アラブ連合共和国の商業上の債務の弁済期限延長に関する日本国政府とアラブ連合共和国政府との間の交換公文

Cairo, June 6, 1969.
書簡をもつて啓上いたします。本使は、アラブ連合共和国に居住する債務者が負担する商業上の債務の弁済期限の延長に関し、両国間の貿易関係を促進し、かつ、アラブ連合共和国にとつてある種の弁済遅滞債務の支払の再開を可能ならしめる目的で日本国政府及びアラブ連合共和国政府の代表者の間で最近到達した次の了解を確認する光栄を有します。
Excellency,I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and the Government of the United Arab Republic concerning a rescheduling of the/repayment periods of commercial debts owed by debtors resident in the United Arab Republic, with a view to promoting trade relations between the two countries and to enabling the United Arab Republic to resume transfers of certain arrears of debts :
1(a) アラブ連合共和国政府は、日本国政府により保険の引受けが行なわれた商業上の債務で、千九百六十九年四月三十日までに弁済期限が到来したもの(利子及び原契約の弁済期間が百八十日以内の債務を除く。)に関し、エジプト中央銀行(以下「中銀」という。)が、アラブ連合共和国の法令に基づき、この書簡の日付の日の後直ちにこれらの債務を引き受けることを確保する。
1.(a) With respect to the commercial debts insured by the Government of Japan, having fallen due up to April 30, 1969, but excluding interest and those debts with an original repayment period up to 180 days, the Government of the United Arab Republic shall ensure that the Central Bank of Egypt (hereinafter referred to as "C.B.E.") duly assume these debts immediately after the date of this Note under the laws and regulations of the United Arab Republic.
アラブ連合共和国政府は、さらに、前記の商業上の債務に関し、中銀が、日本国に居住する債権者に対し、(c)に掲げる弁済計画に従い、弁済期限を延長することを要請することを確保する。
The Government of the United Arab Republic shall also ensure that, with respect to the commercial debts mentioned above, C.B.E. request the creditors resident in Japan to extend the repayment periods in accordance with the repayment scheme set out in sub-paragraph (c) below.
(b) 日本国政府は、(a)にいう商業上の債務に関し、(c)に掲げる弁済期限に従い、日本国に居住する債権者が弁済期限の延長についての中銀の要請に応ずることを容易にするため、日本国の法令の範囲内で、あらゆる可能な措置を執る。
(b) The Government of Japan will take all possible measures, within the scope of the laws and regulations in Japan, to facilitate for the creditors resident in Japan to comply with the requests of C.B.E. for the extension of the repayment periods, in accordance with the repayment scheme set out in subparagraph (c ) below, with respect to the commercial debts mentioned in subparagraph (a) above.
(c)(i) 弁済期限が繰り延べられる元金の総額は、一千八百三十四万二千合衆国ドルと見積もられている。
(c)(i) The total amount of the principals, the repayment periods of which will be rescheduled, is estimated to be US$ 18,342,000.00.
(ii) (i)にいう額は、千九百七十年から始まる五年の期間にわたり、四半期ごとの二十回分割払により弁済される。支払は、各年の一月、四月、七月及び十月の最初の平日に行なわれる。
(ii) The amount mentioned in sub-paragraph (i)will be repaid in twenty equal quarterly instalments over a period of five years starting from 1970. The repayment will be made on the first working day of January, April, July and October of each year.
(iii) 弁済期限の延長から生ずる利子の率は、年六パーセントとする。その利子については、アラブ連合共和国のすべての租税及び課徴金が免除される。原契約に異なる延滞利子率の定めがある場合には、日本国の債権者は、前記の六パーセントの率又は原契約に定める率を選択する権利を有する。各債務の満期の日から千九百六十九年六月三十日までの期間につき計算される利子は、千九百六十九年七月の最初の平日に全額支払われる。その後の利子については、随時弁済が行なわれていない商業上の債務について計算された額が、千九百六十九年十月の最初の平日から始まる六年の期間にわたり、四半期ごとの二十一回分割払により支払われる。
(iii) The rate of interest accruing from the extension of the repayment periods will be six per cent (6%) per annum. Such interest shall be exempted from all taxes and duties of the United Arab Republic. In cases where different rates of the overdue interest are provided for in the original contracts, the Japanese creditors have the right to choose either the rate of six per cent or the rates provided for in the original contracts. Such amount of interest as calculated from the original maturity date of each debt up to June 30, 1969 will be totally paid on the first working day of July, 1969. Such amount of interest as calculated on the amount of the commercial debts, outstanding from time to time, will be paid in twenty-one quarterly instalments over six years beginning the first working day of October, 1969.
(d) アラブ連合共和国政府は、原契約の条件のうちこの書簡で特に言及されていないものは、引き続き変更されないことを確認する。
(d) The Government of the United Arab Re- public hereby confirms that the terms and conditions of the original contracts which are not specifically referred to in the present Note shall remain unchanged.
2 ここに取り扱われているもの以外の事項については、中銀と関係債権者が合意するところによる。弁済期限の延長に伴つて生ずる銀行手数料は、日本国において生じたものを除き、中銀により負担される。
2. Matters other than those dealt with herein shall be as agreed upon between C.B.E. and the creditors concerned. Bank charges incidental to the extension of the repayment periods, other than those incurred in Japan, shall be borne by C.B.E.
3 アラブ連合共和国政府は、この取極に基づき行なわれる元金の弁済及び利子の支払が交換可能通貨によつて行なわれることを確保する。
3. The Government of the United Arab Republic shall ensure that the repayments of principals and payments of interest to be made under the present arrangements shall be made in a convertible currency or currencies.
本使は、閣下がアラブ連合共和国政府に代わつて前記の了解を確認されれば幸いであります。
