航空運輸業の所得に対する課税の相互免除に関する日本国政府とイラン帝国政府との間で交換された口上書

帝国外務省は、日本国大使館に敬意を表するとともに、イラン及び日本国の航空会社の他方の領域における所得税の納付の相互免除に関する千九百六十七年十月十日付けの大使館の口上書第三十二―P号に関し、及び千九百六十七年十月二十五日付けの口上書第二二八四三－三二四六－一八号に従い、次のとおり述べる光栄を有する。
The Imperial Ministry of Foreign Affairs presents its compliments to the Embassy of Japan and with reference to the Embassy's Note No .32/P dated 0ctober 10th, 1967, and pursuant to Note No. 22843/3246/18 dated October 25th, 1967, concerning the mutual exemption of Iranian and Japanese Airline Companies, from the payment of income taxes in each other territory, has the honour to state:
千九百六十七年三月十九日に批准された直接税法第百六十条の注の第三文によれば、外国の航空企業及び海運企業が、相互主義に基づく待遇を条件として租税の納付を免除されることが予見されている事実にかんがみ、かつ、前記の大使館の口上書において、両国政府の間に二重課税の防止に関する一般的な協定が締結されるまでの間、いずれの国の航空会社も相互主義により他方の国における所得税の納付を免除されることが提案されているので、帝国の関係当局は、日本国政府がイランの航空企業が日本国からの貨物及び旅客の輸送から取得する所得に関して相互主義に基づく待遇を与えることを条件として、日本国の航空企業に対してイランからの貨物及び旅客の輸送から取得する所得に対する所得税の納付を免除することに合意した。
In view of the fact that according to the last paragraph of the Note from the Article 160 of the Direct Taxes Law, ratified on March 19th, 1967, it has been foreseen that the Foreign Airline and Navigation Establishments on the condition of reciprocal treatment may be exempted from the payment of taxes, and since in the above mentioned Note it has been proposed that until the conclusion of a general Agreement between the two governments, in regard to avoid the collection of double taxes, the air line Companies of each of the two countries be reciprocally exempted from the payment of income taxes in the other country, therefore the Imperial authorities concerned have agreed to the exemption of the Japanese Airline Establishments from the payment of income taxes obtained from the transport of goods and passengers from Iran, under the condition of observance of reciprocal treatment by that Embassy's Government in regard to the income obtained by the Iranian Airline Establishments, from the transport of goods and passenger from Japan.
大使館が、日本国政府による相互主義に基づく待遇の許与を確認されれば幸いである。
It will be appreciated if the Embassy would be good enough to confirm the exertion of reciprocal treatment by that Embassy's Government

日本国大使館は、帝国外務省に敬意を表するとともに、千九百六十九年十月四日付けの外務省の次の口上書第三七二一－一八号を受領したことを確認する光栄を有する。
The Embassy of Japan presents its compliments to the Imperial Ministry of Foreign Affairs and has the honour to acknowledge the receipt of the latter's Note No.3721/18, dated 0ctober 4th, 1969, which reads as follows:

日本国大使館は、帝国外務省に対し、日本国政府が、千九百六十二年の日本国法律第百四十四号に従い、相互主義に基づき、イランの航空会社に対して、国際運輸における航空機の運用から生ずる所得に対して日本国において課される所得税及び法人税の納付を免除することを通報する光栄を有する。
The Embassy of Japan has the honour to inform the Imperial Ministry that the Government of Japan hereby undertakes, in accordance with the Japanese Law No. 144 of 1962, to exempt, on a basis of reciprocity, airline companies of Iran from the payment of income taxes and corporation tax chargeable in Japan on income derived from the operation of aircraft in international traffic.
日本国大使館は、以上を申し進めるに際し、ここに重ねて帝国外務省に向かつて敬意を表する。
