日本国政府とガーナ共和国政府との間のガーナの商業上の債務の弁済期限延長に関する交換公文

　Tokyo, 14 June, 1968

　書簡をもつて啓上いたします。本大臣は、ガーナの居住者である個人、法人及びその他の債務者が負担する商業上の債務の弁済期限の繰延べに関し、千九百六十六年十二月六日から九日までロンドンで開催されたガーナ共和国政府と関係債権諸国政府との間の協議において到達した了解に基づいて日本国政府の代表者及びガーナ共和国政府の代表者の間で最近到達した次の了解を確認する光栄を有します。

　Excellency,
I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and the Government of the Republic of Ghana concerning the rescheduling of repayment period of the commercial debts owed by persons, corporations and other debtors resident in Ghana, on the basis of the understanding reached during the consultations between the Government of the Republic of Ghana and the Governments of the creditor countries concerned held at London from 6 December to 9 December 1966.

一(a)　ガーナ共和国政府は、ガーナの居住者である債務者と日本国の居住者である債権者との間で、千九百六十六年二月二十四日以前に契約され、かつ、千九百六十六年六月一日から千九百六十九年六月三十日までの間に弁済期限が到来する商業上の債務で、原契約による弁済期限が一年をこえるが十二年をこえないもののうち本書簡の日付の日において弁済の行なわれていない商業上の債務に関し、前記の債務者が(c)(i)、(ii)及び(iii)に定める弁済計画に基づいてその債務の弁済期限を延長することを前記の債権者に要請するよう配慮する。

1.(a) The Government of the Republic of Ghana will see to it that the debtors resident in Ghana should request the creditors resident in Japan to extend the repayment period, in accordance with the repayment scheme set out in sub-paragraphs (c)(i), (ii) and (iii) below, with respect to commercial debts outstanding at the date of the present note with an original repayment period exceeding one year, but not exceeding twelve years contracted between such creditors and debtors before 24 February, 1966 and falling due between 1 June, 1966 and 30 June, 1969, both dates inclusive.

(b)　日本国政府は、日本国の居住者である債権者が(a)にいう商業上の債務に関し、(c)(i)、(ii)及び(iii)に定める弁済計画に基づく弁済期限の延長のためにガーナの居住者である債務者が行なう要請に応ずることを容易にするため、日本国において施行されている法令の範囲内で、可能な措置を執る。

(b) The Government of Japan will take possible measures, within the scope of the laws and regulations in force in Japan, to facilitate the creditors resident in Japan in complying with the requests of the debtors resident in Ghana for the extension of the repayment period, according to the repayment scheme set out in sub-paragraphs (c)(i), (ii) and (iii) below, with respect to the commercial debts mentioned in sub-paragraph (a) above.

(c)(i)　前記の(a)にいう商業上の債務のうち、弁済期限が延長される元本の総額は、五百十八万二百十四合衆国ドル八十一セント(五、一八〇、二一四・八一合衆国ドル)であると見積られている。

(c)(i) Out of the commercial debts mentioned in sub-paragraph (a) above, the total amount of the principals, the repayment period of which will be rescheduled, is estimated to be five million one hundred eighty thousand two hundred fourteen United States dollars and eighty one cents (U.S.$5,180,214.81).

　この額は、千九百六十六年六月一日から千九百六十八年六月三十日までの間に弁済期限の到来する商業上の債務の元本の百パーセント及び千九百六十八年七月一日より千九百六十九年六月三十日までの間に弁済期限の到来する商業上の債務の元本の約五十パーセントから成つている。

　This amount consists of hundred per cent (100%) of the principals of those commercial debts falling due between 1 June, 1966, and 30 June, 1968, both dates inclusive, and approximately fifty per cent (50%) of the principals of those falling due between 1 July, 1968 and 30 June, 1969, both dates inclusive.

(ii)　前記の(i)にいう額は、次の計画に基づいて弁済される。

(ii) The amount mentioned in the preceding sub-paragraph (i) will be repaid according to the following scheme:

　弁済は、各年の七月、十月、一月及び四月の第一日に行なわれる。

　The repayment will be made on the first day of July, October, January and April of each year.

(iii)　前記の(a)にいう商業上の債務の利子は、各債務の原弁済期限に支払われる。ただし、千九百六十六年六月一日から千九百六十八年六月三十日までの間に弁済期限の到来した商業上の債務の利子は、次の分割支払方法に基づいて支払われる。

(iii) The interest of the commercial debts mentioned in sub-paragraph (a) above will be paid on the original date of maturity of the respective debt, except for the interest of those commercial debts falling due between 1 June, 1966, and 30 June, 1968, both dates inclusive, which will be paid according to the following instalments:

(1)　一六・六六パーセント　千九百六十八年　七月一日

(1) 16.66%  lst July 1968

(2)　一六・六六パーセント　千九百六十八年　八月一日

(2) 6.66%  lst August 1968

(3)　一六・六六パーセント　千九百六十八年　九月一日

(3) 16.66%  lst September 1968

(4)　一六・六六パーセント　千九百六十八年　十月一日

(4) 16.66%  lst October 1968

(5)　三三・三六パーセント　千九百六十八年十二月一日

(5) 16.66%  lst December 1968

二(a)(i)　ガーナ共和国政府は、当該債権者に対し、元本の弁済期限の延長から生ずる延滞利子を四半期ごとに千九百六十八年以降の各年の七月、十月、一月及び四月の第一日に支払う。ただし、千九百六十八年七月一日に支払われることとなる延滞利子については、次の二(a)(ii)にいう方法による。

2.(a)(i) The Government of the Republic of Ghana will pay to the creditors concerned moratorium interest accruing from the extension of the repayment period of principals quarter-yearly on the first day of July, October, January and April of each year starting in 1968. However, the moratorium interest to be paid on lst July 1968 will be paid in the manner mentioned in sub-paragraph 2 (a) (ii) below.

(ii)　次の延滞利子の支払は、前記一(c)(iii)に掲げる分割支払方法に従つて行なわれる。

(ii) The payments of the following moratorium interests will be made according to the instalments set forth in sub-paragraph 1 (c) (iii) above:

(1)　前記二(a)(i)の第一文に従つて千九百六十八年七月一日に支払われるべき延滞利子

(1) The moratorium interest to be paid on lst July 1968 according to the first sentence of sub-paragraph 2 (a) (i) above;

(2)　前記二(a)(ii)(1)にいう延滞利子の支払延期から生ずる延滞利子

(2) The moratorium interest accruing from the deferment of the payment of the moratorium interest mentioned in sub-paragraph 2 (a) (ii) (1) above;

(3)　前記一(c)(iii)にいう利子の支払延期から生ずる延滞利子

(3) The moratorium interest accruing from the deferment of the payment of the interest mentioned in sub-paragraph 1 (c) (iii) above.

(b)　延滞利子率は、債務の基因となつた契約において、満期後の支払のために明記された利子率により支払われるか、又は、利子率が明記されていないときは、年六・二五パーセントの利子率で支払われる。

(b) Moratorium interest will be paid at the rate expressly stipulated for post-maturity payments in the contract under which the debt is incurred or, when no interest rate is so stipulated, at the rate of six and a quarter (6.25) per cent per annum.

三　千九百六十六年二月二十四日以前に契約され、かつ、千九百六十六年六月一日から千九百六十八年十二月三十一日までの間に期限が到来する商業上の債務で、ガーナの居住者である債務者が日本国以外のいずれかの国に居住する債権者に対して負担するものについてガーナ共和国政府が、いずれかの時点において、前記一(c)に定める条件よりも当該債権者にとつて有利な条件で商業上の債務の決済のための取極を行なつた場合には、ガーナ共和国政府は、前記一(a)にいう商業上の債務の決済のため、これよりも不利でない条件を直ちに与える。

3. If the Government of the Republic of Ghana makes at any time arrangements for the settlement of commercial debts contracted before 24 February, 1966 and falling due between 1 June, 1966 and 31 December, 1968, both dates inclusive, which the debtors resident in Ghana owe to the creditors resident in any country other than Japan, on terms which are more favourable to the creditors concerned than those provided for in sub-paragraph 1 (c) above, the Government of the Republic of Ghana shall forthwith accord no less favourable terms for the settlement of the commercial debts mentioned in sub-paragraph 1 (a) above.

四　ここに取り扱われている事項以外の事項は、前記一(a)にいう契約の当事者間において合意されるところによる。弁済期限の延長から生ずる銀行手数料は、ガーナの居住者である債務者により負担される。

4. Matters other than those dealt with herein shall be as agreed upon between the parties to the contracts mentioned in sub-paragraph 1 (a) above. Bank charges incidental to the extension of the repayment period shall be borne by the debtors resident in Ghana.

五　ガーナ共和国政府は、前記の繰延計画に基づいて弁済期限が延長される商業上の債務に関し、すべての元本の弁済及び利子の支払が原契約により指定された通貨によつて行なわれることを保証する。

5. The Government of the Republic of Ghana shall ensure that all repayment of principal and payment of interest, in respect of the commercial debts, the repayment period of which will be extended in accordance with the above-mentioned rescheduling, shall be made in the currency or currencies which were designated in the original contracts.

　本大臣は、閣下が貴国政府に代わつて前記の了解を確認されれば幸いであります。
