稲作機械化訓練計画に関する日本国政府とマレイシア政府との間の協定
Agreement between the Government of Japan and the Government of Malaysia concerning the Paddy Mechanization Training Project
日本国政府及びマレイシア政府は、両国間の経済及び技術協力を推進し、これにより両国間に存在する友好関係を一層強化することを希望して、次のとおり協定した。
The Government of Japan and the Government of Malaysia, desiring to advance the economy and technical co-operation between the two countries and thereby to strengthen further he friendly relations existing between the two countries, have agreed as follows:
第一条 (1) 日本国政府及びマレイシア政府は、稲の二期作のために必要な機械化を推進するため、ウェルズレイ地方のブンボンリマの農業学校(以下「学校」という。)において稲作機械化訓練計画(以下「計画」という。)を共同して実施する。
Article I (1) For the purpose of promoting mechanization necessary for paddy double cropping, the Government of Japan and t he Government of Malaysia shall jointly carry out the Paddy Mechanization Training Project (hereinafter referred to as "the Project") at the School of Agriculture at Bumbong Lima, Province Wellesley (hereinafter referred to as "the School").
(2) 計画は、次の各項から成る。
(2) The Project shall cover the following:
(a) 附表Iに掲げる科目についてマレイシア農業普及員の現職研修及び学校の学生の訓練
(a) in-service training of Malaysia Junior Agricultural Assistants (JAA) and training of students in the School in the subjects listed in Annex I;
(b) 農業・土地省農業局が選定するマレイシア農民に対する稲作機械化訓練
(b) paddy mechanization training of Malaysian farmers selected therefor by the Division of Agriculture of the Ministry of Agriculture and Lands;
(c) 前記の訓練のために及びそれに関連して必要な農業研究及び調査
(c) agricultural investigation and survey necessary for and related to the above training.
第二条 日本国政府は、日本国において施行されている法令に従い、次のものを自己の負担において供与するため必要な措置をとる。
Article II In accordance with laws and regulations in force in Japan, the Government of Japan shall take necessary measures to provide at its own expense:
(1) 附表IIに掲げる日本人専門家の役務
(1) The service of Japanese experts as listed in Annex II;
(2) 附表IIIに掲げる資材、設備及び機械並びに計画に必要な部品及び補充品
(2) The material, equipment and machinery as listed in Annex III, together with spare parts and replacements which are required for the Project;
(3) 計画と関連を有するマレイシア人技術者の日本国における技術訓練。ただし、コロンボ計画技術協力計画に基づく通常の手続を通するものとする。
(3) Technical training in Japan for Malaysian technicians in connection with the Project through normal Procedures under the Colombo Plan Technical co-operation Scheme.
第三条 (1) 第二条(2)に規定する物品は、最新の科学及び技術によつて開発され、かつ、マレイシアにおける稲作機械化に適合するものとする。
Article III (1) The articles referred to in Article II (2) shall represent the latest scientific and technical development and be suitable for paddy mechanization in Malaysia.
(2) 第二条(2)に規定する物品は、ペナン港においてc・i・f建てでマレイシア政府の関係当局に引き渡された時にマレイシア政府の財産となり、かつ、計画のためにのみ使用される。
(2) The articles referred to in Article II (2) shall become the property of the Government of Malaysia upon being delivered c. i .f. at the Port of Penang to the authorities concerned of the Government of Malaysia, and shall be utilized exclusively for the Project.
第四条 (1) マレイシア政府は、マレイシアにおいて施行されている法令に従い、次のものを自己の負担において提供するため必要な措置をとる。
Articlel V (1) In accordance with laws and regulations in force in Malaysia, the Government of Malaysia shall take necessary measures to provide at its own expense:
(a) 附表IVに掲げる所要のマレイシア人職員(これらの職員は、各自の職務と兼務で、計画の実施のために必要な職務を遂行する。)
(a) requisite Malaysian staff as listed in Annex IV who shall, in common with their respective duties, carry out the requisite services pertaining to the implementation of the Project;
(b) 学校の土地、建物及び附帯施設(これらは、計画の実施に適当かつ必要な限りにおいて、通常の用途の一環として、使用に供される。)。特に、事務所、修理作業所、機械作業所、機械及び設備の倉庫、薬品、肥料及び種子の貯蔵庫、寄宿舎並びに車庫を含む。
(b) the land and buildings of the School and the facilities therein which shall be available, as part of their normal uses ) for appropriate and necessary use for the implementation of the Project; and, in particular, the facilities of: the office; repair shop; machinery workshop; shed for machinery and equipment; store-house for chemicals, fertilizers and seeds; dormitory; and garage;
(c) 附表Vに掲げる土地の使用
(c) the use of the land as listed in Annex V;
(d) 日本国政府が供与する物品のマレイシア内における輸送、それらの物品の据付け及び操作並びにそれら物品に対する通常のサービス(修理を含むが、予備部品の供給を除く。) のための便宜
(d) facilities for transportation within Malaysia of the articles provided by the Government of Japan, and for their installation, operation and normal servicing, including repair works but excluding the supply of spare parts;
(e) 計画のために必要な機械、設備、工具その他の資材(日本国政府が供与するものを除ぐ。)及び、必要な場合には、その補充品
(e) the supply and, as and when appropriate, replacement of machinery, equipment, tools and any other material required for the Project in addition to those provided by the Government of Japan.
(2) マレイシア政府は、附表VIに掲げる計画の実施に必要な運営費を負担する。
(2) The Government of Malaysia shall meet all normal running expenses necessary for the implementation of the Project as listed in Annex VI.
第五条 日本人専門家及びその家族は、外国の専門家が同様の状況の下においてマレイシア政府によつて与えられる特権、免除及び便宜と同等の特権、免除及び便宜をマレイシアにおいて与えられる。
Article V The Japanese experts and their families will be granted in Malaysia privileges, exemptions and benefits as would be granted under similar circumstances by the Government of Malaysia to foreign experts.
第六条 マレイシア政府は、この協定に定める日本人専門家の職務のマレイシアにおける善意の遂行に起因し、その遂行中に発生し、又はその他その遂行に関連する日本人専門家に対する請求が生じた場合には、その請求に関する責任を負うことを約束する。 ただし、日本人専門家の故意又は重大な過失から生する責任については、この限りでない。
Article VI The Government of Malaysia undertakes to bear claims, if any arise, against the Japanese experts resulting from, occurring in the course of , or otherwise connected with the bona fide discharge of their official functions in Malaysia covered by the present Agreement, except for those claims arising from the wilful misconduct or gross negligence of the Japanese expert.
第七条 農業・土地省農業局長は、計画の実施について全般的責任を負う。日本人専門家は、すべての技術的事項について学校長を通じて農業局長に対して責任を負い、学校長は、計画の運営及びそれに関するすべての事務的事項について責任を負う。
Article VII The Director General of Agriculture of the Ministry of Agriculture and Lands shall have the over-all responsibility for the implementation of the Project. The Japanese experts shall be responsible to the Director-General of Agriculture through t he Principal of the School for all technical matters and the Principal of the School shall be responsible for the management of the Project and all administration connected therewith.
第八条 (1) この協定は、署名の日に効力を生じ、三年間効力を有する。
Article V: (1) The Present Agreement will enter into force on the date of s i0nature and remain force for a period of three (3) years.
(2) この協定は、相互の合意により、さらに特定の期間延長することができる。
(2) The present Agreement may be extended mutual agreement for a further specified period.
千九百七十年十二月二十九日にクアラ・ランプールで、ひとしぐ正文である日本語、マレイシア語及び英語により、それぞれ二通ずつ、本書六通を作成した。
