日本国政府とインドネシア共和国政府との間のインドネシアの対日延払債務に対する再融資に関する交換公文

Djakarta, June 9,1967.
書簡をもつて啓上いたします。本使は、千九百六十六年十二月十九日から十二月二十日までパリで開催された会合においてインドネシア共和国の代表と同国の主要債権国の代表との間に到達した了解に従つて、インドネシア共和国が自国の現在の外国為替事情の要請に対処することを援助するためのインドネシア共和国に対する日本国の資金援助について、日本国政府の代表とインドネシア共和国政府の代表との間で最近行なわれた会談に関し、その会談において到達した次の了解を確認する光栄を有します。
Excellency,With reference to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Indonesia, that were held pursuant to the understanding reached between the representatives of the Republic of Indonesia and her principal creditor countries at the meeting held at Paris form December 19 to December 20,1966, regarding the Japanese financial assistance to the Republic of Indonesia to help the latter meet the present requirements of her foreign exchange position, I have the honour to confirm the following understanding reached in the course of the said negotiations.
1 インドネシア共和国に対する資金援助は、この書簡の2に定める日本国に対するインドネシア共和国の債務の再融資の形で、かつ、日本国の関係法令に従つて供与される。
1. The financial assistance to the Republic of Indonesia will be extended in the form of refinancing of such Indonesian debts to Japan as are defined in paragraph 2.of this Note and in accordance with the relevant laws and regulations of Japan.
2 再融資は、日本国政府が保証した百八十日をこえる信用で千九百六十六年七月一日以前に効力を生じた契約に基づくものに係る債務であつて、千九百六十六年六月三十日に支払期限が到来し、かつ、未支払であつたもの及び千九百六十六年七月一日から千九百六十七年十二月三十一日までの間に支払期限が到来するものの元本及び利子の百パーセントについて適用される。
2. The refinancing shall cover one hundred (100) percent of principal and interest of debts due and unpaid on June 30,1966, as well as debts falling due from July 1,1966 up to December 31,1967, relating to credits of more than 180 days, insured by the Government of Japan and relating to contracts entered into force prior to July 1,1966.
3 日本輸出入銀行(以下「輸銀」という。)は、1及び2にいう債務の再融資のために、インドネシア中央銀行に対し、輸銀とインドネシア中央銀行との間に締結される借款契約(以下「借款契約」という。)に従い、現行の国際通貨基金平価で換算して四千五百万ドル(四五、〇〇〇、〇〇〇ドル)に相当する元金の額百六十二億円(一六、二〇〇、〇〇〇、〇〇〇円)を暫定的に決定された限度とする借款を交換可能な日本円で使用に供することとなる。この限度は、借款契約の締結の時に確定される。借款契約は、なかんずく次の原則を含むものとする。
3. For the purpose of refinancing the debts mentioned in paragraph 1.and2. above, the Export-Import Bank of Japan(hereinafter referred to as "the Eximbank")will make available to the Bank Negara Indonesia a loan in convertible Japanese yen amounting up to the provisionally determined limit of sixteen billion two hundred million yen (16,200,000,000) in principal amount, equivalent to forty five million dollars ($45,000,000) at the present International Monetary Fund parity rate, in accordance with a loan agreement (hereinafter referred to as "The Loan Agreement")to be concluded between the Eximbank and the Bank Negara Indonesia. This limit will be definitely determined at the time of the conclusion of the above Loan Agreement. The Loan Agreement will contain, inter alia, the following principles:
(1) 借款に基づく元金の償還は、次の表に従い八年間にわたつて行なわれる。
(1) The repayment of the principal under the loan shall be made over 8 years in accordance with the following schedule:

(2) 利子率は、年四パーセントとし、インドネシア中央銀行は、随時の未払元金残高について三箇月ごとに利子を支払う。
(2) The rate of interest will be four (4) percent per annum and the Bank Negara Indonesia shall pay the interest quarterly on the balance of principal outstanding from time to time.
もつとも、千九百七十年十二月三十一日までの期間中の前記の利子の支払は、複利計算によることなく猶予されるものとし、千九百七十一年に始まる八年間に均等年賦で行なわれる。
However, the payment of such interest during the period up to December 31,1970 shall be deferred on a non-compounded basis and shall be made on equal annual installments over eight years starting from 1971.
(3)元金の償還及び利子の支払は、インドネシア共和国政府により保証される。
(3) The repayment of principal and payment of interest shall be guaranteed by the Government of the Republic of Indonesia.
4 インドネシア中央銀行は、借款契約に基づく再融資の対象となるすべてのインドネシアの債務の弁済を促進し、インドネシア共和国政府は、これらの債務の支払のための送金の自由を保証する。
4. The Bank Negara Indonesian shall expedite the settlement of all Indonesian debts which are the objects of refinancing under the Loan Agreement and the Government of the Republic of Indonesia shall guarantee the free transferability of the payments thereof.
5 インドネシア共和国政府は、輸銀に対し、借款及びそれから生ずる利子に関し又はそれに関連して課される同国の財政課徴金又は租税を免除する。
5. The Government of the Republic of Indonesia shall exempt the Eximbank from Indonesian fiscal levy or tax and/or in connection with the loan and interest accruing therefrom.
6 両国政府は、この了解から又はそれに関連して生ずるいかなる問題についても相互に協議する。
6. The two Governments shall consult with each other in respect of any matter that may arise from or in connection with the present understanding.
本使は、閣下がインドネシア共和国政府に代わつて前記の了解を確認されれば幸いであります。
I should be grateful if Your Excellency would confirm the foregoing understanding on behalf of the Government of the Republic of Indonesia.

I have the honour to confirm, on behalf of the Government of the Republic of Indonesia that the foregoing correctly sets out the understanding which has been agreed upon in the course of the recent discussions between the representatives of the Government of the Republic of Indonesia and of the Government of Japan.
