AGREEMENT ON FISHERIES BETWEEN JAPAN AND NEW ZEALAND
日本国政府及びニュー・ジーランド政府は、
The Government of Japan and the Government of New Zealand,
ニュー・ジーランドに隣接する水域における日本国の船舶による漁業に関する協定を締結することを希望して、
Desiring to conclude an agreement concerning fishing by Japanese vessels in waters adjacent to New Zealand,
次のとおり協定した。
Have agreed as follows:
第一条 この協定の適用上、「区域」とは、ニュー・ジーランドの領海に接続する水域で、ニュー・ジーランドの領海が測定される基線から十二海里までのものをいう。
ARTICLE I For the purpose of this Agreement "the Area" means the waters which are contiguous to the territorial sea of New Zealand and extend to a limit of twelve nautical miles from the base line from which the territorial sea of New Zealand is measured.
第二条 日本国の船舶及びその船上にある者は、日本国政府により正当に許可を受けた日本国の船舶が、母船の隻数及びそのトン数に関して両国政府間で合意する規模で、区域内の次に掲げる水域のうちニュー・ジーランドの領海が測定される基線から六海里と十二海里との間の部分において、千九百七十年十二月三十一日までの間、底はえなわ漁業に従事することがある場合を除くほか、区域内で漁業に従事しない。
ARTICLE II Japanese vessels and persons on board those vessels will not engage in fishing in the Area, except that, until 31 December 1970, Japanese vessels duly licensed by the Government of Japan may engage in bottom fish long-line fishing on a scale to be agreed upon between the two Governments in terms of the number of mother ships and their tonnage, within the waters between six and twelve nautical miles from the base line from which the territorial sea of New Zealand is measured, in that part of the Area:
(a) ニュー・ジーランド北島及びこれに近接している諸島の地先沖合
(a) Off the coast of the North Island of New Zealand and adjacent islands; and
(b) 南緯四十一度三十分以北及び東経百七十二度三十分以東のニュー・ジーランド南島北部及びこれに近接している諸島の地先沖合
(b) Off the northern coast of the South Island of New Zealand and adjacent islands, north of 41'30' South Latitude and east of 1720 East Longitude.
第三条 日本国の船舶によるこの協定の規定の違反については、日本国の当局又はニュー・ジーランドの当局のいずれか一方により措置が執られる。両国政府は、それぞれの管轄権の行使に関して従うべき取極を行なうことができる。
ARTICLE III Any infringement of the provisions of this Agreement by a Japanese vessel will be dealt with either by the Japanese or by the New Zealand authorities, and the two Governments may make arrangements in accordance with which their respective jurisdictions will be exercised.
第四条 ニュー・ジーランドの当局は、区域内において、日本国の船舶の許可証を検査し、及びこの協定の規定が遵守されていることを確かめるため、その船舶に臨むことができる。
ARTICLE IV The New Zealand authorities may visit Japanese vessels within the Area to inspect their licences and to ascertain that the provisions of this Agreement are being observed.
第五条 両国政府は、いずれか一方の政府の要請があつたときは、この協定の実施について協議を行なうものとする。
ARTICLE V Upon the request of either Government, the two Governments shall hold consultations regarding the implementation of this Agreement.
第六条 この協定は、批准されなければならない。批准書は、できる限りすみやかに東京で交換されるものとする。この協定は、批准書の交換の日の後三十日目の日に効力を生ずる。
ARTICLE VI This Agreement shall be subject to ratification. The instruments of ratification shall be exchanged at Tokyo as soon as possible. The Agreement shall enter into force on the thirtieth day after the date of exchange of the instruments of ratification.
以上の証拠として、下名は、それぞれの政府から正当に委任を受け、この協定に署名した。

書簡をもつて啓上いたします。本使は、本日署名された日本国とニュー・ジーランドとの間の漁業に関する協定第二条に関し、日本国政府に代わつて、次の了解を確認する光栄を有します。
Your Excellency, With reference to Article II of the Agreement on Fisheries between Japan and New Zealand signed today, I have the honour on behalf of the Government of Japan to confirm the following understandings:
1 区域内で底はえなわ漁業に従事するための許可を受ける日本国の母船の数は、いかなる時においても十七隻をこえない。
1. The number of Japanese mother ships licensed to engage in bottom fish long-line fishing in the Area will not at any time exceed seventeen.
2 当初の許可を受ける母船は、約七百総トンの母船一隻を除き、五百総トンをこえない。これらの母船のいずれかが代替される場合は、その代船は、規模において同じ階層のものであり、かつ、いかなる場合ても五百総トンをこえない。
2. The mother ships which are initially licensed to operate will not be of more than 500 gross tons with the exception of one mother ship of approximately 700 gross In case any of these mother ships tons. is to be replaced, the replacing ship will be of the same class as to size and in any case not of more than 500 gross tons.

書簡をもつて啓上いたします。本使は、本日署名された日本国とニュー・ジーランドとの間の漁業に関する協定第三条に関し、日本国政府に代わつて、次の了解を確認する光栄を有します。
Your Excellency, With reference to Article III of the Agreement on Fisheries between Japan and New Zealand signed today, I have the honour on behalf of the Government of Japan to confirm the following understandings:
1 ニュー・ジーランドの管轄権を害することなく、日本国の船舶による協定の規定の違反を処理することは、第一次的には日本国政府の責任である。
1. Without prejudice to New Zealand Jurisdiction, it will be primarily the responsibility of the Government of Japan to deal with any infringement of the provisions of the Agreement by a Japanese vessel.
(1) したがつて、日本国の船舶が協定の規定に違反していることをニュー・ジーランドの当局により発見されたときは、同当局は、日本国の当局に対しその違反を通告する。ニュー・ジーランドの当局は、適当と認める場合には、その違反の証拠を提供することができる。
(1) Accordingly, if any Japanese vessel is found by the New Zealand authorities to be infringing the provisions of the Agreement, they will notify the Japanese authorities of the infringement. In appropriate cases they may furnish evidence of the infringement.
(2) 日本国の当局は、かかる通告があつたときは、必要な措置を執り、かつ、執られたすべての措置についてニュー・ジーランドの当局に通報する。
(2) When they receive any such approach, the Japanese authorities will take the necessary action and will keep the New Zealand authorities informed of all measures taken.
2 この取極は、いずれか一方の政府が終了の通告を行なつてから三箇月で終了する。
2. These arrangements may be terminated at any time by either Government on giving three months' notice to that effect.

本日署名された日本国とニュー・ジーランドとの間の漁業に関する協定に関連し、日本国政府及びニュー・ジーランド政府の代表は、次の事項を記録することに合意した。
In connection with the Agreement on Fisheries between Japan and New Zealand signed today, the representatives of the Government of Japan and the Government of New Zealand have agreed to record the following:
1 日本国の当局は、この協定の発効の時に、ニュー・ジーランドの当局に対し、区域内で底はえなわ漁業に従事することを許可された日本国の母船の船名、登録番号及び総トン数を記載した表を提供し、及び、母船が代替式されるときは、許可を受ける代船について同様の情報を送付する。
1. The Japanese authorities will, upon the entry into force of the Agreement, furnish the New Zealand authorities with a list of the Japanese mother ships licensed to engage in bottom fish long-line fishing in the Area, giving the names, registration numbers and gross tonnage; and will convey to the New Zealand authorities similar information about licensing of replacement vessels when replacement takes place.
2 日本国の当局は、また、区域内で底はえなわ漁業に従事することを許可された日本国の母船の予定操業期間一可能な場合には、区域への到着及び区域からの出発の予定日を含む。)について通報する。
2. The Japanese authorities will also keep the New Zealand authorities informed of the scheduled operation periods (including expected dates of arrival at and departure from the Area, if possible) of Japanese mother ships licensed to engage in bottom fish long-line fishing in the Area.
3 日本国政府は、区域内で底はえなわ漁業に従事することを許可された日本国の船舶により漁獲されるまだいが尾叉長二十五・四センチメートル(十インチ)よりも小さくないことを確保するために必要な措置を執る。
3. The Government of Japan will take necessary measures to ensure that the length of snapper to be harvested by Japanese vessels engaged in bottom fish long-line fishing in the Area will not be less than 25.4 centimetres (l0 inches) in fork length.

Your Excellency, With reference to the Agreement on Fisheries between Japan and New Zealand signed today, I have the honour on behalf of the Government of Japan to confirm the understanding reached between the two Governments that, pending the entry into force of the Agreement in accordance with Article VI there-of, the two Governments will give provisional effect to the Agreement and its related documents, insofar as may be practicable within the limits of their constitutional authority, as from such date as may be notified by the Government of New Zealand to the Government of Japan.
