(Japanese Note)

　Tokyo, December 25, 1970

　書簡をもつて啓上いたします。本大臣は、千九百六十八年十一月二十七日に署名された日本国とオーストラリア連邦との間の漁業に関する協定並びに同日付けのパプア地域及びニュー・ギニア信託統治地域に関する合意された議事録に掲げられた了解に基づき最近東京において日本国政府の代表者とオーストラリア連邦政府の代表者との間で行なわれた協議に言及する光栄を有します。両政府の代表者は、この協議において、パプア地域及びニュー・ギニア信託統治地域における漁業合弁企業設立の進捗状況について検討を行ないました。本大臣は、さらに、前記の協議の結果到達した次の了解を日本国政府に代わつて確認する光栄を有します。

　 Excellency,
I have the honour to refer to the consultations between the representatives of the Government of Japan and the Government of the Commonwealth of Australia recently held in Tokyo pursuant to the Agreement on Fisheries between Japan and t he Commonwealth of Australia signed on November 27, 1968 and to the understanding embodied in the Agreed Minutes relating to the Territory of Papua and the Trust Territory of New Guinea of the same date. In these consultations the representatives of the two Governments reviewed the progress made in establishing joint venture fishing enterprise in the Territory of Papua and the Trust Territory of New Guinea. I have further the honour to confirm on behalf of the Government of Japan the following understanding reached as a result of such consultations:

1　日本国の船舶は、千九百七十五年十一月二十七日又は両政府間の協議によつて合意されるその後の日までの期間、前記の協定第一条2Bに規定されている水域において、同協定の規定に従いまぐろはえなわ漁業に従事する。

1. Japanese vessels may engage in tuna long-line fishing in accordance with the provisions of the said Agreement in the waters specified in paragraph 2B of Article I thereof until November 27, 1975 or such later date as may be agreed in consultations between the two Governments.

2　1にいう協議は、千九百七十四年十一月二十七日までに開かれるものとし、漁業合弁企業及び水産加工合弁企業の設立に関するその時までの進捗状況に照らして行なわれる。

2. The consultations referred to in paragraph 1. above will be held no t later than November 27, 1974 and will be conducted in the light of progress made by that time in establishing joint venture fishing and fish processing  enterprises.

　本大臣は、閣下が前記の了解をオーストラリア連邦政府に代わつて確認されれば幸いであります。

　I should be grateful if Your Excellency would con firm the foregoing understanding on behalf of the Government of the Commonwealth of Australia.

　本大臣は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

　Agreed Minutes relating to the Territory of Papua and the Trust Territory of New Guinea

　日本国政府の代表者及びオーストラリア連邦政府の代表者は、日本国外務大臣と日本国駐在オーストラリア連邦特命全権大使との間で本日交換された書簡に関連して、次のとおり記録することを合意した。

　The representatives of the Government of Japan and the Government of the Commonwealth of Australia have agreed to record the following in connection with the Notes exchanged today between the Minister for Foreign Affairs of Japan and the Ambassador Extraordinary and Plenipotentiary of the Commonwealth of Australia to Japan:

1　日本国政府の代表者は、パプア地域及びニュー・ギニア信託統治地域において、特にかつお・まぐろ漁業に関し、また、可能な場合には沿岸漁業その他の漁業に関し、漁業合弁企業が設立されるようあらゆる努力を払うとの日本国政府の意向を確認した。

1. The representatives of the Government of Japan confirmed the intent ion of their Government to make every effort to see that joint venture fishing enterprises are established in the Territory of Papua and the Trust Territory of New Guinea, particularly in relation to skipjack tuna fishing, and if possible, in other fisheries such as coastal fisheries.

2　オーストラリア連邦政府の代表者は、パプア地域及び二ュ－・ギニア信託統治地域において、漁獲物の加工(製鎌及び 饅詰製造を含む。)及びその副産物の加工のための大規模な総合的事業の設立を育成する希望を表明した。同代表者は、前記の事業の設立(特にマダン地区における設立)に日本側企業関係者が参加することをオーストラリア政府は歓迎するであろうと述べた。

2. The representatives of the Government of the Commonwealth of Australia expressed  a desire to foster the establishment of large scale integrated operations in the Territory of Papua and the Trust Territory of New Guinea for the processing of fisheries products, including the manufacture of cans and canning, and fisheries by-products. They stated that their Government would welcome the participation of Japanese interests in establishing the above-mentioned operations, particularly in the Madang area.

3　日本国政府の代表者は、日本国政府が、マダン地区における水産業に関し、オーストラリア連邦政府の代表者によつて表明された希望に十分な考慮を払いつつ、できる限りすみやかに投資前基礎調査を行なう意向を有すると述べた。

3. The representatives of the Government of Japan stated that their Government had the intention to undertake as soon as possible feasibility studies in relation to fishery industry in the Madang area taking into full account the desire expressed by the representatives of the Government of the Commonwealth of Australia in this connection.

4　オーストラリア連邦政府の代表者は、オーストラリア連邦政府は漁業合弁企業を設立するために日本側企業関係者から提出されるすべての提案をこれまでどおりすみやかに、かつ、好意的に考慮するであろうと述べた。

4. The representatives of the Government of the Commonwealth of Australia stated that their Government would continue to consider promptly and sympathetically all proposals submitted to it by Japanese interests for the establishment of joint venture fishing enterprises.

5　まぐろはえなわ漁業の装備を有する日本国の漁船は、千九百七十三年十二月三十一日までの間、ラバウル港及びマダン港に入ることができるものと了解される。オーストラリア連邦政府は、3にいう事項の進捗状況に照らして、この期間の延長を考慮する。

5. It is understood that Japanese fishing vessels equipped for tuna long- line fishing may enter the ports of Rabaul and Madang until December 31, 1973. In the light of progress made in the matters referred to in paragraph 3. above, the Government of the Commonwealth of Australia will consider the extension of this  period.

6　両政府の代表者は、合弁会社がパプア地域及びニュー・ギニア信託統治地域の住民の福祉に貢献するような方法で運営することが望ましいと述べた。

6. The representatives of the two Governments stated that it would be desirable that Joint venture companies operate in such a  manner as to contribute to the welfare of the people of the Territory of Papua and the Trust Territory of New Guinea.

7　オーストラリア連邦政府の代表者は、オーストラリア連邦政府が、この議事録において取扱われている事項について、オーストラリア連邦のパプア及びニュー・ギニア法(千九百四十九年―千九百六十八年)によつて設立された住民議会及び施政官評議会の表明する見解に対し妥当な考慮を払う義務を有すると述べた。

7. The representatives of the Government of Commonwealth of Australia stated that their Government had the obligation to give due consideration in the matters dealt with herein to the views expressed by the House of Assembly and the Administrators' Executive Council established by the Papua and New Guinea Act 1949-1968 of the Commonwealth of Australia.

　日本国政府の代表者は、この発言を了知した。

　The representatives of the Government of Japan took note of the above statement.
