日本国とパキスタン回教共和国との間の日本国産米の貸借に関する契約に関連する交換公文

Tokyo, November 19, 1969
書簡をもつて啓上いたします。本使は、本年十一月十五日に日本国東京においてパキスタン回教共和国政府と日本国農林省食糧庁との間で締結された「日本国とパキスタン回教共和国との間の日本国産米の貸借に関する契約」(以下「契約」という。)に言及する光栄を有します。前記の契約には主として次の事項が定められています。
Exce1lency,I have the honour to refer to the "Contract for Loan of Japanese Rice between Japan and the Islamic Republic of Pakistan" concluded between the Government of the Islamic Republic of Pakistan and the Food Agency, Ministry of Agriculture and Forestry of Japan on November 15, 1969, in Tokyo, Japan (hereinafter referred to as "the Contract"), The Contract provides, inter alia, for the following:
(a) 日本国農林省食糧庁(以下「貸付者」という。)は、千九百六十七年産日本国産水稲うるち精米十万トンを千九百六十九年十二月から千九百七十年二月までの間にパキスタン回教共和国政府(以下「借受者」という。)に対し貸し付ける。
(a) The Food Agency, Ministry of Agriculture and Forestry of Japan (hereinafter referred to as "the Lender") shall supply on a loan basis to the Government of the Islamic Republic of Pakistan (hereinafter referred to as "the Borrower"), during the period between December 1969 and February 1970 a total of one hundred thousand (100,000) metric tons of milled rice processed from non-glutinous brown rice produced in Japan in the year 1967;
(b) 借受者は、貸付けに係る米穀と同等のパキスタン回教共和国産水稲うるち(日本種)精米を千九百八十年から千九百八十九年までの間において各年一万トンずつ貸付者に返還する。
(b) The Borrower shall return to the Lender each year during the period from 1980 to 1989 ten thousand (10,000) metric tons of milled rice processed from non-glutinous paddy of the Japonica type produced in the Islamic Republic of Pakistan, the quality of which shall be the same as the loaned rice;
なお借受者は、前記の米穀による返還が困難なときは、パキスタン以外の国において産出された水稲うるち(日本種)精米であつて借受者に引き渡された米穀と同等のものをもつて返還することができる。
In the event that the return of the rice as stated above is found difficult, the Borrower may return in non-glutinous milled rice of the Japonica type produced in countries other than Pakistan and of the quality which will conform to that of the rice supplied to the Borrower;
(c) 貸付けに係る米穀の受渡しは、日本国の港における本船積込み渡しとし、返還に係る米穀の受渡しは、日本国の港における本船乗渡しとする。
(c) Rice for loan shall be delivered on the basis of F.O.B. stowed at Japanese ports, while rice for return shall be delivered on the basis of C.I.F. at Japanese ports;
(d) 借受者は、貸付者に対し、貸付料として
(d) By way of charges, the Borrower shall:
(i) 千九百八十年から千九百八十九年までの間において、返還に係る米穀と同等の米穀を各年二千トンずつ引き渡し、かつ、
(i) supply to the Lender two thousand (2,000) metric tons of rice of the same quality as that of rice for return each year during the period between 1980 and 1989; and
(ii) 千九百七十年一月二十日までに百十四万合衆国ドル及び毎年の返還時に貸付者が要した経費に相当する額を支払う。
(ii) pay the Lender one million one hundred and forty thousand (1,140,000) U.S. dollars by January 20, 1970, and, at the time of the annual return of rice, the amount equivalent to the expenses incurred to the Lender.
本使は、契約の締結についてパキスタン回教共和国政府がきわめて満足している旨を閣下に通報するとともに、契約に関連する次の了解を本国政府に代わつて確認します。
I wish to inform Your Excellency that the Government of the Islamic Republic of Pakistan is highly satisfied with the conclusion of the Contract and to confirm on behalf of my Government the following understanding relating to the Contract:
1 両国政府は、それぞれの国で施行されている法令の範囲内で、契約の円滑かつ適時の実施を促進し、かつ、このため必要な措置をとるものとする。
1. The two Governments will, within laws and regulations in force in their respective countries, facilitate smooth and timely implementation of the Contract and take necessary measures to this end,
2 パキスタン回教共和国国民及び日本国民は、契約に基づく米の輸出及び輸入に関する業務のための相手国への入国及び相手国における滞在につき、当該相手国で施行されている法令の範囲内で必要な便宜を与えられるものとする。
2. Nationals of the Islamic Republic of Pakistan and of Japan will be granted, within laws and regulations in force in such other country, facilities necessary for entry into and stay in the other country for the purpose of activities related to the export and import of rice under the Contract.
3 両国政府は、この了解から又はそれと関連して生ずることがあるいかなる問題についても相互に協議するものとする。
3. The two Governments will consult with each other on any problems that may arise out of this understanding or in connexion therewith.
本使は、前記のことが日本国政府の了解でもあることを同政府に代わつて閣下が確認されれば幸いであります。
I should be grateful if Your Excellency would confirm on behalf of your Government that this is also the understanding of the Government of Japan.
本使は、以上を申し進めるに際し、ここに閣下に向かつて敬意を表します。
