日本国政府と大韓民国政府との間の商標権の相互保護に関する取極（口上書）
口上書
NOTE VERBALE
外務省は、在日本国大韓民国大使館に敬意を表するとともに、商標に関する諸権利の相互保護に関し日本国政府及び大韓民国政府の代表者の間で最近行なわれた会談に言及する光栄を有する。この会談の結果えられた取極は、次のとおりである。
The Ministry of Foreign Affairs presents its compliments to the Embassy of the Republic of Korea and has the honour to refer to the conversations which have recently taken place between the representatives of the Government of Japan and the Government of the Republic of Korea concerning the mutual protection of rights on trade marks. The arrangements reached as a result of these conversations are as follows:
1 大韓民国国民は、日本国の領域内において、日本国の関係法令の下で、商標に関する諸権利の享有に関し、日本国民に与えられる待遇よりも不利でない待遇を与えられる。
1. Nationals of the Republic of Korea shall, within the territories of Japan, be accorded, subject to the relevant laws and regulations of Japan, treatment no less favorable than that accorded to nationals of Japan with respect to the enjoyment of rights on trade marks.
2 日本国民は、大韓民国の領域内において、大韓民国の関係法令の下で、商標に関する諸権利の享有に関し、大韓民国国民に与えられる待遇よりも不利でない待遇を与えられる。
2. Nationals of Japan shall, within the territories the Republic of Korea, be accorded, subject to the relevant laws and regulations of the Republic of Korea, treatment no less favorable than that accorded to nationals of the Republic of Korea with respect to the enjoyment of rights trade marks.
3 1及び2にいう「国民」とは、法人を含む。
3. "Nationals" as referred to in the preceding paragraphs shall include juridical persons
4この取極は、いずれか一方の政府が、他方に対し、六箇月前に文書による予告を与えることにより終了させることができる。
4. The present arrangements may be terminated by either Government giving six months' notice in writing to the other.
外務省は、さらに、この口上書及び前記の取極が大韓民国政府にとつて受諾しうるものであることを確認する大使館の口上書を、政府間の合意を構成するものとみなし、この合意は、大使館の口上書の日付けの日に効力を生ずるものとすることを提案する光栄を有する。
The Ministry has further the honour to propose that the present Note Verbale and the Embassy's Note Verbale in reply thereto confirming the foregoing arrangements to be acceptable to the Government of the Republic of Korea be considered to constitute an agreement between the two Governments which becomes effective as from the date of the Embassy's Note Verbale in reply.
外務省は、以上を申し進めるに際し、ここに重ねて大韓民国大使館に向かつて敬意を表する。
The Ministry avails itself of this opportunity to renew to the Embassy of the Republic of Korea the assurances of its highest consideration.

大韓民国大使館は、外務省に敬意を表するここもに、千九百六十八年十二月三日付けの外務省の次の口上書を受領したことを確認する光栄を有する。
The Embassy of the Republic of Korea presents its compliments to the Ministry of Foreign Affairs and has the honour to acknowledge the receipt of the latter's Note Verbale dated December 3, 1968, which reads as follows:

大使館は、さらに、外務省の口上書に述べられた取極が大韓民国政府にとり受諾しうるものであることを確認するとともに、外務省の口上書とこの口上書を両政府間の合意を構成するものとみなし、この合意は、この口上書の日付けの日から効力を生ずるものとすることに同意する光栄を有する。
The Embassy has further the honour to confirm that the arrangements set forth in the Ministry's Note Verbale are acceptable to the Government of the Republic of Korea and to agree that the Ministry's Note Verbale and this Note Verbale in reply shall be considered to constitute an agreement between the two Governments to become effective as from the date of this Note Verbale.
