AGREEMENT BETWEEN JAPAN AND THE UNITED STATES OF AMERICA CONCERNING THE TRUST TERRITORY OF THE PACIFIC ISLANDS
日本国及びアメリカ合衆国は、
Japan and the United States of America,
以前に日本国の国際連盟委任統治の下にあり、現にアメリカ合衆国が国際連合の信託統治制度の下で太平洋諸島信託統治地域として施政を行なつている太平洋の諸島の住民が第二次世界大戦中の敵対行為の結果こうむつた苦痛に対し、ともに同情の念を表明することを希望し、
Desirous of expressing their common sympathy for the suffering caused by the hostilities of the Second World War to the inhabitants of the Pacific Islands formerly under League of Nations Mandate to Japan and now administered by the United States of America under the United Nations Trusteeship System as the Trust Territory of the Pacific Islands,
信託統治地域の住民の福祉のために自発的拠出を行なうことを希望し、
Desirous of making an ex gratia contribution to the welfare of the inhabitants of the Trust Territory,
日本国及びその国民の財産で信託統治地域にあるもの並びに日本国及びその国民の請求権(債権を含む。)で同地域の施政当局及び住民に対するものの処理並びに日本国における同地域の施政当局及び住民の財産並びに日本国及びその国民に対する施政当局及び住民の請求権(債権を含む。)の処理に関し、日本国との平和条約第四条(a)において予見されている特別取極を締結することを希望して、
Desirous of concluding a special arrangement, as envisaged in Article 4(a) of the Treaty of Peace with Japan, concerning the disposition of property of Japan and of its nationals in the Trust Territory and their claims, including debts, against the Administering Authority of the Trust Territory and the residents thereof, and the disposition in Japan of property of the Administering Authority and residents of the Trust Territory, and of their claims, including debts, against Japan and its nationals,
次のとおり協定した。
Have agreed as follows:
第一条 1 信託統治地域の住民の福祉のために使用される日本国の生産物及び日本人の役務を同地域の施政当局が日本国において購入するため、日本国は、現在五百万合衆国ドル(五、○○○、○○○ドル)に換算される十八億円(一、八〇〇、○○○、○○○円)を無償で施政権者としてのアメリカ合衆国の使用に供する。
ARTICLE I 1. Japan will make available in grants to the United States of America, in its capacity as Administering Authority of the Trust Territory, one billion and eight hundred million yen (1,800,000,000), currently computed at five million United States dollars ($5,000, 000), for the purchase in Japan by the Administering Authority of the products of Japan and the services of the Japanese people, to be used for the welfare of the inhabitants of the Trust Territory.
2 1の生産物及び役務の供与は、日本国政府及びアメリカ合衆国政府が別段の合意を行なう場合を除くほか、日本国の昭和四十五年度予算が国会によつて承認された日又は第二条に規定するアメリカ合衆国議会による予算の承認の日のいずれかおそい日から三年の期間にわたつて行なわれるものとする。日本国による生産物及び役務の供与は、3の規定に基づいて締結される細目取極に従うことを条件として、その期間中、合理的な程度に均等に行なわれるものとする。
2. The provision of these products and services shall, unless otherwise agreed upon by the Government of Japan and the Government of the United States of America, be made over a period of three years from the date on which the Japanese budget for the fiscal year 1970 is approved by the Diet, or the date of the appropriation of funds by the Congress of the United States of America under Article II of this Agreement, whichever date is later. The provision of products and services by Japan shall, subject to detailed arrangements to be concluded pursuant to paragraph 3 of this Article, be made in a reasonably even manner during the period.
3 日本国政府及び施政権者としてのアメリカ合衆国の政府は、この条の規定の実施のため、細目取極を締結する。
3. The Government of Japan and the Government of the United States of-America, as Administering Authority, shall conclude detailed arrangements for the implementation of this Article.
第二条 アメリカ合衆国政府は、アメリカ合衆国議会による予算の承認を条件として、信託統治地域のための通常の財政支出のほかに、同地域の住民の福祉のために使用する五百万合衆国ドル(五、○○○、○○○ドル)の資金を設定する。
ARTICLE II The Government of the United States of America shall, subject to the appropriation of funds by the Congress of the United States, establish a fund in the amount of five million United States dollars ($5,000,000), aside from its normal budgetary expenditures for the Trust Territory, to be used for the welfare of the inhabitants of the Trust Territory.
第三条 日本国及び施政権者としてのアメリカ合衆国は、日本国及びその国民の財産で信託統治地域にあるもの並びに日本国及びその国民の請求権(債権を含む。)で同地域の施政当局及び住民に対するものの処理並びに日本国における同地域の施政当局及び住民の財産並びに日本国及びその国民に対する施政当局及び住民の請求権(債権を含む。)の処理に関し、日本国との平和条約第四条(a)の規定に包含されるすべての問題が完全かつ最終的に解決されたことに合意する。
ARTICLE III Japan and the United States of America, as Administering Authority, agree that all questions encompassed by Article 4(a) of the Treaty of Peace with Japan concerning the disposition of property of Japan and its nationals in the Trust Territory, and their claims, including debts, against the Administering Authority and the residents of the Trust Territory, and the disposition in Japan of property of the Administering Authority and the residents of the Trust Territory, and their claims, including debts, against Japan and its nationals, are fully and finally settled.
第四条 この協定は、日本国がその国内法上の手続に従つてこの協定を承認した旨の通知をアメリカ合衆国政府が日本国政府から受領した日に効力を生ずる。
ARTICLE IV This Agreement shall enter into force on the date of receipt by the Government of the United States of America of a note from the Government of Japan stating that Japan has approved the Agreement in accordance with its legal procedures.
以上の証拠として、下名は、各自の政府から正当に委任を受け、この協定に署名した。
IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Governments, have signed this Agreement.
千九百六十九年四月十八日に東京で、ひとしく正文である日本語及び英語により本書二通を作成した。
DONE at Tokyo, this eighteenth day of April, 1969, in duplicate in the Japanese and English languages, both being equally authentic.

書簡をもつて啓上いたします。本日署名された太平洋諸島信託統治地域に関するアメリカ合衆国と日本国との間の協定に関し、本官は、日本国及びその国民が、その請求権で施政権者としてのアメリカ合衆国及び信託統治地域の住民に対するものがすべて処理ずみのものと認められている事実に照らし同協定第三条の規定の範囲内におけるミクロネシア側の請求(信託統治地域が第二次世界大戦にまき込まれたことから生ずる請求を含む。)に対するすべての責任から完全かつ最終的に免れるとのアメリカ合衆国政府の了解を同政府に代わつて確認する光栄を有します。
In connection with the Agreement between the United States of America and Japan concerning the Trust Territory of the Pacific Islands, signed today, I have the honor to confirm, on behalf of the Government of the United States of America, its understanding that, in view of the fact that all claims of Japan and its nationals against the United States of America, as administering authority, and the residents of the Trust Territory are recognized to have been disposed of, Japan and its nationals are fully and finally discharged from all liability for Micronesian claims falling under Article III of the Agreement, including claims arising out of the involvement of the Trust Territory in the Second World War.
施政権者としてのアメリカ合衆国の政府は、その適当と認める形式、態様及び範囲で、かつ、アメリカ合衆国及び日本国が前記の協定に基づいて行なう拠出の合計額に見合う金額を限度として、同協定第三条に規定するミクロネシアの個個の住民の請求につき支払を行なうための措置を執る意図を有します。
The Government of the United States of America, as Administering Authority, intends to make provision for payment, in whatever form, manner and extent it considers appropriate, and not exceeding the sum corresponding to the total amounts to be contributed by the United States of America and Japan by virtue of the Agreement, of claims of individual Micronesian inhabitants of the Trust Territory referred to in Article III of the Agreement.
本官は、閣下が、前記の了解が貴国政府の了解でもあることを貴国政府に代わつて確認されれば幸いであります。

Sir, I have the honour to refer to your note of today's date, which reads as follows:
本日署名された太平洋諸島信託統治地域に関するアメリカ合衆団と日本国との間の協定に関し、本官は、日本国及びその国民が、その請求権で施政権者としてのアメリカ合衆国及び信託統治地域の住民に対するものがすべて処理ずみのものと認められている事実に照らし同協定第三条の規定の範囲内におけるミクロネシア側の讃求(信託統治地域が第二次世界大戦にまき込まれたことから生ずる請求を含む。)に対するすべての責任から完全かつ最終的に免れるとのアメリカ合衆国政府の了解を同政府に代わつて確認する光栄を有します。
"In connection with the Agreement between the United States of America and Japan concerning the Trust Territory of the Pacific Islands, signed today, I have the honor to confirm, on behalf of the Government of the United States of America, its understanding that, in view of the fact that all claims of Japan and its nationals against the United States of America, as administering authority, and the residents of the Trust Territory are recognized to have been disposed of, Japan and its nationals are fully and finally discharged from all liability for Micronesian claims falling under Article III of the Agreement, including claims arising out of the involvement of the Trust Territory in the Second World War.
施政権者としてのアメリカ合衆国の政府は、その適当と認める形式、態様及び範囲で、かつ、アメリカ合衆国及び日本国が前記の協定に基づいて行なう拠出の合計額に見合う金額を限度として、同協定第三条に規定するミクロネシアの個個の住民の請求につき支払を行なうための措置を執る意図を有します。
The Government of the United States of America, as Administering Authority, intends to make provision for payment, in whatever form, manner and extent it considers appropriate, and not exceeding the sum corresponding to the total amounts to be contributed by the United States of America and Japan by virtue of the Agreement, of claims of individual Micronesian inhabitants of the Trust Territory referred to in Article III of the Agreement.

Excellency; I have the honor to refer to the Agreement between the United States of America and Japan concerning the Trust Territory of the Pacific Islands, signed today.
本官は、同協定を考慮して、日本漁船及びその乗組員が補給並びに乗組員の休養及び慰安を目的としてトラック及びパラオの港に立ち寄ることを歓迎されるものであることを確認いたします。現地の施設は、乗組員の医療及び船舶の応急修理のためにも利用することができます。日本漁船のトラック及びパラオへの出入は、施政当局の定める要件に従うべきものであります。この要件を定めるにあたり、日本船舶以外の船舶にとつての必要並びに港の収容能力及び開発可能性に妥当な考慮が払われるでありましよう。日本漁船の出入は、施政当局が同協定中に規定する日本国の生産物及び日本人の役務の購入を開始することができる日から認められることになります。
Having regard to that Agreement, I wish to confirm that Japanese fishing vessels and their crews will be welcome to call upon the ports of Truk and Palau for the purposes of purchase of supplies and rest and recreation of their crews. Available facilities may also be utilized for medical services for crew members and emergency repair of vessels. Access of Japanese fishing vessels to Truk and Palau shall be subject to requirements of the Administering Authority. Such requirements shall take into appropriate account needs of non-Japanese vessels as well as the capacity of the ports and their developmental possibilities. Access for Japanese fishing vessels shall be accorded from the date on which the Administering Authority may commence purchasing Japanese products and services provided for by the Agreement.
本官は、さらに、太平洋諸島信託統治地域の施政当局が、同協定中に規定する日本国の生産物及び日本人の役務の購入を開始することができる日から三年の期間、日本国政府及び日本国民(法人を含む。)に対し、同地域の領水内にある沈船で沈没の時点において日本国籍を有していたものを引き揚げ及び自由に処分する機会を与えることを確認いたします。施政当局は、そのために貴国政府と詳細な討議にはいる用意があります。
I further wish to confirm that the Administering Authority of the Trust Territory of the Pacific Islands will accord the Government of Japan and its nationals (including juridical persons), for a period of three years from the date on which the Administering Authority may commence purchasing Japanese products and services provided for by the Agreement, the opportunity to 'salvage and freely dispose of ships sunk in territorial waters of the Trust Territory which were of Japanese nationality at the time of sinking. The Administering Authority is prepared to enter into detailed discussions to this end with your Government.
