日本国とアメリカ合衆国との間の相互防衛援助協定に基づくホーク・ミサイル・システム及びナイキ・ハーキュリーズ・ミサイル・システムの取得及び生産に関する交換公文

　Tokyo, October 13, 1967

　書簡をもつて啓上いたします。本官は、千九百五十四年三月八日に署名されたアメリカ合衆国と日本国との間の相互防衛援助協定に言及する光栄を有します。同協定は、各政府が、他方の政府に対し、援助を供与する政府が承認することがある装備、資材、役務その他の援助を、両政府の間で行なうべき細目取極に従つて、使用に供するものとすることを特に規定しています。

　Excellency,I have the honor to refer to the Mutual Defense Assistance Agreement between the United States of America and Japan singed on March 8, 1954, which provides, inter alia, that each Government will make available to the other such equipment, materials, services, or other assistance as the Government furnishing such assistance may authorize, in accordance with such detailed arrangements as may be made between them.

　アメリカ合衆国政府及び日本国政府の代表者は、日本国の対空防衛を強化するために必要なホーク・ミサイル・システム及びナイキ・ハーキュリーズ・ミサイル・システム(非核弾頭専用に改修された型)並びに関連指揮装置(以下「システム」と総称する。)の取得及び日本国における生産に関する計画について討議を行ないました。この討議の結果による合衆国政府の了解は、次のとおりであります。

　The representatives of the Government of the United States of America and the Government of Japan held discussions on the program of the acquisition and production in Japan of the Hawk missile system and the Nike Hercules missile system (adapted for non-nuclear warheads) and related control systems (hereinafter jointly referred to as the "Systems:) necessary to enhance the air defense of Japan. The following is the understanding by the Government of the United States of America of the results of the above-mentioned discussions.

1　3の規定に基づき締結される細目取極に従い、日本国政府は、システムを購入し又は生産し、合衆国政府は、これを販売し又は生産を承認する。

1.　In accordance with the detailed arrangements to be concluded under paragraph 3 below, the Government of Japan will buy or produce and the Government of the United States of America will sell or authorize the production of the Systems.

2　システムは、合衆国企業による援助を受けた日本国の民間企業の能力を可能な限り活用して入手される。必要に応じて、合衆国政府は、日本国政府に直接販売を行ない、この計画の実施を補足するものとする。

2.　The Systems will be acquired to the maximum feasible extent through the private industrial capabilities of Japan as supplemented by such capabilities in the United States of America. When necessary, the program will be further implemented by direct sale by the Government of the United States of America to the Government of Japan.

3　この了解は、前記の協定及びこれに基づく取極(昭和三十一年三月二十二日に署名された防衛目的のためにする特許権及び技術上の知識の交流を容易にするためのアメリカ合衆国政府と日本国政府との間の協定を含む。)に従つて実施されるものとし、その実施のための細目取極は、両政府の権限のある当局の代表者により締結されるものとする。

3.　The present understanding will be implemented in accordance with the above-mentioned Mutual Defense Assistance Agreement and arrangements concluded thereunder, including the Agreement between the Government of the United States of America and the Government of Japan to facilitate Interchange of Patent Rights and Technical Information for Purposes of Defense signed on March 22, 1956. The detailed arrangements to implement the present understanding will be concluded between representatives of the competent authorities of the two Governments.

4　この了解及びこれに基づき締結されるすべての取極に基づいていずれか一方の政府が負担する財政上の債務又は支出は、それぞれの国の憲法上の規定に従つた予算上の承認を得ることを条件とする。

4.　Financial obligations or expenditures incurred by either Government under the present understanding and all arrangements to be concluded hereunder will be subject to budget authorization pursuant to the constitutional provisions of the respective countries.

　本官は、この了解が日本国政府により受諾される場合には、この書簡及び受諾する旨の閣下の返簡をその返簡の日付の日に効力を生ずる両政府間の合意を構成するものとみなすことを提案する光栄を有します。

　I have the honor to propose that, if the above understanding is acceptable to the Government of Japan, the present note and Your Excellency's reply of accpetance shall be regarded as constituting an agreement between the two Governments which shall enter into force on the date of Your Excellency's reply.

　本官は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

　I avail myself of this opportunity to renew to Your Excellency the assurance of my highest consideration.

　Sir,I have the honour to acknowledge receipt of your note of today's date, which reads as follows:

　本大臣は、日本国政府が前記の了解を受諾することを日本国政府に代わつて確認し、貴官の書簡及びこの返簡をこの返簡の日付の日に効力を生ずる両政府間の合意を構成するものとみなすことに同意する光栄を有します。

　I have the honour the confirm on behalf of my Government that the foregoing understanding is acceptable to the Government of Japan and to agree that your note and this reply shall be regarded as constituting an agreement between the two Governments which shall enter into force on the date of this reply.

　本大臣は、以上を申し進めるに際し、ここに重ねて貴官に向かつて敬意を表します。
