Agreement between the Government of Japan and the Government of the Republic of Indonesia concerning the Grant to Indonesia
日本国政府及びインドネシア共和国政府は、
The Government of Japan and the Government of the Republic of Indonesia,
インドネシアの経済安定復興計画の実施のために必要とされる物資及び役務を供給する目的のためインドネシアに供与される日本国の援助に関して両国政府間で行なわれた千九百六十七年六月九日の交換公文を想起し、
Recalling the Exchange of Notes of June 9, 1967 effected between the two Governments, regarding Japanese assistance to be extended to Indonesia for the purpose of facilitating the supply of goods and services needed in Indonesia for the implementation of its economic stabilization and rehabilitation programme,
インドネシアにおける現下の経済情勢が同交換公文に予想された贈与を即時に具体化することを必要としていることを認め、
Recognizing that the economic situation currently prevailing in Indonesia pressingly calls for an immediate materialization of the extension of the grant envisaged in the said Exchange of Notes,
贈与を具体化し、かつ、その条件を定めるための取極を行なうことを希望して、
Desiring to make arrangements for materializing the extension of the grant and for setting forth the terms and conditions thereof,
次のとおり協定した。
Have agreed as follows:
第一条 1 日本国政府は、インドネシア共和国政府に対し、三十六億円(三、六〇〇、〇〇〇、〇〇〇円)の額の贈与を、日本国の関係法令に従い、行なうものとする。
Article 1 1. The Government of Japan shall extend to the Government of the Republic of Indonesia a grant in the amount of three billion six hundred million yen (3,600,000,000) in accordance with the relevant laws and regulations of Japan.
2 この贈与は、千九百六十六年十月三日に制定され、その後諸規則により詳細に規定されたインドネシアの輸入制度に準拠し、かつ、日本国の関係法令に従つて、日本の供給者とインドネシアの輸入者との間で締結される円貨による契約に基づく日本国の生産物及び日本人の役務の購入のために、この協定の効力発生の日から使用に供される。
2. The grant shall be made available, as from the coming into force of the present Agreement, for the purchase of product of Japan and services of Japanese people under such contracts as may be entered into in Japanese yen between Japanese suppliers and Indonesian importers on the basis of Indonesian import system as introduced on October 3, 1966, subsequently elaborated in various regulations and in accordance with the relevant laws and regulations of Japan.
第二条 1 日本国政府は、第一条２に定める契約により輸入者が負う債務にあてるための支払を、第五条の規定に基づいて定める手続に従い、インドネシア共和国政府の名義で東京銀行本店に開設される贈与勘定を通じて、日本円で行なうものとする。
Article 2 1. The Government of Japan shall, in accordance with the procedures to be determined under Article 5 of the present Agreement, make payments in Japanese yen to cover the obligations incurred by the Indonesian importers under the contracts referred to in paragraph 2 of Article 1, through a Grant Account to be opened with the head office of The Bank of Tokyo in the name of the Government of the Republic of Indonesia.
2 日本国政府は、１の規定に基づく支払を行なうことにより、その支払を行なつた時に、第一条の規定に従いその支払の金額までインドネシア共和国政府に対する贈与を行なつたものとみなされる。
2. By and upon making a payment under the preceding paragraph, the Government of Japan shall be deemed to have extended the grant to the Government of the Republic of Indonesia to the extent of the amount of such payment in accordance with Article 1 of the present Agreement.
第三条 この協定に基づいて供与された日本国の生産物は、インドネシアの領域から再輸出してはならない。
Article 3 The products of Japan supplied under the present Agreement shall not be re-exported from the territories of the Republic of Indonesia.
第四条 両国政府は、この協定から又はそれに関連して生ずることがあるいかなる事項についても相互に協議する。
Article 4 The two Governments shall consult with each other in respect to any matter that may arise from or in connection with the present Agreement.
第五条 この協定の実施に関する手続その他の細目は、両国政府間の取極でさらに規定するものとする。
Article 5 Details including procedures for the implementation of the present Agreement shall be further specified in an Arrangement between the two Governments.
第六条 この協定は、署名の日に効力を生ずる。
Article 6 The present Agreement shall come into force on the date of signature.
以上の証拠として、下名は、それぞれの政府から正当に委任を受け、この協定に署名した。
IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Governments, have signed the present Agreement.
