government of Nepal.


(4)　状況に応じた適当な住居施設の提供。これに関する細目取極は、1の計画に規定する。

(4) Provision of such appropriate housing accommodations as circumstances permit, the detailed arrangement of which will be defined in the schedule mentioned in 1. above.


4(1)　ネパール政府は、ネパールにおける協力隊の活動に関連して日本国政府が与える任務を遂行するための協力隊の駐在員一人及び調整員二人以上を受け入れる。

4.(1) His Majesty's Government of Nepal will accept a Representative and/or Coordinators of the Volunteers who will discharge the functions to be assigned to them by the Government of Japan relative to the activities of the Volunteers in Nepal.


(2)　駐在員及び調整員は、その任務の遂行に必要な器具及び材料並びにその身回品及び家庭用品の輸入に対し又はこれに関連して課される関税その他すべての種類の課徴金を免除される。駐在員及び調整員は、また、一人につき一台の自動車を無税で輸人すること(又はネパールにおける保税倉庫から購入すること)を認められる。

(2) The Representative and the Co-ordinators will be exempted from the payment of customs duties and charges of any kind imposed on or in connection with the importation of equipment and materials necessary for the performance of their functions as well as the personal and household effects. The Representative and the Co-ordinators will also be allowed duty-free importation (or purchase from bond in Nepal) of one motorcar each.


(3)　駐在員及び調整員は、海外から送付される給与に対し又はこれに関連して課される所得税その他すべての種類の課徴金を免除される。

(3) The Representative and the Co-ordinators will be exempted from p8yment of income tax and charges of any kind imposed on or in connection with any allowances to be remitted from overseas.


5　両政府は、協力隊派遣計画の実施を成功させるため、随時協議する。

5. The two Governments shall enter into consultation, from time to time, for the successful implementation of the dispatch programme the Volunteers.


　本使は、さらに、前記の了解がネパール政府にとつて受諾しうるものであるときは、この書簡及びこの書簡に同意される閣下の返簡が両政府間の合意を構成するものとすることを提案する光栄を有します。

　I have further the honour to propose that, the foregoing understandings are acceptable to His Majesty's Government of Nepal, is Note and your reply Note concurring therein shall constitute an agreement between the two Governments.


　本使は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

　I avail myself of this opportunity to renew to you the assurance of my highest consideration.

　書簡をもつて啓上いたします。本大臣は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。

　Excellency: I have the honour to acknowledge receipt of Your Excellency's Note of today's date which reads as follows:

　本大臣は、さらに、閣下の書簡に述べられている了解をネパール政府に代わつて確認し、かつ、閣下の書簡及びこの返簡が両政府間の合意を構成するものとすることに同意する光栄を有します。

　I have further the honour to confirm the understandings set forth in Your Excellency Note on behalf of His Majesty's Government of Nepal and to agree that Your Excellency' Note and this reply Note shall constitute a agreement between the two Governments.


　本大臣は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

　I avail myself of this opportunity to renew to Your Excellency the assurance of my highest consideration.
