　日本国政府とマルタ政府との間の貿易協定

　TRADE AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF MALTA

　日本国政府及びマルタ政府は、両国間の貿易関係を拡大し、及び強化することを希望して、次のとおり協定した。

　The Government of Japan and the Government of Malta, in their desire to expand and strengthen the trade relations between their two countries, have agreed as follows:

第一条
　日本国政府及びマルタ政府は、現存の相互貿易関係をあらゆる可能な方法で改善するよう努力するものとする。

Article 1
　The Government of Japan and the Government of Malta shall endeavour to improve in every possible way existing mutual trade relations.

　各国政府は、日本国とマルタとの間の貿易を促進し、かつ容易にするために、関税及び貿易に関する一般協定の締約国としてそれぞれの国が有し又は有することあるべき権利及び義務に従い、両国間の貿易に関して、最恵国待遇を与えるものとする。

　In order to promote and facilitate trade between Japan and Malta, the Government of each country will grant the most-favoured-nation treatment in respect of trade between the two countries in accordance with the rights and obligations which each country has or may have as a Contracting Party to the General Agreement on Tariffs and Trade.

第二条
　両国政府は、両国の経済的及び社会的開発に資するため、両国間の経済、技術協力の妥当な形態を見出すよう努力するものとする。

Article 2
　With a view to contributing to the economic and social development of their respective countries, the two Governments shall endeavour to find the appropriate form of economic and technical cooperation between the two countries.

第三条
　両国間のすべての支払は、それぞれの国の法令の範囲内で、ポンド・スターリング又は他の自由に交換可能な通貨により行なうものとする。

Article 3
　All payments between the two countries shall be effected in pounds sterling or in other freely convertible currencies within the scope of the laws and regulations of the respective countries.

第四条
　混合委員会を設置するものとし、この委員会は、いずれか一方の政府の要請に基づき、かつ、可能な場合には、提案された期日に会合するものとする。混合委員会の任務は、この協定の実施に関して生ずる問題を明確にすることにある。混合委員会は、両国政府の代表により構成される。

Article 4
　A Mixed Commission will be formed which shall meet at the request of either side and, if possible, on the suggested date. It will be the function of the Mixed Commission to clarify any questions or problems which may arise in the carrying out of this Agreement. This Mixed Commission will be composed of representatives of both Governments.

第五条
　両国政府は、見本市及び展示会用の物品及び宣伝用の商品見本については、それぞれの国で施行されている法令に従い、関税を免除するものとする。ただし、これらの物品及び見本を処分するにあたつては、輸入国の権限ある当局の事前の許可を得、かつ、適正な関税を支払わなければならない。

Article 5
　The two Governments shall, subject to the laws and regulations in force in their respective countries, exempt from customs, duties articles destined for fairs and exhibitions as well as samples of goods for advertising purposes provided that such articles and samples shall not be disposed of without the prior permission of the competent authorities of the importing country and payment of the appropriate customs duties.

第六条
　この協定は、署名の日に効力を生ずる。この協定の有効期間は、一年とし、いずれか一方の政府が他方の政府に対し少なくとも三箇月前に書面による終了の通告を行なわない限り、その後一年ずつ自動的に更新される。

Article 6
　This Agreement shall come into force on signature. It shall be valid for one year and shall thereafter be automatically renewed form year to year unless written notice of termination is given by either Government to the other at least three months in advance.

I take pleasure in informing Your Excell that the Government of Malta has withdrawn invocation of Article XXXV of the General Agreement on Tariffs and Trade with regard Japan and that the Director General of G.A. has been informed accordingly.

In the course of the discussions which have led to the signing of the Trade Agreement between the Government of Japan and the Government of Malta it was agreed that the Government of Malta would facilitate, within the scope of its laws and regulations, and in conformity with the principle of non-discrimination, the entry into its territory of the nationals of Japan and their sojourn, travel, residence, and the exercise of various activities therein.

In the course of the recent discussions which have led to the signing of the Trade Agreement between the Government of Malta and the Government of Japan, the Japanese delegation has expressed the readiness of its Government to encourage the promotion of economic and technical cooperation by Japanese business circles interested in participating in the economic development of Malta and to facilitate such economic and technical cooperation within existing possibilities.
