　AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF GERMANY CONCERNING TRADE IN COTTON TEXTILES


　日本国政府及び

　The Government of Japan and the Government of the Federal Republic of Germany,


　ドイツ連邦共和国政府は、

　


　千九百七十年九月三十日まで延長された千九百六十二年十月一日の綿製品の国際貿易に関する長期取極(以下「ジュネーヴ取極」という。)の規定、特に相互に受諾可能な取極の締結について定める第四条の規定に従い、日本国とドイツ連邦共和国との間の綿製品貿易の秩序ある発展を確保することを希望して、

　Desiring to ensure the orderly development of trade in cotton textiles between Japan and the Federal Republic of Germany in accordance with the provisions of the Long-Term Arrangement regarding International Trade in Cotton Textiles of October l, 1962, which was extended until September 30, 1970 (hereinafter referred to as the "Geneva Arrangement") and in particular of Article 4 thereof, which provides for the conclusion of mutually acceptable arrangements,


　協力しかつ次の諸規定を適用することを合意した。

　Have agreed to co-operate and to apply the following provisions:


第一条
　この協定は、日本国を原産地としかつ積出地とする綿製品でこの協定の附属書に掲げるものに適用する。

Article l
　This Agreement shall apply to cotton textiles originating in and despatched from Japan and listed in the Annex to this Agreement.


第二条
　この協定の有効期間中、この協定の規定により、ドイツ連邦共和国政府は、新たな数量制限を設けないこと及び現行の数量制限の適用を停止することを約束し、また、日本国を原産地としかつ積出地とする綿製品のドイツ連邦共和国への輸入が合意された数量をこえない限り、ジュネーヴ取極第三条の規定を援用しないことに同意する。

Article 2
　During the period of validity of this Agreement and by virtue of the provisions contained therein, the Government of the Federal Republic of Germany undertakes not to introduce new quantitative restrictions and to suspend the application of those in force and agrees not to invoke the provisions of Article 3 of the Geneva Arrangement as long as imports into the Federal Republic of Germany of cotton textiles originating in and despatched from Japan do not exceed the quantities agreed upon.


　日本国政府は、特にドイツ連邦共和国政府の要請があつたときは、合意された上限が尊重されるよう適当な措置をとり、かつ、このため必要と認められる措置の実施についてドイツ連邦共和国と協力することを約束する。

　The Government of Japan undertakes to take appropriate measures, especially when so re-quested by the Government of the Federal Re-public of Germany, in order that the ceilings agreed upon are respected, and to co-operate with the Government of the Federal Republic of Germany in implementing the measures recognized as necessary for this purpose.


　ジュネーヴ取極の規定は、両政府の間で引き続き効力を有する。

　The provisions of the Geneva Arrangement shall remain in force between the two Governments.


第三条
(a)　総上限

Article 3
(a) Global ceiling


　十二箇月の期間について合意された総数量は、六千トンとする。

　The total quantity agreed upon for the period of twelve months shall be 6,000 tons.


(b)　分類群別上限

(b) Ceilings by groups of categories


　前記の総数量は、二の主要な品目分類群の間で次のとおり配分される。

　The afore-mentioned total quantity shall be apportioned as follows between the two main groups of categories of products:

　第一分類群　生地又はさらしの綿織物(マーセライズされているかどうかを問わない。)　二、〇〇〇

　Group I Cotton fabrics, grey or bleached, whether or not mercerized         2,000 tons


　第二分類群　その他の綿織物、綿の二次製品及び綿の雑製品　四、〇〇〇

　Group II Other cotton fabrics, made-up articles and miscellaneous articles of cotton         4,000 tons


(c)　個別上限

(c) Specific ceilings


　前項に定める各分類別上限の限度内において、取引が過度に特定品目に集中することを避けるため、個別上限が合意される。この上限は、この協定の附表を基礎として定められる。

　Up to each of the ceilings by groups of categories established under the preceding paragraph, specific ceilings will be agreed upon in order to prevent excessive concentration of trade on certain products; these ceilings will be fixed on the basis of the list annexed to this Agreement.


　いずれかの十二箇月の期間において、ドイツ連邦共和国政府が、個別上限の対象となつていない特定の品目の輸入について急速かつ重要な増大を認める場合には、同政府は、個別上限を定めるよう要請することができる。この場合には、当該品目についての個別上限の水準を合意するためすみやかに協議を行なう。

　If, in the course of one of the annual periods, the Government of the Federal Re-public of Germany notes a rapid and sub-stantial growth in deliveries of certain pro-ducts which are not covered by specific ceilings, it may request that a specific ceiling, it may request that a specific ceiling be fixed. In such a case, a consultation shall be held forthwith to agree upon the level of a specific ceiling for the product in question.


第四条
(a)　第一分類群について定める数量と第二分類群について定める数量との間で振替えを行なうことはできない。

Article 4
(a) No transfer may be made between the quantity fixed for Group I and the Quantity fixed for Group II.


　個別上限は、超過してはならない。個別上限の未使用分は、各分類群別上限の限度内において、同一の分類群の他の分類で個別上限の対象となつていないものに使用することができる。

　The specific ceilings must not be exceeded; within the framework of the ceilings by groups, the unused portions of the specific ceilings, may be used for the other categories of the group which are not covered by specific ceilings.


(b)　十二箇月の期間において使用されなかつたいずれかの分類群別上限の部分は、当該上限の十パーセントの限度内において次の十二箇月の期間の同一の分類群別上限に繰り越して加算することができる。

(b) Portions of one of the ceilings for the two groups of categories not used during one annual period may be carried over and added to the ceiling for the same group in the following annual period within the limits of 10 per cent of the ceiling in question.


　分類別の個別上限の未使用部分は、振替え又は他の繰越しの対象となつていない場合には、当該上限の十パーセントの限度内において次の十二箇月の期間の同一の個別上限に繰り越し加算することができる。

　The unused portions of the specific ceilings for the categories may be carried over and added to the same specific ceilings for the following year within the limits of 10 per cent of the said ceilings, if the specific ceilings have not been subject to a transfer or a carry-over of another kind.


(c)　日本国政府が適当な時に書面で要請する場合には、合意された各上限の五パーセントの限度内において、次の十二箇月について定められた上限から先取りが認められる。ただし、日本国政府は、特に季節的要因を考慮に入れ、すべての分類の綿製品の輸出が年間を通じてできる限り均等に行なわれるよう努力する。先取りの量は、次の十二箇月の上限から控除される。

(c) Within the limits of 5 per cent of each of the ceilings agreed upon, advance deliveries shall be authorized from the ceiling established for the following annual period, if the Government of Japan so requests in writing in due time; the Government of Japan, however, shall endeavour to ensure that exports of cotton textiles of all categories are spaced out as regularly as possible over each of the annual periods, taking seasonal factors in particular into account. Amounts imported in advance shall be deducted from the ceilings for the following annual period.


第五条
　両政府は、ドイツ連邦共和国に仕向けられる日本国の綿製品の輸出及びこれに対応するドイツ連邦共和国への輸入に関する情報を交換する。各政府は、この協定の適用にあたり、自国が用いる分類方法を適用することができるものとし、また、このようにして提供された情報の比較を容易にするため協力する。

Article 5
　The two Governments agree to exchange all information relating to exports of cotton tex-tiles from Japan to the Federal Republic of Germany and to the corresponding imports into the Federal Republic of Germany. Each Government will, for the purposes of this Agreement, apply classification at its disposal and shall co-operate in facilitating comparison of in-formation thus supplied.


第六条
　ドイツ連邦共和国政府が日本国政府に対し、この協定の実施について、ドイツ連邦共和国の輸入者と日本国の輸出者との間の現行の取引関係の維持について困難が生じた旨を通報した場合には、両政府は、この取引関係の維持を確保するため必要なあらゆる措置を決定する目的をもつて協議を行なう。

Article 6
　If the Government of the Federal Republic of Germany informs the Government of Japan that difficulties have arisen, in the application of this Agreement, regarding the maintenance of existing commercial relations between importers in the Federal Republic of Germany and their suppliers in Japan, the two Governments shall consult each other to determine all the measures necessary to ensure the maintenance of these commercial relations.


第七条
　両政府は、いずれか一方の政府の要請があつたときは、この協定の実施から生ずるすべての問題について協議する。

Article 7
　The two Governments undertake to consult each other, at the request of either Government, on all problems arising from the implementation of this Agreement.


　さらに、両政府は、綿製品の貿易全般に関し、日本国政府の代表者と欧州経済共同体の加盟国政府及び委員会の代表者との間の協議に参加することに同意する。

　Furthermore, the two Governments agree to take part in consultations between representatives of the Government of Japan and representatives of the Governments of the Member States and of the Commission of the European Communities regarding the overall aspects of trade in cotton textiles.


第八条
　この協定は、ドイツ連邦共和国政府がこの協定の署名の日から三箇月以内に日本国政府に対して反対の宣言を行なわない限り、ベルリン地区についても適用する。

Article 8
　This Agreement shall also apply to Land Berlin, provided that the Government of the Federal Republic of Germany has not made a contrary declaration to the Government of Japan within three months from the date of signing of this Agreement.


第九条
　この協定は、署名の日に効力を生じ、かつ、千九百六十九年十月一日から十二箇月の期間適用される。

Article 9
　This Agreement shall enter into force on the date of signature thereof and shall be applicable for a period of twelve months as from October 1, 1969.


　ジュネーヴ取極の有効期間を延長する議定書第四項の規定は、この協定について適用される。その規定が適用される場合には、この協定中の約束は、適当な形式に規定される。

　The provisions of paragraph 4 of the protocol extending the Geneva Arrangement shall be applicable to this Agreement. In case of their application, the undertakings contained in this Agreement shall be set out in an appropriate form.


　以上の証拠として、下名の代表者は、正当な委任を受けてこの協定に署名した。

　IN WITNESS WHEREOF, the undersigned representatives, duly authorized thereto, have signed this Agreement.

　Excellency, At the conclusion of the negotiations between the Government of the Federal Republic of Germany and the Government of Japan which have resulted in the signing of the Agreement concerning Trade in Cotton Textiles, I have the honour to confirm, on behalf of the Government of the Federal Republic of Germany, the following understandings:


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(1)　欧州経済共同体における特殊の事情にかんがみ、前記の協定は、欧州経済共同体の他のすべての加盟国政府と日本国政府との間に同様の二国間協定が綿製品の国際貿易に関する長期取極第四条の規定に従つて署名されたときに適用されることとなる。


							

						

						

							

								
(1) In consideration of certain elements proper to the European Economic Community, the afore-mentioned Agreement will be applicable when all Member States of the European Economic Community have concluded similar bilateral agreements under Article 4 of the Long-Term Arrangement regarding International Trade in Cotton Textiles.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(2)　協定のいかなる規定も、ドイツ連邦共和国政府と日本国政府との間において存在する綿製品の自由化の現状に影響を与えるものと解してはならない。


							

						

						

							

								
(2) No provision of the Agreement shall be interpreted as affecting the present state of liberalization of cotton textiles in the relations between the Government of the Federal Republic of Germany and the Government of Japan.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(3)　関係品目の輸入の急速かつ重要な増大が市場かく乱をおこす場合又はおこすおそれがある場合にのみ、ドイツ連邦共和国政府は、協定第三条(ｃ)に基づいて個別上限を設定するよう要請するものと了解される。


							

						

						

							

								
(3) It is understood that the Government of the Federal Republic of Germany will request a specific ceiling to be fixed under paragraph (c) of Article 3 of the Agreement only when rapid and substantial growth of deliveries of the products concerned causes or threatens to cause market disruption.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
　　同条に定める協議の結果が得られるまでの間、日本国政府は、要請の行なわれた日から、当該品目の輸出を、統計資料が入手可能な最近の十二箇月間に行なわれた輸出の百五パーセントを期間比例按分したものに相当する水準に維持する。


							

						

						

							

								
　Until the results of the consultations provided for under that Article are available, the Government of Japan will, from the date of the request, maintain its exports of the products concerned at a level which corresponds, pro rata temporis, to 105 per cent of the exports effected during the most re-cent period of 12 months for which statistical data are available.
