Agreed Minutes


　千九百六十七年十一月に東京で、日本国政府の代表とドイツ連邦共和国政府の代表との間で行なわれた討議において、海運に関する意見が交換され、次のように記録することが合意された。

　During the discussions held in Tokyo in November 1967 between the representatives of the Government of Japan and the representatives of the Government of the Federal Republic of Germany, views were exchanged on shipping and it was agreed to record as follows:


　両国政府の代表は、OECD条約に従つて、海上運送に関連する取引及び送金の自由は、為替管理上の措置により、自国船舶の優遇を定める法規により、政府機関若しくは半政府機関による自国船舶の優遇の取極により、貿易協定における優先積取条項により、船籍の選択に影響を及ぼすような輸出入許可制度の運用により、又は差別的な港湾規則若しくは課税措置により、妨げられることがあつてはならないというＯＥＣＤの経常的貿易外取引の自由化に関する規約の条項に、日独両国政府は拘束されることを確認した。

　The representatives of the two Governments confirmed that the two Governments are bound, in accordance with the Convention on the O.E.C.D., by the provisions in the Code of Liberalisation of Current Invisible Operations of O.E.C.D. that the freedom of transactions and transfers in connection with maritime transport should not be hampered by measures in the field of exchange control, by legislative provisions in favour of the national flag, by arrangements made by governmental of semi-governmental organisations giving preferential treatment to national flag ships, by preferential shipping clauses in trade agreements, by the operation of import and export licensing systems so as to influence the flag of the carrying ship, or by discriminatory port regulations or taxation measures.
