These Governments acting together under the Treaty establishing the Benelux Economic Union, signed at The Hague on February 3, 1958, on the other,
千九百七十年九月三十日まで延長された千九百六十二年十月一日の綿製品の国際貿易に関する長期取極(以下「ジュネーヴ取極」という。)の規定、特に相互に受諾可能な取極の締結について定める第四条規定に従い、日本国とベネルックス諸国との間の綿製品貿易の秩序ある発展を確保することを希望して、
Desiring to ensure the orderly development of trade in cotton textiles between Japan and the Benelux countries in accordance with the provisions of the Long-term Arrangement regarding international trade in cotton textiles of October 1, 1962, which was extended until September 30, 1970 (hereinafter referred to as the "Geneva Arrangement"), and in particular of its Article 4 which provides for the conclusion of mutually acceptable arrangements,
次のとおり協定した。
Have agreed upon the following provisions:
第一条 この協定は、日本国を原産地としかつ積出地とする綿製品でこの協定の附属書に掲げるものに適用する。
Article 1 This Agreement shall apply to cotton textiles originating in and despatched from Japan and listed in the Annex to this Agreement.
第二条 この協定の有効期間中、この協定及び附属書の規定により、ベネルックス諸国政府は、新たな数量制限を設けないこと及び現行の数量制限の適用を停止することを約束し、また、日本国を原産地としかつ積出地とする綿製品のベネルックス諸国への輸入が合意された数量をこうない限り、ジュネーヴ取極第三条の規定を援用しないことに同意する。
Article 2 During the period of validity of this Agreement and by virtue of the provisions contained therein or annexed thereto, the Governments of the Benelux countries undertake not to introduce new quantitative restrictions and to suspend the application of those in force and agree not to invoke the provisions of Article 3 of the Geneva Arrangement as long as imports into the Benelux countries of cotton textiles originating in and despatched from Japan do not exceed the quantities agreed upon.
日本国政府は、特にベネルックス諸国政府の要請があつたときは、合意された上限が尊重されるよう適用な措置をとり、かつ、このため必要と認められる措置の実施についてベネルックス諸国と協力することを約束する。
The Government of Japan undertakes to take the appropriate measures, especially when so requested by the Governments of the Benelux countries, to ensure that the ceilings agreed upon are respected, and to co-operate with the Governments of the Benelux countries in implementing the measures recognized as necessary for this purpose.
ジュネーヴ取極の規定は、日本国政府とベネルックス諸国政府との間で引き続き効力を有する。
The provisions of the Geneva Arrangement shall remain in force between the Government of Japan and the Governments of the Benelux countries.
第三条 (a) 総上限
Article 3 a) Global ceiling
十二箇月の各期間について合意された総数量は、千二百メトリック・トンとする。
The total quantity agreed upon for each twelve-month period shall be 1,200 metric tons.
(b) 分類群別上限
b) Ceilings by group of categories
前記の総数量は、二の主要な品目分類群の間で次のとおり配分される。 メトリック・トン
The said total quantity shall be apportioned as follows between the two main groups of categories of products: Metric tons
第一分類群 生地又はさらし綿織物(マーセライズされているかどうかを問わない。) 五〇〇
Group I Cotton fabrics, grey or bleached, whether or not mercerised 500
第二分類群 この他の綿織物、綿の二次製品及び綿の雑製品 七〇〇
Group II Other cotton fabrics, made-up articles and miscellaneous articles of cotton 700
(c) 個別上限
c) Specific ceilings
前項に定める各分類群別上限の限度内において、取引が過度に特定品目に集中することを避けるため、個別上限が合意される。この上限は、この協定の附表を基礎として定められる。
Up to each of the ceilings by group of categories established under the preceding paragraph, specific ceilings shall be agreed upon in order to prevent excessive concentration of trade on certain products; these ceilings shall be fixed on the basis of the list annexed to this Agreement.
いずれかの十二箇月の期間において、ベネルックス諸国政府が、個別上限の対象となつていない特定の品目の輸入について急速かつ重要な増大を認める場合には、同政府は、箇別上限を定めるよう要請することができる。この要請があつた場合には、当該品目についての個別上限の水準を合意するためすやかに協議を行なう。
If, in the course of one of the annual periods, the Governments of the Benelux countries note a rapid and substantial growth in imports of certain products which are not covered by specific ceilings, they may request that a specific ceiling be fixed. Where such a request is made, a consultation shall be held forthwith to agree upon the level of a specific ceiling for the product in question.
第四条 1 第一分類について定める数量と第二分類群について定める数量との間で振替えを行なうことはできない。
Article 4 1. No transfer may be made between the quantity fixed for Group I and the quantity fixed for Group II.
個別上限は、超過してはならない。個別上限の未使用分は、各分類群別上限の限度内において、同一の分類群の他の分類で個別上限の対象となつていないものに使用することができる。
The specific ceilings shall not be exceeded; within the framework of ceilings by group, the unused portions of the specific ceilings may be used for the other categories of the group which are not covered by specific ceilings.
2 各十二箇月の期間において使用されなかつたいずれかの分類群別上限の部分は、当該上限の十パーセントの限度内において次の十二箇月の期間の同一の分類群別上限に繰り越して加算することができる。
2. Portions of one of the ceilings by group of categories not used during any annual period may be carried over and added to the ceiling for the same group in the following annual period within the limits of 10% of the ceiling in question.
分類別の個別上限の未使用部分は、振替え又は他の繰越しの対象となつていない場合には、当該上限の十パーセントの限度内において次の十二箇月の期間の同一の個別上限に繰り越し加算することができる。
The unused portions of the specific ceilings by category may be carried over and added to the same specific ceilings for the following year within the limits of 10% of the said ceiling, if the specific ceilings have not been subject to a transfer or to a carry-over of another kind.
3 日本国政府が適当な時に書面で要請する場合には、合意された各上限の五パーセントの限度内において、次の十二箇月について定められた上限から先取りが認められる。ただし、日本国政府は、特に季節的要因を考慮に入れ、すべての分類の綿製品の輸出が年間を通じてできる限り均等に行なわれるよう努力する。先取りの量は、次の十二箇月の上限から控除される。
3. Within the limits of 5% of each of the ceilings agreed upon, anticipation shall be authorized from the ceiling established for the following annual period, if the Government of Japan so requests in writing in due time; the Government of Japan, however, shall endeavour to ensure that exports of cotton textiles of all categories are spaced out as regularly as possible over each of the annual periods, taking seasonal factors in particular into account. Amounts delivered in anticipation shall be deducted from the ceilings for the following annual period.
第五条 日本国政府及びベネルックス諸国政府は、ベネルックスに仕向けられる日本国の綿製品の輸出及びこれに対応するベネルックス諸国への輸入に関する情報を交換する。各政府は、この協定の適用にあたり、自国が用いる分類方法を適用することができるものとし、また、このようにして提供された情報の比較を容易にするため協力する。
Article 5 The Government of Japan and the Governments of the Benelux countries will exchange all information relating to exports of cotton textiles from Japan to the Benelux countries and to the corresponding imports into these countries. Each of the Governments will, for the purpose of this Agreement, apply classification available to it and will co-operate in facilitating comparison of information thus supplied.
第六条 ベネルックス諸国政府が日本国政府に対し、この協定の実施について、ベネルックス諸国の輸入者と日本国の輸出者との間の現行の取引関係の維持について困難が生じた旨を通報した場合には、日本国政府及びベネルックス諸国政府は、この引取関係の維持を確保するため必要なあらゆる措置をとる目的をもつて協議を行なう。
Article 6 In case the Governments of the Benelux countries inform the Government of Japan that difficulties have arisen, in application of this Agreement, regarding the maintenance of existing commercial relations between importers in the Benelux countries and their suppliers in Japan, the Government of Japan and the Governments of the Benelux countries will consult each other in order to take all necessary measures to ensure the maintenance of these commercial relations.
第七条 日本国政府及びベネルックス諸国政府は、いずれか一方の政府の要請があつたときは、この協定の実施から生ずるすべての問題について協議する。
Article 7 The Government of Japan and the Governments of the Benelux countries undertake to consult each other, at the request of either Government, on all problems arising from the implementation of this Agreement.
されに、日本国政府及びベネルックス諸国政府は、綿製品の貿易全般に関し、日本国政府の代表者と欧州経済共同体の加盟国政府及び委員会の代表者との間の協議に毎年参加することに同意する。
Furthermore, the Government of Japan and the Governments of the Benelux countries agree to take part each year in consultations between the representatives of the Government of Japan and the representatives of the Government of the Member States and of the Commission of the European Economic Community regarding the overall aspects of trade in cotton textiles.
第八条 この協定は、オランダ王国については、同王国の欧州地域にのみ適用される。
Article 8 As regards the Kingdom of the Netherlands, the present Agreement shall apply only to the territory of the Kingdom situated in Europe.
この協定は、署名の日に効力を生じ、かつ、千九百六十九年十月一日から十二箇月の期間適用される。
The present Agreement shall enter into force on the date of the signature and shall be applied for the period of twelve months form Octobers 1, 1969.
ジュネーヴ取極の有効期間を延長する議定書第四項の規定は、この協定について適用される。その規定が適用される場合には、この協定中の約束は、適当な形式に修正される。
The provisions of paragraph 4 of the Protocol extending the Geneva Arrangement shall be applicable to the present Agreement. In case of their application, the under-takings contained in the present Agreement shall be modified in an appropriate form.
この協定の附属書は、協定の不可分の一部をなす。
The annex to the present Agreement forms an integral part thereof.
以上の証拠として、下名の代表者は、正当な委任を受けてこの協定に署名した。

Tokyo, October 22, 1969
書簡をもつて啓上いたします。本使は、ベネルックス諸国政府と日本国政府との間で行なわれ、綿製品の貿易に関する協定の署名に至つた交渉の妥結にあたり、ベネルックス諸国政府に代わつて次の了解を確認する光栄を有します。
Excellency, At the conclusion of the negotiations that took place between the Governments of the Benelux countries and the Government of Japan and which led to the signature of the Agreement concerning trade in cotton textiles, we have the honour to confirm, on behalf of the Governments of the Benelux countries, the following understandings:
1 欧州経済共同体における特殊の事情にかんがみ、前記の協定は、欧州経済共同体の他のすべての加盟国政府と日本国政府との間に同様の二国間協定がジュネーヴ取極第四条の規定に従つて署名されたときにのみ適用されることとなる。
1. In consideration of certain elements proper to the European Economic Community, the above-mentioned Agreement will be applicable only when similar bilateral agreements between the Governments of the other Member States of the EEC and the Government of Japan have been signed in accordance with the provisions of Article 4 of the Geneva Arrangement.
2 前記の協定のいかなる規定も、ベネルックス諸国政府と日本国政府との関係において存在する綿製品の自由化の現状に影響を与えるものと解してはならない。
2. No provision of the Agreement shall be interpreted as affection the present state of liberalisation in respect of cotton textile products which exists in the relations between the Benelux countries and Japan.
3 関係品目の輸入の急速かつ重要な増大が市場かく乱をおこす場合又はおこすおそれがある場合にのみ、ベネルックス諸国政府は、協定第三条(ｃ)に基づいて個別上限を設定するよう要請するものと了解される。
3. It is understood that the Governments of the Benelux countries will request a specific ceiling to be fixed in accordance with Article 3 c) of the Agreement only when rapid and substantial growth in deliveries of the pro-ducts concerned causes or threatens to cause disruption of the market. Pending the results of the consultations provided for in the said Article, the Government of Japan shall maintain, as from the date of the request, exports of the products in question at a level corresponding, pro rata temporis, to 105% of the exports effected during the most recent twelve-month period for which statistics are available.
同条に定める協議の結果が得られるまでの間、日本国政府は、要請の行なわれる日から、当該品目の輸出を、統計資料が入手可能な最近の十二箇月間に行なわれた輸出の百五パーセントを期間比例按分したものに相当する水準に維持する。
本使は、閣下が日本国政府に代わつて前記の了解を確認されれば幸いであります。
We shall be grateful if Your Excellency is good enough to confirm the above-mentioned understandings on behalf of the Government of Japan.
