AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF ITALY CONCERNING TRADE IN COTTON TEXTILES
日本国政府及びイタリア政府は、千九百七十年九月三十日まで延長された千九百六十二年十月一日の綿製品の国際貿易に関する長期取極(以下「ジュネーヴ取極」という。)の規定、特に相互に受諾可能な取極の締結について定める第四条の規定に従い、日本国とイタリアとの間の綿製品貿易の秩序ある発展を確保することを希望して、
The Government of Japan and the Government of Italy, Desiring to ensure the orderly development of trade in cotton textiles between Japan and Italy in accordance with the provisions of the Long-term Arrangement regarding International Trade in Cotton Textiles of October 1, 1962, which was extended until September 30, 1970 (hereinafter referred to as the "Geneva arrangement"), and in particular of its Article 4, which provides for the conclusion of mutually acceptable arrangements,
次のとおり協定した。
Have agreed upon the following provisions:
第一条 この協定は、日本国を原産地としかつ積出地とする綿製品でこの協定の附属書に掲げるものに適用する。
Article 1 This agreement shall apply to cotton textiles originating in and despatched form Japan and listed in the Annex to this Agreement.
第二条 この協定の有効期間中、この協定及び附属書の規定により、イタリア政府は、新たな数量制限を設けないこと及び現行の数量制限の適用を停止することを約束し、また、日本国を原産地としかつ積出地とする綿製品のイタリアへの輸入が合意された数量をこえない限り、ジュネーヴ取極第三条の規定を援用しないことに同意する。
Article 2 During the period of validity of this Agreement and by virtue of the provisions contained therein or annexed thereto, the Government of Italy undertakes not to introduce new quantitative restrictions and to suspend the application of those in force and agrees not to invoke the provisions of Article 3 of the Geneva Arrangement as long as imports into Italy of cotton textiles originating in and despatched from Japan do not exceed the quantities agreed upon.
日本国政府は、特にイタリア政府の要請があつたときは、合意された上限が尊重されるよう適当な措置をとり、かつ、このため必要と認められる措置の実施についてイタリアと協力することを約束する。
The Government of Japan undertakes to take the appropriate measures, especially when so requested by the Government of Italy, to ensure that the ceilings agreed upon are respected, and to cooperate with the Government of Italy in implementing the measures recognised as necessary for this purpose.
ジュネーヴ取極の規定は、日本国政府とイタリア政府との間で引き続き効力を有する。
The provisions of the Geneva Arrangement shall remain in force between the Government of Japan and the Government of Italy.
第三条 (a) 総上限
Article 3 a) Global ceiling
十二箇月の各期間について合意された総数量は、一、六〇〇メトリック・トンとする。
The total quantity agreed upon for each twelve-month period shall be 1,600 metric tons.
(b) 分類群別上限
b) Ceilings by group of categories
前記の総数量は、二の主要な品目分類群の間で次のとおり配分される。
The said total quantity shall be apportioned as follows between the two main groups of categories of products:

(c) 個別上限
c) Specific ceilings
前項に定める各分類別上限の限度内において、取引が過度に特定品目に集中することを避けるため、個別上限が合意される。この上限は、この協定の附表を基礎として定められる。
Up to each of the ceilings by group of categories established under the preceding paragraph, specific ceilings will be agreed upon in order to prevent excessive concentration of trade on certain products; these ceilings will be fixed on the basis of the list annexed to this Agreement.
いずれかの十二箇月の期間において、イタリア政府が、個別上限の対象となつていない特定の品目の輸入について急速かつ重要な増大を認める場合には、同政府は、個別上限を定めるよう要請することができる。この要請があつた場合には、当該品目についての個別上限の水準を合意するためすみやかに協議を行なう。
If, in the course of one of the twelve-month periods, the Government of Italy finds a rapid and substantial growth in imports of certain products which are not covered by specific ceilings, they may request that a specific ceiling be fixed. Where such a request is made, consultations shall be held forthwith to agree upon the level of a specific ceiling for the products in question.
第四条 1 第一分類群について定める数量と第二分類群について定める数量との間で振替えを行なうことはできない。
Article 4 1. No transfer may be made between the quantity fixed for Group I and the quantity fixed for Group II.
個別上限は、超過してはならない。個別上限の未使用分は、各分類群別上限の限度内において、同一の分類群の他の分類で個別上限の対象となつていないものに使用することができる。
The specific ceilings shall not be exceeded; within the limits of each ceiling by group, the unused portions of the specific ceilings may be used for the other categories of the group which are not covered by specific ceilings.
2 各十二箇月の期間において使用されなかつたいずれかの分類群別上限の部分は、当該上限の十パーセントの限度内において次の十二箇月の期間の同一の分類群別上限に繰り越して加算することができる。
2. Portions of one the ceilings by group of categories not used during each twelve-month period may be carried over and added to the ceiling for the same group in the following twelve-month period within the limits of 10% of the ceiling in question.
分類別の個別上限の未使用部分は、振替え又は他の繰越しの対象となつていない場合には、当該上限の十パーセントの限度内において次の十二箇月の期間の同一の個別上限に繰り越し加算することができる。
The unused portions of the specific ceilings by category may be carried over and added to the same specific ceilings for the following twelve-month period within the limits of 10% of the said ceilings, if the specific ceilings have not been subject to a transfer or to a carry-over of another kind.
3 日本国政府が適当な時に書面で要請する場合には、合意された各上限の五パーセントの限度内において、次の十二箇月について定められた上限から先取りが認められる。ただし、日本国政府は、特に季節的要因を考慮に入れ、すべての分類の綿製品の輸出が年間を通じてできる限り均等に行なわれるよう努力する。先取りの量は、次の十二箇月の上限から控除される。
3. Within the limits of 5% of each of the ceilings agreed upon, anticipation shall be authorized from the ceiling established for the following twelve-month period, if the Government of Japan so requests in writing in due time; the Government of Japan, however, shall endeavour to ensure that exports of cotton textiles of all categories are spaced out as regularly as possible over each of the twelve-month periods taking into account seasonal factors in particular. Amounts carried in advance shall be deducted from the ceilings for the following twelve-month period.
第五条 両国政府は、イタリアに仕向けられる日本国の綿製品の輸出及びこれに対応するイタリアへの輸入に関する情報を交換する。
Article 5 The two Governments will exchange all information relating to exports of cotton textiles from Japan to Italy and to the corresponding imports into Italy.
各政府は、この協定の適用にあたり、自国が用いる分類方法を適用することができるものとし、また、このようにして提供された情報の比較を容易にするため協力する。
Each Government may, for the purpose of this Agreement, apply classification available to it and will co-operate in facilitating comparison of information thus supplied.
第六条 イタリア政府が日本国政府に対し、この協定の実施について、イタリアの輸入者と日本国の輸出者との間の現行の取引関係の維持について困難が生じた旨を通報した場合には、日本国政府及びイタリア政府は、この取引関係の維持を確保するため必要なあらゆる措置をとる目的をもつて協議を行なう。
Article 6 In case the Government of Italy informs the Government of Japan that difficulties have arisen, in the implementation of this Agreement, regarding the maintenance of existing commercial relations between importers in Italy and their suppliers in Japan, the two Governments will consult each other in order to take all the necessary measures to ensure the maintenance of these commercial relations.
第七条 両国政府は、いずれか一方の政府の要請があつたときは、この協定の実施から生ずるすべての問題について協議する。
Article 7 The two Governments will, at the request of either Government, consult each other on all problems arising from the implementation of this Agreement.
さらに、日本国政府及びイタリア政府は、綿製品の貿易全般に関し、日本国政府の代表者と欧州共同体の加盟国政府及び委員会の代表者との間の協議に毎年参加することに同意する。
Furthermore, the Government of Japan and the Government of Italy agree to take part each year in consultation between Representatives of the Government of Japan and Representatives of the Governments of the Member States and of the Commission of the European Communities regarding the overall aspects of trade in cotton textiles.
第八条 この協定は、署名の日に効力を生じ、かつ、千九百六十九年十月一日から十二箇月の期間適用される。
Article 8 The present Agreement shall enter into force on the date of signature and shall be applicable for the period of twelve months from October 1, 1969.
ジュネーヴ取極の有効期間を延長する議定書第四項の規定は、この協定について適用される。その規定が適用される場合には、この協定中の約束は、適当な形式に修正される。
The provisions of paragraph 4 of the Protocol extending the Geneva Arrangement will be applicable to the present Agreement. In case of their application, the undertakings contained in the present Agreement will be modified in an appropriate form.
この協定の附属書は、協定の不可分の一部をなす。
The Annex to the present Agreement forms an integral part thereof.
以上の証拠として、下名の代表者は、正当な委任を受けてこの協定に署名した。
IN WITNESS WHEREOF, the undersigned Representatives, duly authorized thereto, have singed the present Agreement.

Tokyo, October 22nd, 1969
書簡をもつて啓上いたします。本官は、イタリア政府と日本国政府との間で行なわれ、綿製品の貿易に関する協定の署名に至つた交渉の妥結にあたり、イタリア政府に代わつて次の了解を確認する光栄を有します。
Excellency, At the conclusion of the negotiations that took place between the Government of Japan and the Government of Italy and which led to the signature of the Agreement concerning trade in cotton textiles, I have the honour to confirm, on behalf of the Government of Italy, the following understandings:
1 欧州経済共同体における特殊の事情にかんがみ、前記の協定は、欧州経済共同体の他のすべての加盟国政府と日本国政府との間に同様の二国間協定がジュネーヴ取極第四条の規定に従つて署名されたときにのみ適用されることとなる。
1. In consideration of certain elements proper to the European Economic Community, the above mentioned Agreement will be applicable only when similar bilateral agreements between the Government of the other Member States of the European Economic Community and the Government of Japan have been signed in accordance with the provisions of Article 4 of the Geneva Arrangement.
2 前記の協定のいかなる規定も、イタリアと日本国との関係において存在する綿製品の自由化の現状に影響を与えるものと解してはならない。
2. No provision of the Agreement shall be interpreted as affecting the present state of liberalization in respect of cotton textile products which exists in the relations between Italy and Japan.
3 関係品目の輸入の急速かつ重要な増大が市場かく乱をおこす場合又はおこすおそれがある場合にのみ、イタリア政府は、協定第三条(c)に基づいて個別上限を設定するよう要請できるものと了解される。
3. It is understood that the Government of Italy may request a specific ceiling to be fixed in accordance with Article 3 c) of the Agreement only when rapid and substantial growth in deliveries of the products concerned causes or threatens to cause disruption of the market.
同条に定める協議の結果が得られるまでの間、日本国政府は、要請の行なわれた日から、当該品目の輸出を、統計資料が入手可能な最近の十二箇月間に行なわれた輸出の百五パーセントを期間比例按分したものに相当する水準に維持する。
Pending the results of the consultations provided for in the said Article, the Government of Japan shall maintain, as from the date of the request, exports of the products in question at a level corresponding, pro-rata temporis, to 105% of the exports effected during the most recent twelve-month period for which statistics are available.
本官は、閣下が日本国政府に代わつて前記の了解を確認されれば幸いであります。
I shall be grateful if Your Excellency is good enough to confirm the above-mentioned understandings on behalf of the Government of Japan.
